United States (1842), ruled that "the power to regulate [the movement of the mail] by virtue of the Postal Act of , is vested in [the Postmaster General]. He therefore has power, by virtue of his special commission, to issue the necessary stamps and orders as will authorize the issuance of such postage stamps for the issue of letters by mail" (1873, p. 5). In 1878, the Supreme Court reaffirmed that the Postmaster General had the right to issue "any stamps, certificates or orders for use in the enforcement of the provisions of the Act of 1836, as amended" (p. 805).
It is interesting to note that Congress did not require the Postal Service to issue a postage stamp for letters by mail, only that the Postal Service would be free to issue a stamp whenever it chose—without limitation—to, which it did.
The Postmaster General also issued a series of stamps to accompany the original Postal Act of 1793, including ones with the words "The Constitution" on them as well as those with the words "We Shall Overcome." In 1876, Congress enacted an act that required the Postal Service to issue postage stamps to accompany all federal taxes, fees, and assessments of whatever nature and in whatever denominations.
