Employment Contract between College and Assistant Coach of College Sports Team Employment Agreement made on the __________________________________ (date) , between the Board of Trustees of _________________________________________________ (Name of College) , a nonprofit corporation organized and existing under the laws of _________________________ (state) , with its principal office located at __________________ ____________________________________________________________________________ (street address, city, county, state, zip code) , hereinafter called College , and __________________________________ (Name of Assistant Coach) of ________________ ____________________________________________________________________________ (street address, city, county, state, zip code) , and hereinafter called the Coach . 1. Term Subject to the terms and conditions of this Agreement, College does hereby employ Coach as an Assistant Coach for the _______________________________ (name of sport) intercollegiate program (Program) for the period beginning _______________________ (date) , and ending ___________________________ (date) . Coach’s employment will terminate on __________________________ (date) without prior notice. Employment after such date will be at the discretion of the Athletic Director of College and will be pursuant to a new agreement executed by the parties. 2. Duties Coach will be responsible to the head __________________________ (name of sport) coach for the performance of such duties related to the recruitment, supervision, and training of student athletes for the Program as may be assigned by the head coach. Coach shall also perform such other duties and responsibilities as may be assigned from time-to-time by the College’s Director of Intercollegiate Athletics (the Director ). 3. Compensation Effective _____________________________ (date), the Salary for duties performed by Coach under this Agreement shall be $_______________, payable in (e.g., 12 equal monthly installments) ________________________________ . The Salary may be adjusted during the term of this Agreement as required by the legislature or as deemed appropriate by the College. 4. Deductions from Compensation Payments to Coach by College pursuant to the terms of this Agreement shall be subject to all deductions required by state and federal law or regulation. College will make such other deductions permitted by law and authorized by Coach in writing. 5. Other Employment During the period of employment as assistant coach, Coach shall not engage in any other employment, act in a consulting capacity to any person, partnership, association, or corporation, or receive any athletically related income or benefit from sources outside the institution, except as may be permitted by the Constitution and Bylaws of the National Collegiate Athletic Association, the Rules and Regulations of the (e.g., State College Board) __________ _____________________________ , the Board of Trustees of College, and with the prior written approval of the President of College. Approval shall be required annually. Each request for approval must be in writing and shall specify the source and amount of the income or benefit to be received. Coach shall make a written annual report through the Director to the President of College specifying the amount of all income and benefits from approved sources outside the institution 6. Termination A. Either Coach or College may terminate this Agreement prior to ______________ _______________ (date) without cause by giving the other party thirty (30) days written notice. B. In the event Coach accepts employment in any capacity with an employer other than College (except as permitted herein) or if Coach dies, or becomes permanently disabled to the extent that, in the judgment of the Head Coach and the Director , Coach cannot satisfactorily perform the duties of ___________________________ (name of sport coach) , this Agreement shall terminate as of the date of such employment, death, or disability. C. College shall be obligated to compensate Coach or Coach’s estate in accordance with this Agreement for services performed prior to the date of termination and, in the event of disability or death , Coach or Coach’s estate shall be entitled to those benefits, if any, that are payable under any College sponsored group employee insurance or benefit plan in which Coach is enrolled. 7. Standard of Conduct T he employment and performance of C oach is subject to the Constitution and Bylaws of the National Collegiate Athletic Association, the Rules and Regulations of the (e.g., State College Board) ________________________________ , the Board of Trustees of College, the institutional rules of College, and the Constitution and Rules of any intercollegiate athletic conference of which College is a member. Violations of such constitutions, bylaws, policies, rules, or regulations by Coach shall be sufficient cause for such disciplinary action as may be appropriate under the applicable constitution, bylaws, policies, rules, or regulations. 8. Notices Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party as set forth at the beginning of this Agreement. 9. Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 10. Entire Agreement This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. 11. Modification of Agreement Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. 12. Opportunity to Consult with Attorney. Coach acknowledges that he has had the opportunity to consult and review this Agreement with an attorney. Accordingly, in all cases, the language of this Agreement shall be construed simply, according to its fair meaning, and not strictly for or against any party.
