kindles a fire that runs upon the land of another shall pay the owner for damages and it's important to note that this is a civil process all open burning in new hampshire is governed by the department of environmental services air resources division enva 1001 are the administrative rules from des that state the requirements for open burning the rules regulate the size and the type of material which may be burned it clearly states that permits may only be written for the burning of permissible materials it's also important to note that the smoke nuisance clause no longer exists in enva 1001 snow cover requirements under res 5601.01 the ncr administrative rules regarding open burning indicate that no permit is required for open burning when there is frozen precipitation within a hundred foot radius of the burn site res 560102 when a fire permit is required just as the statute does and it says a fire permit shall be required for all open burning when the ground is not covered by snow should a question arise regarding the necessity of a fire permit for any type of burning device or container the director of the division of forest and lands shall make the final determination it's important to remember that with snow cover all forestry rules are suspended except for the type and the size of the material that can be burned and this is from the new hampshire des rules enva 1001 so unless you have a local ordinance that you are able to enforce in a local basis enforcement would be limited to whatever authority would apply under rsa 154 for any open burning related issues when the ground is covered with snow res 560103 covers fire permit issuance except as provided in this section no person other than a forest fire warden shall issue fire permits so this indicates the warden and authorized deputy wardens have the authority to issue permits it also allows the director to authorize others to issue fire permits after recommendation by the forest fire warden and this is how a issuing agent would be appointed definitions under dncr administrative rule res 5601 to kindle a fire means from the point of ignition to the time of extinguishment open burning means the burning of any material wherein the products of combustion are emitted directly into the ambient air without passing through a stack or a chimney from an enclosed container the use of portable fireplaces is considered open burning to completely extinguish a fire means to extinguish it so that it emits no smoke heat or flames the term does not include a buried fire portable fireplaces means devices such as chimneys steel fire pits and any other device designed to burn permissible materials other than gas or charcoal an enclosed container means any such purpose-built device container or vessel so constructed as to be completely enclosed by solid fire resistive material attached to a stack or chimney and capable of regulating fire draft and constructed as a solid fuel appliance examples would be a wood stove or outdoor wood boilers res 560106 discusses charcoal fires and charcoal fires in a container that's off the ground gas grills and other devices similar in nature and all controlled camp stoves shall not require a fire permit the permit exemption applies to chimneys only if charcoal is burned or if it is a propane fired unit in new hampshire the age limit minimum age to obtain a fire permit is 18 years of age there's a definition of stack in the administrative rules that came from nfpa stack means a manufactured or field constructed chimney for non-residential use made of a solid masonry unit bricks stones reinforced portland cement one or more metal walls or made of metal with a refractory lining or any suitable chimney lining that is capable of withstanding the flue gas conditions of its use connected to the appliance in an airtight manner and of such height as to properly regulate draft and control the emissions of sparks an administrative rule what is considered raining raining means sustained precipitation that is actively occurring of sufficient intensity and duration so as to prevent the fire from spreading in woodland fuels so for category two and three permits to be burned between the hours of nine and five it needs to be actively raining in order for that exemption to apply attendance of the fire means that an individual responsible for the fire and capable of extinguishing the fire is on the same property as the fire and is able to immediately extinguish the fire and has the fire in plain view seasonal permits for category 1 and category four fire permits now expire at the end of the calendar year a category four seasonal fire permit is issued jointly by the forest ranger and the forest fire warden or their issuing agent a primiti means a landowner or a person having written permission to kindle a fire from the landowner written permission can be in the form of this standard template that's available in your wardens manuals or it can be something as simple as a few sentences on a piece of paper but it needs to constitute written permission from the owner to the person designated in order for them to obtain a fire permit to burn on that landowner's property due to ownership and relationship changes it is recommended to have a new letter granting permission each year and wardens and deputies when writing the permit should retain that letter of permission and attach it to the warden's copy for records in september of 2017 the director of the division of forest and lands and the state fire marshal met and discussed some exemptions to the fire permitting law under a few circumstances it was decided that open burning devices could be exempted from the fire permitting requirement if they met the nfpa standard in the photographs on this slide you can see that these are fairly well developed fireplaces as long as the fireplace has the burn chamber covered with either a screen or fireplace doors and since the smoke is being emitted through a stack with a smoke shelf design included to tumble any sparks that may be emitted it was determined that these types of devices would not require a fire permit because they do not meet the requirements for open burning the fact that there is a stack attached to them and they meet the other nfpa requirements they would be considered exempt from fire permitting this slide indicates a couple of more elaborate patio style fire pit installations but as you can see the difference here as compared to the prior slide is that the smoke is not being emitted through a stack both of these devices are considered open burning and the fire permit is required for each of these devices whether it be a category one for a fire pit up to two foot in diameter or a category two for a fire pit up to four feet in diameter they would have to comply with the setback distances for 25 feet for category 1 and 50 