[Music] hey guys Michael from Bedell Property Management here and today we're going to talk about how to write terms and conditions for the proposals that you send out to your clients I'm a landscape contractor in the winter months I do snow and ice management and kind of serve the needs of our clientele here in the community that surrounds Milford having terms and conditions in your estimates or proposals is absolutely crucial because it lays the foundation in the groundwork for exactly how that business relationship is going to go from the day it starts all the way through the day it may unfortunately end [Music] so number one is payment terms and that's where you're going to get to set the parameters of when you expect your client to pay you so you can keep going or complete this job a quick tip to think of when using payment terms is it just makes sense to get your client to pay you as quick as possible but at the same time you maybe need to have foresight or if it's a bigger job how much do you need to get paid now how much do you need to get paid later and then ultimately what are you going to leave left to be paid at the end because that can be obviously the most contentious payment number two is any tax terms that you want to include on this and some municipalities or states or federal governments depending on where your business is located you have to have certain taxes that are charged on services and so you're going to want to lay out who is going to be on the hook to pay for those how those are due and when those are due and if they're not and it's not applicable then then it may even just make sense to say something about that in the contract as well [Music] number three is service terms and this is where in writing you're going to get to break down how you intend to complete your work how are you going to handle when weird or bad things or unexpected things come up and you're going to basically explain in writing to the client how this whole thing is going to go down four is scheduled terms and this is where you're going to set the expectation for your client about how long this Project's going to take and what they should expect throughout the duration of the project Pro tip give them a way longer time frame than you will ever need to complete the project when even if things do go wrong you still probably get it done in a shorter time frame than advertised and if things actually go really well on a job for once you literally look like a contractor hero number five is changes terms and this is how the client ought to expect when things have to change there's gonna be concealed contingencies that come across on a job you never know what's behind the wall you're about to open up or what's in the ground below us and once you've dug that hole or opened up that wall you might find something that it requires additional attention or you now have to work around and this is going to give your client in writing a procedure about how you're going to go about dealing with those changes and what expectations are for both parties so number six is your general disclaimer and this is going to be any additional language that you've left out so far in your agreement but you really need to put in there most recently this might have something to do with the change in gas prices or maybe how you want to warranty plant material disclaimers are an important part of the contract because they're your last chance to just clear up any potential misunderstandings that may happen if they weren't in there because at the end of the day you never really know what someone's actual expectations are but you are given the ability by putting together this agreement to certainly level the playing field and let them know what they actually ought to be so I hope some of these tips and tricks are helpful to you guys and remember these are living documents these are going to be based on your unique experiences so take those to heart and make the most of them and ultimately you're in control of making sure that you have the best tomorrow possible so take care be good to each other and we'll see you soon [Music]
