landlord or the tenant is not in compliance with so this notice is for both landlords and tenants to notify the other that there's an issue that they're not complying with so today what I need you to do before we get going is right below in the remarks there's a link where you can get the 14 30 day notice I want you to pause real quick this video print it out so we can go along with it later on in the video we're gonna go step-by-step through it so for reference purposes so take a few minutes download that print it off and then then start the video back up okay welcome back so the 14 30 day notice very important as I said before this is for anything any breach other than a nine payment of rent I'll give you an example so let's say that in the lease your tenant is responsible to mow the lawn once a week and the tenant has failed to do that and now the city code people are calling and sending you notices that the lawn needs to be to mowed to be mowed so on and so forth so you would fill out and serve to your tenant a 30 day at fourteen thirty day notice and it basically says the tenant has 14 days to mow the lawn otherwise the 30 day notice is in it so it so let's back up here it's 14 days to mow the lawn if they don't mow the lawn within 14 days then you as the landlord can terminate the lease agreement and then they'd be forced to move or you'd have to evict them on the tenant side the tenant has the same rights so I'll give you an example let's say that the the landlord it's a multi-unit the landlord is responsible for for for bug spray you know making sure there's no cockroaches and stuff like that the tenant has repeatedly said hey mr. landlord there's bugs you need a spray and the tenant and the landlord's fail at failing to do that the tenant would fill out the same the same 1430 day notice and the notice is hey mister missus landlord you have 14 days to spray this place otherwise in 30 days we're going to terminate the lease contract and move and move out so the key to this really is the structure of the and the format of the notice and the math when does the 14 days start when does the 30 day start when does this six-month provision start so I'm going to cover that but first of all just real quick if you would grab your actual 14 day notice here and read through here as I said in my previous video on the three day notice the wording matters so if you look at your notice it says fourteen thirty day notice of intention to terminate the lease agreement of the notice of default and intention to terminate the lease agreement notice that it's in bold print and it's in its its capital letters in the legal field that means something there's a point of emphasis to it okay as the three day notice the language is very similar it says this is a legal notice remember we're giving this to the tenant or the landlord we're serving them notice this is a legal notice time is of the essence failure to comply with this notice may result in legal action against you so this notice is putting them on notice that this is a legal notice and we could take legal action against you if you don't comply with it and then it goes on to say consult with an attorney if you do not understand very important we want to remove any legal possible legal defense that a tenant could throw up at the last minute if they show up a court that says hey if I would have known it was a legal document I would have hired an attorney well we've already advised them to hire an attorney if they don't understand it so basically this notice is you read through there it identifies what the issue is so in our scenario it would be as per paragraph 5 of the lease agreement you're responsible to mow the lawn once a week and you fail to do that at the very bottom this is important it says the delivery method and I'm not gonna get into the delivery itself because that's a previous video that I did but it does have how did you deliver this notice was it hand-delivered or was it put in the mail and this is in the notice it needs to be in there so if you hand-delivered it you put the date and who delivered it and if you drop it in the mail then you would put the date that you put it in the mail and who dropped it in the mail so very important that that's in there again go if you want know more specifics about the notice just go to a previous video that I have so all right let's talk about the actual math all right it's a 1414 30 day notice you have 14 days to comply with whatever the breach is or otherwise in 30 days I'm going to terminate the lease and and evict you so let's look at our scenario the example that I gave you you're supposed to the tenant supposed to mow the lawn days of the month we have the 1st through the 17th of the month and this is just an example let's say that on the 1st of the month the tenant comes in to pay the rent and you the landlord says hey hey I just got the notice excuse me from the city that says you haven't mowed the lawn what's going on here and they said well I haven't got around to it whatever the case may be or maybe they just say yeah I have your nuts it doesn't matter either way you've been put on notice that the the lawn hasn't been mowed mowed and hasn't been so on the second you write up the 14 day notice and you hand-deliver it or you drop it in the mail as required by the statute the second is called the service day you cannot count this as the very first day of the 14 so you drop it in the mail a hand delivered the second doesn't count the first day of the 14-day notice starts on the third day of the month okay so let's just count here because the math is very important 14 days the third of the month is the first day 1 2 3 4 5 6 7 8 9 10 11 12 13 14 the 14th day of the notice is the 16th day of the month very important because you cannot terminate the lease during the notice period if you do then your urine breach okay and then they could actually challenge the validity of this notice in your eviction so you give them the notice on the second that doesn't count you wait the 14-day notice period a couple of things are gonna happen during that notice period number one the tenant may comply the tenant might actually go out and mow the lawn that's what we wanted them to do boom we're good to go you cannot move forward with any Vixen and throw them out well let's say during the 14 after the 14 day period it's still not mowed they did not mow the lawn then on the seventeenth day of the month one day after the notice period expires then you the landlord terminate the lease agreement and then it converts into a 30 day notice so it goes from that notice legal notice period to now the 30 day notice something you have to remember about if it should this happen it's retroactive so if you terminate the lease on the seventeenth okay the day after the 14-day notice period expires and and becomes the 30 day notice the 30 days started way back here on the third of the month which was actually the first day of the notice period okay so it's retroactive so in this case then they have 30 days to move out at that point obviously if they don't move out then you're gonna have to evict them one last thing that the statute provides is a six-month probationary period so let's say that within this the 14-day notice period they do mow the lawn now they're on probation for the next six months so if the same thing happens again they don't mow the lawn within that six month period you don't have to give them another 214 day notice you simply give them a 30-day notice you've basically invoked the 30-day notice provision of this so say you got 30 days to vacate i've terminated the lease and you're gonna have to move it's a little complicated to a victim the thing that the one thing about a 14 30 day notice if you get to the you have to evict them you have to have proof that that the the they did not hear the the breach so one of the things you want to make sure that if you do this at the point that it looks like you're gonna have to terminate the lease before you do anything else make sure you talk to your attorney to set it up because
