The notice required under RCW 13.38.070 and 25 U.S.C. § 1912(a)  has  has not been given.  2.2  The petition should be dismissed because: Order on CHINS Petition (ORCIN) - Page 1 of 3 WPF JU 05.0300 (07/2018) - RCW 13.32A.170, .190 . 2.3  The petition should be approved because a preponderance of the evidence has established that: a.  The child is a child in need of services as defined in RCW 13.32A.030(5). b.  The petitioner, if the child, has made a reasonable effort to resolve the conflict. c.  Reasonable efforts have been made to prevent or eliminate the need for removal of the child from the child’s home and to make it possible for the child to return home. d.  It is contrary to the welfare of the child to remain in or return to the child’s home. e.  It is in the child’s best interest to be placed in foster care. f.  A suitable out-of-home placement resource is available. III. Order The court orders that: 3.1  The petition is dismissed and the child shall return or remain at home. 3.2  The petition is approved.
