Do agreements signed online by EchoSign or signNow have the same legal position as signed by hand?
Online signature software such as EchoSign or signNow use electronic signatures, also known as digital signatures. Most countries now have legislation that provide for the use of electronic signatures. However, these countries may have slightly different requirements for what constitutes a legally binding electronic signature. The United Nations has attempted to provide some unifying features through the UNCITRAL Model Law on Electronic Signatures 2001 but this model law has only been adopted in 32 states including the UK, China, Mexico and India. In the UK, the Electronic Communications Act 2000 was enacted to comply with the UNCITRAL Model Law but it has now been replaced by Europe’s Electronic Identification and Authentication Services Regulation (910/2014/EC)(eIDAS) which came into force on July 1 2016.This new law applies to all EU member states, but since BREXIT, it is uncertain whether the UK will continue with eIDAS.The eIDAS states that only "qualified electronic signatures" will be mutually accepted by all the EU member states. A qualified electronic signature must be uniquely linked to the signer and based on a qualified electronic certificate that is issued by an approved authority. In the USA, the Electronic Signatures in Global and National Commerce Act (ESIGN, 2000) and the Uniform Electronic Transactions Act (UETA, 1999) give similar recognition to online signatures as paper signatures.Under these two acts, the term "electronic signature" means an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record.Briefly, the following requirements must be met for an electronic signature to be valid:The signer intended to sign, consented to the use of electronic records for the transaction and did not withdraw his or her consent. The electronic transaction system must keep a record of how the signature was created or make a textual or graphic statement that must be attached to the agreement. The signer must have received a copy of the UETA consumer consent disclosures. The electronic signature records must be capable of being retained and accurately reproduced later by all parties. In other words, all parties must be allowed to reprint the agreement and the signatures if they want to.In Canada, electronic signatures are governed by the Personal Information Protection and Electronic Documents Act (PIPEDA, 2000). A secure electronic signature must be:Unique to the person signing. The person signing has sole control over the signing process and his or her identify can be verified. The electronic signature is linked to an electronic document in a way that any attempt to change the document can be determined. In general, there's a lot of similarity in requirements governing electronic signatures, mainly because this is necessary to promote the growth of international e-commerce and trading. However, to avoid uncertainty, you should always state in your agreement which country’s law applies to the agreement. If there was going to be a dispute later on, you then know which country’s law will apply to the agreement and what the likely result will be.Also, even though you sign an agreement online using these software, ensure that you print a copy of the agreement and the signatures and keep these paper copies for your own records. For more info, you can check out our article on 4 tools to sign NDA agreements electronically.Credits: Icon "edit" by Chameleon Design from the Noun Project.

Do you think students should be required to use cursive writing in U.S. public schools?
There are some arguments for it, such as historical context and personalization of writing styles. That said, I don’t students should be required to learn or use it.Partially, this is because of my own experience as a student. We were forced to learn and use cursive in third grade when I was a child. I had no use for it and frankly did not care to learn it in the first place. My print writing was fine. I stopped using cursive in fifth grade the moment my teacher no longer required it and haven’t used it since.Today, my print handwriting is so legible that the judge I work for actually thought I’d used a font and couldn’t figure out why I’d handed him a document off of a color printer when I gave him a slightly modified order with changes in blue ink.I highly disagree with a few of Bruce Deitrick Price’s arguments.First, it is not that historic.Modern cursive writing has really been around only since about the invention of the printing press. Italian humanists who were upset at the Gothic font that Gutenberg favored for maximum print legibility revolted and adapted a monastic Carolingian script that was meant to be inconvenient and time-consuming to write as a form of protest at early industrialization and mass production of text.In the 1800’s, Platt Rogers Spencer attempted to kind of standardize the script, which was replaced with Austin Norman Palmer’s modern cursive around the turn of the 20th century, which fought with the Zaner-Bloser method for dominance in public schools. As typewriters dominated the 20th century, handwriting was already going down the tubes. As early as 1955, the Saturday Evening Post denounced the “nation of scrawlers” that would come of failing to teach cursive. Their six-decade old fears have never been founded. The consensus of scientific studies on the subject show that cursive handwriting offers no speed benefits, no legibility benefits, and no genuine advantages over print writing. [1]Requiring legibility and forcing students to work on their handwriting is important, but teaching cursive writing simply is not required to achieve that goal.Bruce argues that it requires students to learn language better. His arguments do not reflect the reality of teaching.I don’t agree that it forces students to look at the structure of words, how to spell better, or how language fits together. It might do that in other languages, but English is a terrible hodgepodge of so many languages that forcing students to learn a different character system is absolutely not an effective way to teach them language arts. I used to have a poster up in my room that said, “English doesn’t borrow from other languages. It knocks them out, drags them into a back alley, and rifles through their pockets for loose grammar.”You know what’s an effective way to teach students the structure of words, how to spell, and how language fits together? Teaching students the structure of words, how to spell, and how language fits together.Bruce’s argument that teaching only print makes all signatures look alike bears no merit. I write in all print, and my signature has slowly become P-scribble, K-scribble.Electronically signed documents are rapidly becoming an industry standard, for better or worse, and biometric signatures will become the preferred method for signing very soon. Harder to forge, easier to create and track.Bruce argues that cursive writing forces precision of writing. Jesus, no. I spent the better part of a decade in the high school classroom. I had students who could write with precision in print just fine, and I had students whose cursive was so incredibly imprecise as to be illegible. There simply is absolutely no correlation between simply forcing students to learn cursive and their writing actually becoming neater. As for reading old documents, why? Should we force them to learn abandoned Old English characters, such as the thorn, wynne, ashe, or eth? What? Never heard of those?Let me enlighten you. These were part of English not terribly long ago. In fact, not that much longer ago than the invention of cursive writing. The thorn. The wynne (or wynn, depending on what part of England you were in).The ashe or ash.The eth.Wanna read Beowulf in the original? You’ll need to know those.Should we make them learn cuneiform? Cyrillic? Simplified Chinese? The last two would be more practical than forcing them to learn an outdated method of writing for the sheer purpose of reading old stuff that has likely already all been digitally converted into legible print text.A person with a reasonable understanding of Latin characters can probably, with minor effort, at least parse out modern cursive writing post 1500 if they absolutely had to, and would likely have far greater difficulty with the syntax and spelling than the script itself. There can be a certain elegance in script. I have a friend who is a graphic designer and who loves fonts. She created her own. (I liked using it for handouts, actually.) She sometimes writes in modified printing, and sometimes in various flowing script. She did our wedding invitations and mixed the two in a way that was truly stunning, while remaining easily legible and readable. But she chooses to do this.If she’d been forced into learning a certain script in elementary school, I imagine she’d hate it to this day, as I do.No, cursive should be offered as a supplemental art, not required. Thanks for the A2A, Stacey.Footnotes[1] Cursive craze not worth the paper it’s scripted on –Kate Gladstone
