Hey everybody, Robert Wright here, private label law attorney, and today I'm gonna give you four legal tips for hiring designers on Fiverr. Now, as a private label seller, Fiverr is one of the greatest resources you can possibly have. You can get almost anything on Fiverr. You can get brand names created, you can get logos designed, you can get white background photos, lifestyle shots, the optimized listings. I mean you can get everything on Fiverr, it's really great, but we also have to be careful when we hire on Fiverr. So here's four rules of the road in terms of making sure that you do in smart business, good solid legal foundational business on Fiverr. First, look at reviews. Just like when you go to Alibaba, you want to look for a gold supplier. You want to look for someone that's been in business for a long time, that moving a lot of volume, look at the reviews of the person that's giving the gig. Look for someone that has a track record of good solid reviews. Sounds common sensical, but oftentimes we'll get tempted to run to the lowest cost. Don't do that. Look at reviews. Reviews matter. Secondly, understand the terms of the gig. In other videos I've talked about copyright law. We know that copyright vest with the author, and that's not necessarily the person paying the bill. Fiverr's terms are really good. If you look at Fiverr's terms of service, they basically say, unless the person offering the gig says you don't own the copyright, you do. So the default is you own it. Unless the person providing the Gig says they're going to continue to own the copyright. In that listing, as you're looking through that gig make sure you understand the ins and outs. How many revisions you'll be given? Do you own the copyright or is that something that you have to purchase additionally? Are you allowed to use whatever you're buying for commercial use? Those bullets in that gig are really important. Make sure you pay attention to that. Also, make sure that the person providing the gig isn't using any stock assets. You pay someone a couple of dollar, $5, $10, whatever it is. They run off to Istock. Istock photo, pulled down a stock photo, manipulate it a little bit and give it to you and say, hey, you own it. No, my guess is, when you buy stock photos, you've got to make sure that you have the appropriate license. You gotta make sure that you have the ability to use whatever's being purchased for commercial use. You have to make sure that you have the ability to make derivative works and my guess is that person that's providing the gig on Fiverr isn't going to know the ins and outs of that, so make sure that the work that's being provided, is original work. That there are no stock photos, there's no licensed materials being used. How do you do that? Before you buy the gig sit with the person that's going to offer the gig, send them a message, get that confirmation in writing. So right up front and do that. And then even though the terms of service and Fiverr are really good in terms of intellectual property ownership, remember unless the gig says, you don't own the copyright, you do. I always like to get just a simple copyright assignment agreement in place. It's just, it's belt and suspenders. It's dotting the i's, it's crossing the t's, just having that signed written agreement or in worst case scenario an email affirmation you really want a signed writing, and with e-signatures, you should be able to do that without any sort of difficulty. But getting that signed agreement in place, you put it in a file, it just eliminates any issue down the road. When you go to register those copyrights, it's gonna make it much simpler. If you have a work for hire agreement in place, that shows definitively that you own the right. So those are four things you can do to protect yourself when you're hiring a graphic designer on Fiverr. Again, Fiverr is an amazing resource. I use it for my private label business. I highly recommend that you do too, but we got to be smart when we use resources like that. The devil's in the detail, and so making sure that you've looked at reviews, making sure that you understand the terms of the gig, make sure that you're acting proactive, questions about not using stock material, and then documenting everything in a quick, simple work for hire agreement. It's just going to keep your private label business safe. And a safe private label business helps increase sales.
