good afternoon and welcome to another episode of this is your life money motivation i want to jump right into this topic that we shared with me from a friend of mine that lives in the state of arkansas as you know last week the house of representatives went on recess without coming up with a stimulus uh plan compromise with the republican party which i think is an outcry and the problem with that ladies and gentlemen is that many millions of americans were dependent upon that extra six hundred dollars of unemployment from the federal government and now they're not getting it and as you know these rent freezes are over in a lot of states so if you're looking for that six hundred dollars to help you pay for your rent and you now don't have that six hundred dollars to pay your rent you have a problem and this is a severe issue that's going on in the state of arkansas right now because the state of arkansas has the worst i mean the worst tenant rights in america when it comes to renting an apartment or a house let me give you some basics this would never happen i'm here in new york new york state new york city and this would never happen arkansas is the only state in the country where landlords do not have to provide a livable dwelling landlords are also not required to make repairs unless it is stated in the lease agreement and lastly renters cannot withhold rent for any reason so those are three major items so let's go with item number one landlords do not have to provide a livable dwelling so what is a livable dwelling that means a livable dwelling means an apartment you walk into apartment you're looking to rent you know it's freshly painted you know it looks nice etc however in arkansas the apartment can be as is where is meaning there could be plumbing issues that the landlord doesn't disclose there could be rats there could be roaches there could be electrical issues there could be problems with the roof where if it rains the water leaks into the apartment could be numerous scenarios maybe have a heat problem you don't know but the landlord does not have to provide you a livable dwelling it's as is where is basically landlords are not required to make repairs unless it's stated in the lease agreement so if you walk into an apartment it looks beautiful you move in and let's suppose today suddenly it rained hard water starts coming into from the roof because if there's roof damage it's leaking in your living room goes all over your furniture you put buckets down you call the landlord up hey the roof is leaking come fix it he can say screw you and you still have to pay the rent you cannot stop paying the rent regardless for any reason or you can get evicted that is crazy those three elements right there are crazy in most states this is not permittable but in arkansas it is here goes another thing landlords have up to 60 days 60 days to return deposits so if you're living in this apartment that you thought was wonderful and there's a heavy rain and the water starts leaking in the living room profusely ruining your furniture and you call the landlord to fix it he says screw you okay and you say well i can't stay here and you leave you're not going to get your deposit back for up to 60 days if you get it back because he's not required by law to provide you with a livable dwelling just crazy and also tenants can be evicted for for failing to pay rent okay staying in the residence after the lease has ended or any other lease violations arkansas has both civil and criminal evictions if you are behind on your rent you may be served a failure to vacate notice and must leave the property within 10 days or be served with a criminal charge and this is the problem in the state of arkansas right now because you have many americans that were dependent upon that 600 stimulus unemployment from the federal government it now has ended and they are unable to pay their rent and they are not getting out in a timely manner and so they're going to jail you're not seeing this on the news but this is happening so imagine if you live in the state of arkansas let's suppose you're from another state you don't have any family or friends there's no shelters so you have to gather all your belongings pack them up and go somewhere else you don't have any money you don't have any money which is why you couldn't pay your rent anyway so now because you didn't get out in 10 days you can go to jail you got kids where do you go where do you go and this is just uh crazy and here goes the kicker the eviction process in arkansas is not like the eviction process in most states i'm here in new york city new york state and you know if you get behind on your rent it might be you know three four five six months before you're out the apartment because there's a process not in arkansas if you get behind on your rent okay the landlord gives you you know if your rent is due on the first you don't pay it the landlord gives you a three day notice to vacate if you don't leave then he files a petition with the court you the tenant has five days to respond and explain what's going on after the five days you don't respond or even if you do respond the court is going to have a court date and basically quickly not 30 days from now quickly shortly after that five days and so basically the land you know the judge is going to say either you paid it or you didn't and you got to get out and if you don't get out you're going to jail so and this happens quickly it doesn't happen over a period of time so right now the evictions and arkansas are skyrocketing only because everything happens quickly so the fact that the house of representatives democrats and republicans were unable to come up with a stimulus package compromise is just so heinous and so unacceptable and you have citizens in arkansas who are depending on this extra six hundred dollars to help them pay rent and now some of them are just going to jail because they don't leave because they have nowhere to go or again it's the educational system a lot of people uh there you have a segment of some citizens that aren't highly educated and aren't familiar with the landlord tenant law and so they stay there and they end up going to jail they don't know they don't know this law they don't know that you can have uh civil and criminal evictions they're not aware of the law because they can't afford an attorney and they're going to jail so we really need to come up with a plan on how we're going to handle evictions and foreclosures because if we can't come up with a stimulus compromise and just realize that you dug a hole and you just have to bail people out you bail the rich out you got to bail the the common man out because uh rental and uh house foreclosures are just going to be going up and up uh if we don't come up with some solutions been listening to an episode of this is your life we'll see you on the
