Services Contract with Hair Stylist for Popular Music Band Agreement made on the _____ day of __________________ 20____, between _____________________________________ (Name of Hair Stylist) of ___________________ ______________________________________________________________________________ (street address, city, county, state, zip code) , referred to herein as Stylist , and _______________ ______________________________________________________________________________ ______________________________________________________________________________ __________________________________________________ (name of each member of band) , who compose a band that plays primarily _______________________________ (type of music) and is presently touring __________________________________________________________ ________________________________ (parts of country) , said members of band being known as ___________________________________________________ (name of band) and being hereafter jointly referred to as Artists ; Whereas, Stylist specializes in cutting and styling hair, applying chemical perms and color treatments; and applying hair extensions and weaves when necessary; and Whereas, Artists desires to hire Stylist to style their hair during the tour described in Paragraph I below; Now, therefore, in consideration of the matters described above, and of the mutual benefits and obligations set forth in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: I. Services to be Performed Stylist shall style the hair of Artists during the tour (hereafter the Tour ) which begins on _______________________________________ (date) and lasts until _____________________ _____________ (date) and will involve concerts in the following states ____________________ ___________________________________________________________________ (list states) . II. Compensation Artists shall pay to Stylist the nonrefundable sum of $_______________on execution of this Agreement and the balance of $________________when the Tour is over. All reasonable out-of-pocket expenses incurred by Stylist will be reimbursed to Stylist by Artists on _______________________ (day of week) of each week after Stylist presents to Artists the appropriate receipts and/or documentation for such expenses. III. Completion Date The services of Stylist for the Tour are to be completed on or before _________________ ________________________ (date) . IV. Stylist is Independent Contractor The parties intend that an independent contractor-employer relationship will be created by this Agreement . Artists are interested only in the results to be achieved and the conduct and control of the work will lie solely with Stylist . Stylist is not to be considered an agent or employee of Artists for any purpose and Stylist is not entitled to any of the benefits that Artists provide for their employees. It is understood that Stylist is free to contract for similar services to be performed for others while under contract with Stylist . V. Assignment of Contract Neither of the parties may assign this Agreement or any rights under the Agreement without the prior written consent of the other party. VI. Governing Law The parties agree that this agreement shall be governed by and construed pursuant to the laws of ____________________________________ (state) . VII. Entire Agreement This Agreement is the complete and exclusive statement of the mutual understanding of the parties. This Agreement supersedes and cancels all previous written and oral agreements and communications between the parties relating to the subject matter of this Agreement. VIII. Amendment The parties agree that they may amend this Agreement only by a written agreement duly executed by persons authorized to execute agreements on behalf of the parties. IX. Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
