let's go over a few housekeeping items before we start with the presentation before we start we recommend using google chrome or mozilla firefox for your internet browser when participating in our to part three of did you know a pan presentation on notary facts laws and misconceptions did you know your stamp and your journal are your exclusive property even if someone else paid for them even if you only notarize for business the stamp and journal are yours if you leave that business the stamp and journal should go with you they must be kept in a secure location and no one other than the notary public should use the stamp or the journal secure means accessible only to the notary or in the notary sole possession an example would be in a locked cabinet that only you have the key did you know if you are not an attorney you need to disclaim that in any advertising the following disclaimer should appear in any advertisement i am not an attorney licensed to practice law in this commonwealth i am not allowed to draft legal records give advice on legal matters including immigration or charge a fee for those activities if there is not space in the advertisement the statement needs to be displayed at your place of business or provided to the customer before the notarial act is performed did you know there are certain documents that may be presented to the notary that should not be notarized form i-9 is one of those documents the i-9 is used to verify the identity and employment authorization of individuals hired in the united states either the employer or an authorized representative of the employer must complete form i-9 the u.s citizenship and immigration services provides guidance on working with form i-9 a notary may be hired to complete form i-9 when this happens the notary is acting as an authorized representative of the employer not a notary public the notary should not place their official stamp on form i-9 even if they are being asked to did you know there is a difference between a verification on oath or affirmation number two in pan's journal and an oath or affirmation number five in pan's journal the verification on oath or affirmation is a verbal exchange and a document being signed in the presence of the notary the verbal exchange is an oath or affirmation that the information in the document is true the oath or affirmation is usually only a verbal exchange it is used to swear someone into an office or prior to testimony in court or for a deposition this completes the presentation portion and we are now open for questions the i9 i received a phone call and i missed it amber the point is there are documents out there that do not require notarization now it's not normally the notary's decision to decide whether something actually needs to be notarized or not we specifically know the the federal i-9 form does not require notarization and the federal government actually states that even if a notary is acting as a representative of a company when completing the form that they are not to place their stamp on it it's very direct um instruction from the federal government mary lynn asks if an employee leaves and does not take their stamp or journal what is the employer's obligation well the stamper journal is the notaries obligation to keep with them in their sole possession the employer should return the stamp to the notary at the earliest convenience because it is the notaries obligation though to keep it in their sole possession and i'm going to take a look at uh deborah's question and no marcia's question and deborah's question because marshall is just a resource question she wants to know where can she view past webinars we do post some of our past webinars not the oldest ones on our youtube page once again i'm posting that youtube link or did i did i do it i did that takes you right to the playlists uh there is a playlist just for webinars so you can check that out there and deborah says if i notarize for just the company i work for do i need to post the information about not being a notary for legal counsel again deborah that is specific to advertising if you advertise then that particular disclaimer needs to be included if you advertise and you don't have room for that particular um disclaimer then you would want to post it at your place of business so in general the answer to your to your question is no although i do know i mean this is kind of a neat idea people use in their outlook signature sometimes they'll actually put that disclaimer as a part of their outlook signature and i don't think that's a bad idea either not a requirement but not a bad idea okay kelly asked can i notarize a title being signed away by the seller even when the purchaser is not present uh you when you're completing section a you are obligated to have the purchaser's name and address on the uh completed but the purchaser does not have to be present you are notarizing that the odometer uh is correct and it is just of the seller's signature that is correct but again as always unless you are a penndot agent or you know a lot about uh notarizing a penndot title we don't recommend that you do it because there are too many ways to make mistakes if a mistake is made a replacement title would be needed and it would cost somebody at present 55. just to piggyback on what kathy said tracy wants to know i would like to have uh links for the following proper use of embossing stamp email address for three instructors catherine john and brian okay we can provide our email addresses although that instructors at notary.org is a shared email address tracy if you send an email to that address all three of us will get it there is i believe there is a youtube video on proper use of an embossing seal and i have just a couple of clicks down from your question i published uh the youtube link that would be under notary you're waiting for the questions to come in guess i didn't turn my phone off did i that's the first time i've ever forgotten nice ringtone yeah wake you up doesn't it now i'm embarrassed remember it takes 10 to 15 seconds for the questions to come in before we actually see them the technology is a bit slow in the chat all right so that shouldn't happen again at least the dog's not snoring or barking i do like it when your dog snores i'm used to it now we promised we'd have you out of here laugh of the day yeah like when i used to be in radio and you know the door that heavy door is closed with a heavy glass thick glass and there's that big on air red sign above the door and people just burst through the door and start talking to you when the mic was open it was it's like come on wake up folks jennifer has a question for you how hard