This Protective Order shall govern all (documents and information relating to _____________ produced, given or filed during this action) (all documents produced by _____________ during this action), hereinafter referred to as "Protected Information." All Protected Information shall be used solely for the purpose of preparing for or conducting this action and shall be held in confidence as hereinafter provided in this Protective Order. 2 . The Protected Information may only be disclosed to qualified persons, who are defined to consist exclusively of: (a) The parties, counsel for the parties to this action and such regular employees of such counsel as are required to assist in the conduct in this action; (b) Independent bona fide experts or consultants working with counsel for either party; (c) Such other persons on whom counsel for the parties agree. - 1 - 3 . If Protected Information is to be included in any papers filed in Court, such papers shall be filed in a sealed envelope labeled "Confidential -- Subject to Protective Order". The Clerk of this Court shall maintain such sealed envelopes intact and unopened except as otherwise directed by the Court. Such information nevertheless may be referred to in oral and written presentations to the Court. 4 . Each person other than counsel and its regular employees given access to Protected Information pursuant to the terms hereof shall be advised that the Protected Information being disclosed is subject to the terms of this Protective Order, and may not be disclosed other than pursuant to the terms hereof. 5 . Nothing in this Protective Order shall be deemed or construed to restrict in any way any party with respect to its own documents or other information or to prevent any party from interposing an objection to a request for any discovery on any ground. 6 . Immediately after entry of a final judgment or order of dismissal and the conclusion of the last appeal therefrom in this action, all Protected Information shall be destroyed unless _____________ 's attorney elects to retain the documents as part of (his) (her) file, in which case, the documents shall be maintained in a separate envelope marked "Confidential -- Subject to Protective Order." 7 . The obligations of this Protective Order shall continue after the conclusion of this action unless modified by further Order of this Court.
