hi this is Jim Cunningham and we are going to go over the advance health care directive form for California this is the statutory health care directive that is in the California Probate Code and I've circled here something very important is you have the right to give instructions about your own health care so this is a fundamental right for Californians and it's broken up into different parts and we'll go over each of these parts and part one is where you designate the individual to make healthcare decisions for you and to consent or refuse consent for treatment and approve diagnostic tests surgical procedures and so forth part two gives specific instructions about any aspect of your healthcare and part three talks about donating your body and part four allows you to designate a physician now this is a little confusing so I've taken the example of Will Smith so this is Will Smith's dirt Vance healthcare directive and so he's I'm going to skip down here so this is where you sign it if when you're making this this is page five of six that's where you sign it and win it the second page of the advanced health care directive so where it says page two of six up here this is where you designate the agent so you don't put your name on the document until the end and this is probably the single biggest boo-boo that people make is that they put their name here so what this says 1.1 is designation of agent now what that means the agent is the person that makes healthcare decisions for you now in this hypothetical example I don't know Will Smith he's a public figure I figured we might as well use him right I love his music he's about my age so he's designated Jada Pinkett Smith as his agent to make healthcare decisions for him in the document we write out their residents I pulled this off the internet I just googled it and these are fake numbers but you would go ahead and write in your numbers so when you're filling this out you don't put in Jada Pinkett Smith because I don't think she's gonna make healthcare decisions for you you're gonna want to put the person that you pick to make healthcare decisions for you if you don't have someone you need to pick someone it can be a spouse it can be a child it could be a grandchild a family friend an acquaintance maybe your spiritual adviser or whoever it is but it's a good idea to ask them ahead of time make sure that they're comfortable having that that responsibility so one point one is designating an agent and then if Jada is not available basically if she doesn't pick up the phone when when the hospital calls her the doctor calls or is out of town or whatever then we go to the next person in line and Harry Smith is Will Smith's brother and I put here you know one two three main street any town California and again some hypothetical phone numbers but it's very important to complete this information and put in the phone number as well as the address and the reason is if you don't answer the phone you know if if Will Smith is at the hospital and they pull up this this form that he's given his physician and we'll talk about that in a little bit and Jada pinkett-smith doesn't answer the phone they will send out a Sheriff's Department officer to knock on the door and say you know Will Smith is in the hospital and you need to come in and and make some decisions so it's very important to put your your residence address where you actually live where people can find you and then there's an optional third agent paragraph 1.2 my agent is authorized to make all healthcare decisions for me all healthcare decisions including decisions to provide with holder withdraw artificial nutrition and hydration that's would be some type of artificial means of giving you fluids or food except as you designate and you can write in here except as I designate in this case we're not putting anything here and you know whatever wishes you have write them in there when the authority becomes effective so this document says my authority my agents authority the person is making decisions for me becomes effective when my primary physician says I'm I'm unable to make my own healthcare decisions now this kind of makes logical sense it's really hard for me to determine a situation or think about a situation where the authority to make healthcare decisions would be immediate because in the real world your treating physician is gonna ask you you know this is what's going on what do you want to do what and so I'm not sure how this I'm not sure why this is there I'm sure there's a reason for that to be there but I don't think it's necessary in my personal opinion to check this box because this document is needed when you cannot make decisions for yourself agents obligation my agents shall make healthcare decisions for me in accordance with this power of attorney they have to do it they have to follow your instructions very very important post death Authority 1.5 my agent is authorized to donate my organs or not right if you don't want them to be able to donate your organs and say I do not write in here I do not want my organs donated or I only want particular organs donated or whatever but again I've chosen not to to put anything in this hypothetical example here nomination of conservator so what this is is a nomination of conservator is if you're unable to provide for your own food clothing or shelter or under unable to provide for your basic needs then the county typically steps in and appoints a conservator or a loved one will step forward and petition the court to be appointed your guardian so guardian conservator have different meanings in California but generally speaking a conservator is appointed when you can't do for yourself right so maybe somebody's had a stroke or Alzheimer's or dementia or Parkinson's oftentimes those are the type of people that have a conservator appointed over them to help them now we move to part 2 instructions for healthcare and I've checked on this hypothetical example choice not to prolong life I do not want my life to be prolonged if I'm a goner I mean that's basically what it says or you can choose to prolong life I want to be my long my life to be prolonged as long as possible ok so that's a choice that you're free to make but I would encourage you to pick one or the other and it relief from pain this is palliative care not curative care oftentimes this is where a hospice will step in and again we've chosen to leave this blank you're not required to fill this this line out other wishes if you have any other wishes put them in there if you have spiritual wishes you can you can put those in as well part 3 is donation of organs tissues and parts and I in this hypothetical example put whatever you know whatever is needed go ahead and and donate those and if you want to restrict your donation then you can restrict it here part 4 I have again this is totally fictionalized about dr. Oz where we've named dr. Oz as the primary physician and this actually is his street address I put again I pulled this off Google and that's his office's phone number and he does take new patients so dr. oz is is there and if dr. oz isn't available we could certainly put another person here again don't put dr. Oz's information in here if you're not his patient you should put who you're your physician is your primary care physician moving to page five this is where the signature happens it is dated you can see where it's signed Will Smith and then will prints his name under here so page 5 of 6 is where you write your name you do not write it on the first four pages you bet you write it on page 5 and put your address that's very important it helps identify you so it gives some added information now this document is witnessed this document is not notarized so this is kind of like a will and a will is not notarized this particular document is signed by two witnesses now the witnesses I'm gonna walk you through this these aren't just two these are two people who sign and they see Will Smith sign it and there's these two friends Tom Cruise and David Beckham again I googled all this information about who his friends are and these are their addresses I have no ideas if these are the actual addresses and Tom Cruise or David Beckham or Will Smith if you ever see this this is completely fictionalized so they sign as witnesses and then there's this additional statement of witnesses so at least one of the statements must at least one of the witnesses must sign this I declare under penalty of perjury which means I swear that I'm not related to the individual executing this advanced health care directive okay or I'm not entitled to any part of their estate that's very important so you know you can't have Will Smith can't have his two kids sign this you got to pull in one neighbor you got to pull in one friend at least one person with missingness has to fit this description now if Will Smith were a resident and a skilled nursing care facility this is only if you're a resident in a skilled nursing care facility the Ombudsman or patient advocate Ombudsman needs to sign this basically certifying that this is not really under the under fraud duress Menace or undue influence so it's an added level of protection protection for residents of skilled nursing cares of skilled nursing care facilities and that concludes the advance health care directive
