Agreement by Attendee of Halloween Party Not to Drink and Drive or have a Designated Driver Agreement made on the ___________________ (date), between ______________________ (Name of Attendee of Party) of _______________________________________________________ ______________________ (street address, city, state, zip code), referred to herein as Attendee, and ________________________________ (Name of Sponsor of Halloween Party and/or Owner of Location of Party), of ____________________________________________________________ ____________________ (street address, city, state, zip code), referred to herein as Sponsor.Whereas, Sponsor is sponsoring a Halloween Party at _______________________________ _______________________________________ (street address, city, state, zip code), on ________________________ (date), said Halloween Party being herein referred to as the Party; andWhereas, it is a condition of Sponsor that anyone attending said Party must be twenty-one years old and agree not to consume alcohol in or about the premises of Sponsor and then drive a motor vehicle while under the influence of alcohol; and Whereas, the undersigned desires to attend said Party and is willing to enter into and abide by the terms of this Agreement;Now, therefore, for and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Attendee warrants and represents that he is above the age of twenty-one years of age and is not under the influence of any alcoholic beverage of any nature.2. Attendee warrants and represents that if he has consumed or plans to consume any alcoholic beverage of any nature before, during or after said Party, he will not drive a motor vehicle while legally under the influence of alcohol but has designated the undersigned to be his designated driver.3.Attendee agrees to show his driver’s license whenever asked by the Sponsor or any employee or representative of Sponsor.4. Attendee agrees the he will immediately leave the premises of the Party upon violation of any of the terms of this Agreement, and that failure to immediately leave may result in arrest and prosecution for trespass and/or such other crime as appropriate.5. Attendee shall indemnify and hold Sponsor harmless from any and all claims and liability for damages, losses or expenses of any sort arising from the breach of this Agreement by Attendee.In this contract, any reference to Sponsor or Attendee includes that person’s employees, heirs, executors, and/or administrators; and the singular includes plural and masculine includes feminine.WITNESS our signatures as of the day and date first above stated._______________________________________ _______________________________________ (Name & Signature of Attendee) (Name & Signature of Designated Driver
