Lessee may not sublease or assign any rights acquired by this lease, nor may Lessee allow any party to hunt or fish on the leased premises. Third: It is agreed that in the event of failure on the part of the Lessee to pay the rent when due, such failure shall give Lessor the right, privilege and option to cancel the lease for nonpayment of rent, or at the option of the Lessor shall make the rental for the entire term of the lease due and payable, together with reasonable attorney's fees. Fourth: Lessor may, at all times, enter upon the premises for the purpose of viewing and inspecting the premises. Fifth: Improvements of a temporary or removable nature may be made by the Lessee, at Lessee's own expense and upon Lessee's own responsibility, and the Lessee may at any time that this lease remains in effect, remove any such improvements (except casings for water wells) which Lessee may have made, provided that the Lessee must leave the portion of the property from which such improvements are removed in a condition equal or better to the condition of the property before construction of the improvements. Sixth: Lessee agrees not to make or suffer any unlawful or improper or offensive use of the premises, and during the term of the lease, to keep the premises in good order, free from refuse, noxious weeds and objectionable matter, and to remove all garbage refuse of any kind from the premises. Seventh: It is agreed that this is a surface lease for agricultural purposes and shall in no way affect the right of the Lessor to lease said property for exploration, development or production of minerals, provided that Lessee shall be compensated for any loss caused by such activities. Lessor and its assigns shall enjoy full ingress to and egress from the property for those purposes. Eighth: It is agreed that the filing of any petition in bankruptcy by or against the Lessee shall be deemed to constitute a breach of this lease and shall give the Lessor the immediate right, privilege and option to exercise the same remedies provided for in the Third paragraph above for non- payment of rent. Ninth: Lessee agrees to protect and indemnify Lessor from the claims of all parties for property damages, personal injuries, death, or other loss of any kind, without exception, which may arise directly or indirectly from the condition of the leased premises and/or from the operations or activities to be carried out by Lessee, its agents or employees on the leased premises. Lessee agrees to obtain and maintain liability insurance coverage with limits of [_$Limits_] and to have Lessor named as an additional insured on such coverage. Tenth: Lessor reserves the right to enter the premises, or to have Lessor's agents or employees enter the premises, prior to the termination of the lease for plowing, seeding, fertilizing and such customary seasonal work as needs to be done for the existing and following years, provided that such access shall not interfere with regular farm operations by the Lessee. Eleventh: Lessee will operate the leased premises in an efficient and husbandlike manner that will conserve the Lessor's property, and Lessee will allow no livestock other than Lessee's own on the leased premises, and will not allow his own livestock to uproot or trample crops or cause any injury to the leased premises. Twelfth: Lessee will use diligence to prevent noxious weeds from growing or going to seed on the leased premises, and will destroy the same, and will keep weeds and grasses out of fields, farmstead, roadside and fence rows. Thirteenth: Lessee will keep in good repair all terraces, open ditches, headlands, roads and inlets and outlets of drains, and will preserve all established water courses or ditches and refrain from any operations or practices that injure access or drainage. Fourteenth: Lessee shall plant and maintain sufficient crop on the leased premises to meet all required quotas. Fifteenth: Willful neglect, failure or refusal of either party to carry out any material provision of this lease shall give the other party, in addition to all other remedies provided herein, the power to terminate the lease and the right to compensation for damages suffered as a result of such breach, such termination to become effective thirty days after written notice of termination specifying the delinquency has been mailed to the delinquent party (at the address given above), unless during such thirty day period the delinquent party has cured the delinquency. In addition, the Lessor shall have full benefit of summary proceedings provided by law for eviction of a tenant upon termination under this paragraph, or at the end of the term. In case an Attorney be employed to protect any right of Lessor or Lessee arising under this lease, the party whose actions or inactions necessitate such employment shall pay additionally a reasonable attorney's fee. Sixteenth: Lessee agrees to surrender possession and occupancy of the leased premises peaceably at termination of this lease, and to permit the Lessor to re-enter to prepare for the following year. Lessee agrees that at the termination of the lease the Lessee shall leave on and in the leased premises no less planted crop than was present on and in the leased premises at the beginning of this lease. Seventeenth: Lessee agrees not to permit the presence, use, disposal, storage or release of any hazardous substances upon the property described above during the term of this lease.
