FOR MINNESOTA STATE COURT TO THE NOTARY PUBLIC OR COURT REPORTER TAKING THE DEPOSITION INSTRUCTIONS FOR TAKING WRITTEN DEPOSITION A. BEGINNING THE DEPOSITION The Deposition should be commenced as follows: "On the Day day of Month , Year , the witness _______________ personally appeared, and having been first duly sworn, gave answers to direct written questions as follows: B. NUMBERING THE ANSWERS Then number the answers to correspond with the identical number of the question asked. The entire answer should be transcribed exactly as the witness states without deletion or abbreviation. C. EXHIBITS When exhibits are requested to be marked, they should be marked Plaintiff's Number 1 (or if the question is being asked by Defendant, Defendant's Number 1) and thereafter numbered in consecutive order. On the back of the original of such exhibit which is mailed with the written answers should be stated the following: "This exhibit is the true, correct, and original as handed to me by the witness (then initial it)." D. GET ANSWERS TO EACH QUESTION Do not allow the answer to one question to be answered by a reference to a preceding answer such as "see answer to question 2". If the answer is to be identical, please type out the answer. It is helpful to keep in mind that this is testimony, the same as if the witness were sitting in the witness chair in the courtroom. Thus, it is best if the witness answers in his normal manner. - 1 - E. IF ANOTHER SET OF QUESTIONS ARE SENT TO YOU If another attorney submits cross-questions, these questions are answered in the same manner as the direct question except that, the preface to the answers should state: "In answer to cross-questions propounded by the Plaintiff (Defendant) the witness answered". F. ASSEMBLING THE DEPOSITION Both the answers to direct questions and to the cross-questions, if any, plus the exhibits should be bound, stapled, or otherwise fastened together as one bundle for mailing in the envelope provided. At the end of the answers, provide a place for the witness to sign the answers, which should be notarized: ___________________________ WITNESS Dated: Subscribed and sworn to before me this _____ day of ____________, 20___. _______________________________ NOTARY PUBLIC And: Send one extra copy of everything to {Name of Attorney} - 2 -