feet for category 2. category 1 permit refresher again they can be burned at any time of the day they're essentially a camp or a cooking fire they may be issued by the warden deputy warden or issuing agent on a seasonal basis and as we mentioned earlier that would be from january through december of each year category 1 permits need to be a minimum of 25 feet in clearance from an occupied structure category 2 fire permits can be issued between 5 pm and 9 a.m they may be issued on a seasonal basis as well and they must be a minimum of 50 feet of clearance from an occupied structure both category 1 and category 2 need some type of fire resistive ring around the burn pit in order to comply with administrative rule category three fires can be burned between 5 pm and 9 a.m unless it's actively raining and then they could be burned during those daytime hours if it continues to rain once the rain stops the fire should be extinguished unless it is after 5 pm category 3 permits may be issued at the warden's discretion up to a 7 consecutive day period category three fires need to also be a minimum of 50 feet from any occupied structure but unlike category 1 and 2 the category 3 fire pit does not need a fire resistive ring around it res 5602 covers public and private campgrounds and picnic grounds category one permits issued in these areas she'll comply with the following they need to be on an area of clean mineral soil at least eight feet across they must have at least six inches of sand or gravel under the fire pit for any type of fire that's built directly on the ground there shall be no limbs or other burnable material to a height of 10 feet above the fire pit and they shall have a ring of fire resistive material constructed so it cannot be moved from the mineral soil area obviously we do not want campers or picnickers to be able to move the fire permit to alternate locations because it's most likely they will not select a spot that is safe that's why we would prefer that the fire ring is attached to the ground in some manner so it cannot be moved here's some valuable information that is in your wardens manual the schematic on the left you know indicates the setback distances and the sand requirement eight foot minimum clearance in the overhead vertical clearance requirement there's also a description here in the page to the right side of the slide that's also in your wardens manual we would recommend copying these if you have a new campground being developed in your community you can provide this as the state guidance for the establishment of the fire pit locations the requirements for the premier are quite extensive they're all covered in res 5601 0.04 this covers category 1 2 and 3 fire permit requirements so a permittee shall be issued a category 1 2 or 3 fire permit if the forest fire warden or authorized issuing agent determines the following the primiti is the landowner or they have land owners written permission the permittee meets the required minimum age of 18. except for public and private campgrounds and picnic sites the permittee meets the criteria for the specified distances from structures as follows category 1 it's a 25-foot minimum setback from occupied structures category two and three has a 50 foot minimum setback from occupied teachers the material to be burned is clean untreated wood or brush less than five inches in diameter and it meets the applicable air resources regulations the weather conditions are favorable as to prevent the spread or escape of the fire and the permittee has adequate suppression equipment to control the fire the premier meets the required time frame for category 1 they can be burned any time of the day whether raining or not category 2 and 3 permits must be burned between the hours of 5 pm and 9 a.m unless it is actively raining and one of the more important aspects is number eight the primiti has not had more than two open burning violations or any grievous violations within the past seven years based upon the date of the first offense in march of 2006 this administrative rule went into effect in this particular example on this slide we have an individual that received their first violation that was documented in june of 2014 this may have been a written warning in august of 2015 they received a second documented violation this could be another written warning could also be a administrative summons or a court summons in july of 2016 the individual received a third violation that was documented in writing this administrator rule allows us to suspend their ability to obtain a fire permit for the remainder of the seven year period from the date of their first violation which would have been june and 2014. so from july of 2016 through june of 2021 that particular individual does not have the ability to obtain a fire permit because of this restriction res 5601 covers restrictions and failure to abide by the fire permit restrictions shall be considered a violation and shall cause a fire permit to be summarily suspended so if you do summarily suspend a permit for a violation a written warning should be issued to document the reasons why the permit was summarily suspended the director may suspend the issuance of fire permits statewide or a portion thereof during periods of high force fire danger and when the daily fire danger reaches class four or five conditions now we're going to cover the basics regarding completing a fire permit essentially it's filling the information into the required cells or boxes the permittee's name if the permittee is not the landowner there's a box behind the permittee's name that you can check if they provide written landowner permission obviously they would need to do so if they are not the landowner in order for them to qualify for the permit the landowner's name and address would be indicated on the permit as you can see here the permittee is not the owner so it's important to have the landowner's contact information from the written permission that you obtained to include that information on the permit the location of the fire it may be the landowner's physical address or in many cases it's not the landowner's address it's a different location that was designated by the landowner and indicated in the written letter of permission would include the start date and the end date for the permit and then select the category of permit in this case it's a category 3 permit this could be issued up to 7 days maximum it's for burning after five pm and the fire needs to be extinguished by nine the next morning in this case it's not for seven days it's only for a two day period but the seven days is at the warden's discretion depending on local weather conditions a category three permit cannot be a seasonal permit so the seasonal boxes for category 1 and 2 on the right side of the permit would not apply here there's