Colorado Legal Last Will and Testament Form for Married person with Adult Children

hi everyone I'm attorney Aiden Kramer with the law office of Eden H Kramer in Colorado and you're watching all up in your business in this episode of all up in your business I'm going to go over what a simple will is I get a lot of inquiries from potential clients who tell me that they want just a simple will when in reality what they are thinking of in their mind is really not that simple so typically a simple will is a document that provides an outright distribution of property and assets generally to one person a simple will usually applies in situations where it's just a husband and wife and no children and nobody else really needs to get anything from either estate when one of them dies so when the wife dies everything she gets is going to the husband and if the husband dies first everything he has is going to go to the wife and that's really what a simple will is so typically a will is going to have a few very important terms in it there's going to be a portion where you say who the members of your family are this is really for clarity and so it's clear to whomever's reading the will that by my husband I mean this person's name by children I mean these people so you want to state who your family is their names so that when you go through reading the rest of the will it's very clear who you're talking about then there's going to be the portion where you say how you want your assets to be distributed so in a simple will as I mentioned if you're married and don't have any children your distribution is going to usually just be outright to you the surviving spouse if you have children or other family members or charities or other people that you want some assets to go to then that will be the place where you put them as well but that typically overrides the idea of a simple will finally there's going to be a portion in the will where you designate a personal representative the personal representative is going to be the person who sees the administration of your estate through and who helps family members works with quartz does whatever it needs to be done to get your estate administered and to get all of your assets distributed to wherever they're supposed to go so you want to appoint at least one person as your personal representative typically if you're married it would be your spouse you would also want to appoint a at least one or two backup personal representatives so if your spouse pre diseases you then maybe you have an adult child or a sibling or a close friend so you want to appoint at least two personal representatives one is the primary and then one or two successors and one of the most important parts of the will is at the very end after all the good stuff where you've talked about what you want how you want it done after all that the most important part at the end where you sign it you have witnesses sign it and you have it notarized all of that makes the rest of it valid and enforceable in Colorado I typically recommend two witnesses and for it to be notarized that makes it as close to ironclad and unbreakable as you can get the rules about what a valid will knees with witnesses and notarization vary from state to state in Colorado it's best to have two witnesses and to have it notarized so that's really the four most important parts to a simple well you can put a lot more things into a will a lot more terms make very grand distributions to multiple multiple people but that gets a lot more complicated and it's not a simple well anymore so I'm not going to talk about those things but so a simple will got those four portions so that's all for this episode if you have any questions or comments go ahead and comment below if you would like to speak with me personally about possibly getting a simple or not system the whale in place go ahead and contact me my phone number and email are below otherwise I hope you enjoyed hope you learned a little something I'm Aiden Kramer and I'll see you next time
