Photo or Artwork Release Release made on the _____________________ (date), by _____________________ (Name of Owner of Rights to Photo or Artwork), of _________________________________________ (street address, city, state, zip code), referred to herein as Owner, in favor of _____________________ (Name of Purchaser of Rights), a corporation organized and existing under the laws of the state of _____________________ (name of state), with its principal office located at _________________________________________ (street address, city, state, zip code), referred to herein as the Company. For and in consideration of the payment by Company to Owner of the sum of $_____________________, the covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Owner agrees as follows: 1. Owner hereby consents to and authorizes the use and reproduction of the enclosed photographs or works of art created and/or submitted by me (the Artwork) to Company. Company shall have the right to use the Artwork in all markets and media throughout the world, in perpetuity. 2. Company may videotape, photograph and electronically scan the Artwork during and in connection with the upload of the material to the Company’s on-line/interactive services. Owner hereby waives the right to inspect or approve any finished photographs or printed or electronic matter that may be used, now or in the future, whether that use is known to Owner or unknown, and Owner hereby waives any right to royalties or other compensation arising from or related to the use of the Artwork. 3. Owner represents and warrants that he/she is the sole owner of all rights in and to the Artwork and has full power and authority to grant all rights related to the Artwork, and has, if necessary, secured all rights, consents and permissions including but not limited to those of others appearing in the Artwork. Owner further represents that the Artwork does not violate any rights of any individual or entity and is not the subject of any litigation. 4. Owner hereby agrees to release, defend and hold harmless the Company, its agents, employees and successors, including any firm publishing and/or distributing the Artwork in whole or in part, whether on paper or via electronic media, from and against any claims, damages or liability arising from or related to the use of the Artwork, including but not limited to any misuse, distortion, blurring or alteration, either intentionally or otherwise, that may occur or be produced in the taking, processing,
Of any image or art in violation of these terms and conditions. 5. Owner may edit and/or modify the artwork for personal use, provided the edits and modifications do not affect its integrity, identity or character (unless such alteration would lead to a distortion or alteration that could be perceived by an average consumer as being misleading). 6. Owners may be prohibited from posting or using the artwork in any fashion, in whole or in part, by company, or by law or other reasonable requirements that may be imposed by a third party. 7. Owner agrees for the sake of clarity, accuracy, legality, decency and for the protection of company's business practices, to remove and/or refuse to post the artwork in its entirety if the company has any reason or belief that such use would (without company's consent) violate an applicable law or right of legal action, or breach any covenants hereunder and to retain the right to remove, refuse to post, or screen the image(s), in whole or in part, as company has reasonably deemed appropriate, in its sole discretion. 8. No copyright or other proprietary rights are transferred by parties or assignable to the company. The art of photoshopping and the web for the past decade, this is the world we live in: the age of internet has transformed how a majority of us interact with others and how images are taken—and edited. Photographers, models, and media companies have always dealt with photoshopped images, but what's new is now the ability to manipulate them from anywhere on the web, even on your own home page. You might be surprised to know how easy it is to take an out-of-context image and manipulate it into something that makes you look pretty or makes others look bad. Why do people do this, or at least what's different about this case in particular? I'll let photographer michael bruns speak for himself, “this is an issue. I always make an effort to show what my subject actually looks like. With that being said, I know some people like to take the most interesting or flattering photo possible and just edit it, so it's all their picture. It's a constant struggle to maintain a good image when all these things are happening, so that's how I handle it. However, even if i never edit an image that was taken with the intent of creating a negative image, some people will always attempt to be clever or use Photoshop to