some information that the permittee should read on the face of the permit as well as a tremendous amount of information on the back a synopsis of law and administrative rule requirements encourage them to read that information or you could read that to them as you fill out the permit just as a reminder to review some of the permit laws and administrative rules at the time of issuance the permittee is required to sign the permit they would print their name their contact address telephone number email address and then whether it's a warden deputy warden or issuing agent they would also sign on the right side of the permit with the authority to issue the permit indicate the town that they have that authority in and the date that the permit was written they would also include the fire department's phone number the synopsis of the fire laws and administrative rules on the back is pretty comprehensive we've managed to use all the available space to include as much information as possible certainly encourage anyone that you're writing a permit to to read the back of the permit as well before kindling the fire to make sure that they're fully aware of all the laws and rul s which would apply in this instance the other type of permit that would be available in new hampshire on a more limited basis is a category 4 fire permit this is what was previously referred to as a commercial fire permit primarily because it allows burning during the hours of 9 00 am and 5 pm when it's not raining category 4 permits may be denied if a category 3 permit will suffice or if there's any other available means of disposal for that material these permits may be issued on a seasonal basis as with a category three fire category fours must not be closer than 50 feet to an occupied structure the fire must be attended at all times must be completely extinguished before leaving and burying the fire is not considered extinguishment this permit is issued jointly between the forest ranger and the forest fire warden or their agent an example for most of these permits that are issued is a requirement for brush burning at municipal transfer stations so the forest ranger and the fire warden would meet up annually to issue a seasonal permit from january through december for the municipal transfer stations in each community to burn brush if they choose to do so the same rules apply with a category 4 permit as any other type of permit there is no exemption for non-permissible materials there's no exemption to the 5-inch diameter maximum rule essentially the only difference with this permit is that it allows daytime burning and does not require it to be done when it's actively raining you'll notice there are a number of spots where additional stipulations can be made on this permit such as equipment that may be required in order for this permit to be made valid the gps coordinates for the fire and specifics about the material being burned but once again there's no exemption to the five-inch rule only permissible materials may be burned in the warden's corner and the division website as well as in your wardens manual we have a trifold brochure that we've just recently revised which includes information about all the different categories of permits on the back you can see that we discussed the fire danger class day information as well and how to prop extinguish a fire on the inside of the document we discuss the different categories the requirements for what can be burned the time of day the liabilities and penalties associated with open burning and there's a commonly asked questions section which should cover most of the questions that anyone new to the fire permit realm may have supplies of these are available through your forest ranger or you may download the pdf from the wardens corner and print copies as you see fit a new document was developed to provide additional guidance for a seasonal fire permit issuance this document is available on the division website it provides guidelines on the issuance of category 1 and category 2 seasonal permits if an individual requests a seasonal category one or two permit and the site and circumstances are such that they would be issued a category one or two permit then a seasonal permit will be issued as with other permits additional requirements may be asked of the permittee such as the request to call the fire department or dispatch center before burning checking on the fire danger class day and having adequate suppression equipment available at the site some frequently asked questions on seasonal permits can more than one type of seasonal permit be issued to the same individual and or location the answer is yes if an individual has two fire locations at the same physical location then both would need to be checked on the permit a permittee would need to understand the different kinds of requirements related to a category 1 versus a category 2 fire permit but they can both be issued on the same permit form are there required setbacks from public roads and utility lines officially the answer is no however the warden deputy warden or issuing agent can deny the permit if the burning in a specified location will create an unusual hazard that will endanger life or property or both so essentially you do have the authority to restrict burning in close proximity to roads and utility lines if it is a public safety hazard under 5601.08 if a fire permit is summarily suspended for non-compliance can all other fire permits for that individual or that physical address also be suspended the answer to that is no summarily suspending a permit applies to the specific permit and the violation associated with it if corrective action is taken and conditions are compliant with the law and rule then another permit can be issued to the individual or if they already have a second permit issued for that particular location it would still be permissible to use it as long as they complied with the conditions that were stated on the permit what constitutes a structure regarding compliance with setback distances for the purposes of res 5600 and the issuance of fire permits the division of forest and lands has used nfpa 1144 as a guide to define a structure so the definition utilized will be a building usually enclosed by walls and a roof constructed to provide support or shelter for an intended occupancy of people or animals including any attached combustible piece of work artificially built up or composed of parts joined together in some definite manner what is the definition of combustible this is also through nfpa 1144 a combustible is any material that in the form in which it is used and under the conditions anticipated will ignite and burn or will add appreciable heat to an ambient fire is there a date in the spring when seasonal permits are required to be in effect once the snow cover is dissipated