is it to pass a notary exam well if you prepare it is not difficult and on the pan if you are a pan member you can go and get some tutorials on our home page in the member portal and if you've taken the education and read through all of the materials for that then it isn't um difficult there are some questions you may be stumped on but if you prepare for it and follow the tutorials um it you should be fine you know the feedback we're getting from from most people is that what they were all wound up about nothing and it wasn't that big of a deal now i can't say that'll be your experience but that is the the the feedback we're getting from many many people susan asks in a notary journal do you do you enter the name of the person signing or the name of the company that they are signing for susan when it comes to the name and address of the customer is actually the individual that is signing if you would like over in any additional areas like in our journal the remarks section you could indicate who that person is signing for i am not perfect tracy not one bit um he asked to post the proper wording being of not being an attorney i got right there at the very end of what you were saying i'm gonna repeat it and then if you would email us we can send you the actual statement i am not an attorney licensed to practice law in this commonwealth i am not allowed to draft legal records give advice on legal matters including immigration or charge a fee for those activities and if you email us at instructors.org i'd be happy to put that in writing and email that to you charlie and martha ask is there a fee involved with becoming an e notary not remote the there is no fee to apply to the state but the fees uh are involved when you um contract with one of the vendors of e-notary of the e-notary platform so and those costs can be fairly expensive there's coming in some comments on the exam that it wasn't too tough but you do have to think about it you can't just fly through the questions and then the pan tutorial practice exam on the website in the member portal is a great resource jennifer are there any big policy changes to being a pa notary due to covid19 the largest policy change jennifer is this my question or yours am i the largest policy is that during the pandemic and for 60 days after remote online notary is allowed in pennsylvania um and that would be i would say the biggest policy change that they are allowing remote online notary to happen and there is one other thing that we bring up periodically people do ask about it and that is normally under the notary law you are not permitted to accept id that has expired but and i'll read directly from our frequently asked questions question number 12. penndot is extending the expiration dates of pennsylvania driver's licenses and pennsylvania photo id cards that expire from march 16 2020 near the beginning of the pandemic through august 31st 2020 to august 31st 2020 so if your id or driver's license expired anywhere in that time frame it's extended until august 31st now here's the kicker the department of state received a waiver from the governor so notaries may accept that expired identification if the notarization is not after august 31st 2020. there's more to it than that there's some information about what to write in the journal and what happens if the if penndot offers a a more recent update say they extend it to the end of september which they haven't but you can download and look at our frequently asked questions that is question number 12. that question also appears in our blog tam asks if we know of a good forum to get reviews on the approved products for the e-notary um i don't know of a forum for that um tammy i haven't heard of one or read anything about reviews on the different vendors i would say just contact the vendors and get brochures from each of those and compare them best you can and you may actually need to call to get pricing so you can do your own comparison and we're caught up on questions for the moment it's almost 20 after i promise to have you out of here by 11 30 or 11 45 looks like we're on track to do that if you do have be done now that we're all in the green zone it's it's the door notarizations where there's som thing like a barrier that you can't see you can't hear them you can't watch them sign you would have a a they were trying to come up with and they didn't want us to sign off so they said wait and they put that up it's like okay we'll wait that was a while back i i got a kick out of that uh denise our intent is to continue these but as we are taking vacation going back on the road it may not be thursday and friday every week for example next week because of vacations we're only doing friday and we are going to repeat what we did this week so they're going to be some there's going to be some give and take but our intent is to really try very hard to keep these up as best we can you're not going to necessarily see all three of us you know hopefully you won't see us solo either i mean that can be done but not as exciting thank you all and you two say s stay safe another 30 seconds and i'll right before the exam like a day or two i would review go through them and what i did when i took my exam was even hours before i sat down and did the practice exam that was on the pan website that got me used to sitting in front of a computer and answering questions on a computer screen and not just um doing it in person so it helps to do it on the computer screen as well the only thing i i tell people is this don't over study or freak yourself out i think people overthink everything and they start to over study and then by the time they get there they're so nervous they can't concentrate so study it maybe do it the night before or right before as kathy said go in fresh get a good night's sleep and you probably should be okay karen they give you uh one hour to take the exam or 30 questions they're all multiple choice uh again for some people somebody said earlier it took them a half an hour some people are saying it took them 10 minutes it just depends on you but you have an hour okay um we lost the question here can you talk about notarizing motor vehicle documents um we do have a youtube video on transferring a title so um you want to go there um we unless you are a penndot agent we don't recommend it because there is a potential for defensing the title and that can be quite expensive um brian's posted the uh playlist for that and then if you go to the questions you can marry lynn um really recommend that if you are a member and you have regular questions that you either call or chat live online with one of our customers service reps it's the