the answer to that is no there's going to be variability amongst parts of the community in terms of when the snow cover dissipates but under administrative rule permits are required when the ground is not covered with snow what constitutes unfavorable weather conditions unfavorable weather conditions can vary throughout the state on any given day the forest protection bureau puts out the daily predicted fire danger during the fire season which is based on past current and predicted weather the fire danger ratings represent near worst case conditions measured at exposed locations or near the peak of the normal burning period class 1 and 2 fire danger days are based on the prediction that unfavorable weather conditions are not likely to occur class 3 fire danger is when fires may become serious and their control difficult unless they are attacked successfully while small normally the state does not restrict burning on class three days this is a decision made by the forest fire warden who needs to consider local conditions along with the size and location of the fire when issuing fire permits who has the authority to restrict open burning priority s 5601 0.09 only the director of the division of forest and lands can suspend burning on a statewide level without the governor's approval this can only occur when the fire danger reaches a class 4 or 5 condition it is rarely done and highly publicized when it occurs within a municipality the forest fire warden is the authorized agent with the ability to restrict burning on a day-to-day basis based on local conditions what constitutes an unusual hazard an unusual hazard is a unique situation as it pertains to public safety and the protection of woodlands and property examples are smoke impacting visibility on a public road or fire constructed under a utility line health complaints regarding smoke from a permitted fire burning permissible material are not under the scope of the division of forest and lands they are referred to the local health officer under rsa 147 colon 3. can burning be restricted to only days when it is raining the answer to that question is no ras 5601 is very clear on when fire permits are allowed if a permittee meets all of the requirements set forth in res 5601.04 then they shall be issued a fire permit do i have to notify seasonal permit holders when there are restrictions on open burning in effect or our category 1 and 2 fire permits exempt from those restrictions category one and two fires are not exempt from the restrictions on open burning and seasonal permit holders should be notified campgrounds may be allowed to continue to burn under certain circumstances because of the additional conditions required at their burning locations our public campgrounds exempt from the setback distances at campsites for their seasonal permits the answer is yes per administrative rule 5601.08 h campgrounds are exempt from the setback requirement because of the additional conditions required at their locations for rental properties can the landowner obtain a seasonal permit that will be valid for those individuals who will be renting the camp or the home the answer is no renters are required to obtain a permit for rental properties they are required to have written permission from the landowner in order to obtain that fire permit does the paper permit need to be posted at the burn site the paper permit needs to be accessible by the permittee and presented upon request of the director or the director's agent is a physical site inspection required for seasonal permit renewals if a site inspection has been performed in the past the answer is no a physical site inspection is recommended but not required the town forest fire warden has the authority to make this decision locally this slide is a list of non-permissible materials from the department of environmental services none of these materials are legal to burn tires household trash packing material coated or laminated paper coated or treated cardboard oily rags animal vegetable or kitchen waste used oil gasoline or other hazardous waste brush greater than five inches in diameter any wood that has been painted stained glued or treated in any way i.e there's no pressure treated or laminated beams or plywood that would be acceptable to burn and the reason why is is the toxicity of the smoke and particulate matter resulting from the combustion of these items there are a number of air resources division publications and brochures available to help educate the public as to what is legal to burn and what is not if you go to des.nh.gov you can download a number of those various documents for your use this one is a trifold that covers the beginning of residential trash burn he goes through and describes under state law rsa 125n what was prohibited with the passing of that law in terms of residential trash burning there's also an associated fact sheet that covers the same information and most recently des produced this backyard burning quick guide which does a good job of giving people the green for the acceptable types of burning and the red for unacceptable or non-permissible materials and then on the back of the quick guide it gives some guidelines and recommendations as well as a review of what is lawful and unlawful in terms of open burning if you would desire a supply of these they're available through the des air resources division the phone number there is 603 one one three seven zero in the next few slides i'm going to discuss the live fire instruction and training activities notification requirements with des these requirements apply to the fire service for the structure and vehicle live fire training that is done commonly in new hampshire a notification form must be filed with des prior to implementing the training burn i would strongly encourage you to contact ees with any questions to ensure compliance before conducting any type of structure or vehicle live fire training there are requirements for asbestos testing and abatement procedures that must be followed the burn must be a bona fide training evolution with a certified instructor and safety officer present if the burn is being conducted in the presence of the warden or their agent no fire permit is required dncr must be notified of the gps coordinates and the time and the date of the fire there is also a fact sheet available on outdoor wood fired boilers although they are not considered open burning because the smoke is emitted through a stack many times the fire warden is the first point of contact when an individual calls in with a smoke nuisance complaint it's important to remember that outdoor wood boilers are regulated by new hampshire des and the town and city health officers have been designated in this rsa to have enforcement authority regarding smoke nuisance issues resulting from wood-fired boilers
