required in most family court cases in South Carolina there are several sections this is the caption this is information about the parties this section is income this is deductions from income so that's the first page the second page is monthly expenses and the next section is installment loans such as credit cards or a signature loan this would not include your car payment or your house payment as I will explain later the next section is debts or applications that are not payable in monthly installments this might be a large medical bill or some other large debt that you're not making monthly payments toward the next section is property that you own and it's either marital property or non marital property now if many cases involve people that have never been married like a custody case between parents that have never been married and everything that you own would be non-marital in that case or if you're coming back to court to modify a divorce decree everything you own when you come back to court would probably be non marital property this next section doesn't apply to many people you you only go to the next section if you your total assets are more than $300,000 so I won't even go into this section because it doesn't apply to many people that are in family court on a day to day basis all right so this is the caption you would include the county where the case is filed the circuit where it's filed every county belongs to a Judicial Circuit in South Carolina the parties go here and it's either the financial declaration of the husband father or it could be the wife mother or you could just insert your name here or plaintiff or defendant if you wanted to and here's the case number here is information about the party that's filling out the the financial declaration you would only put fill out your side if you're the husband or the father or if you're the wife or the mother you include your address age occupation and so forth now this is the income section there's different types of incomes the first two belonged or apply to people that I call w-2 employee employee x' if you get a w-2 or you get a paycheck with taxes and other things withheld it goes here this is regular pay and down here's overtime commissions etc a lot of my clients complain well overtime shouldn't count but it does count because it is an important part of your income and many people get overtime on a fairly regular basis and I'll explain how to calculate that later pensions retirement and the new ''tis that's if you are receiving a pension plan from an employer some other retirement this would not be Social Security because here's where social security retirement goes this is Social Security retirement or Social Security disability or VA benefits additional employment income here is if you have have two jobs a second job goes here disability and workers comp benefits again this is not Social Security disability this is if you're receiving disability payments on a private employer disability plan or your own disability insurer plan or workers comp AFDC and unemployment spousal or child support goes here so this would be alimony or child support that you're receiving in a separate matter or from somebody that's not a party to this case dividends interest so if you have any of this kind of income rental income and business profits is fairly common this business profits is this is where you would fill it out if you're self-employed and there's even a place for other income and down here deductions from your paycheck or if you're self-employed you would put yourself employee tax here if your 1099 employee technically you probably should be paying self-employment tax if you don't haven't started figuring out your taxes yet sometimes I just estimate what your tax liability would be and put it as federal or state tax because you'll pay taxes on part of your income regardless of how you know whether you're actually figuring out your taxes yet a lot of my clients or 1099 and they haven't started doing taxes yet because they just started this new job now estimating your employer income can be tricky by the way this form is based on monthly payments so this would be monthly income so if you're paid weekly or every other week or twice a month you got to try to figure out what your monthly income is many people make the mistake if they're paid weekly of multiplying their weekly income by 4 to get monthly so if they make $100 a week gross income they multiply it by 4 and say that their monthly income is four hundred dollars this would be incorrect weekly income equals our monthly income equals your weekly income times 52 divided by 12 or put another way weekly income times four point three three three three monthly so that's something to always remember because we're going to talk about weekly payments because a lot of things we're going to do is to convert something to an average weekly amount and then multiply it by four point three three three to get monthly if you're paid every two weeks it would be by monthly income equals bi-weekly times twenty six divided by twelve which is the same as bi-weekly times two point one six six six six equals monthly obviously if you're paid every two weeks excuse me twice that us that should be twice monthly so my phone was wrong and I corrected or this didn't this little explanation was wrong twice monthly so if you're paid on the 1st and 15th of each month you've just divided by 2 to get the weekly amount so what we want to do if you're if you get the paid the same every paycheck you can simply you can simply take any paycheck and if you're paid weekly multiply it by four point three three three to get the monthly amount or multiply it by two point one six six six seven if you're paid every two weeks or if you're paid twice a month multiply it by two to get your average monthly amount and you would do the same thing for deductions from your paycheck like taxes and so forth but if your income varies what you want to do is find a average weekly amount so this is a typical paycheck and most paychecks include year-to-date figures and you'll see them here down here our deductions from pay so what'd you do this check was issued in October 13 2017 and what you want to do is figure out how many weeks have passed during the year for October 13 2017 and then divide these year-to-date figures by that number of weeks and if you check into it this would be the forty one forty first week of the year or they were 41 weeks past this year so if we were working on January 1st at this job we would divide each one of these figures by 41 to get the weekly amount and then once you get the weekly amount we would multiply it by four point three three three to get the monthly amount now I have created a spreadsheet that I am making available on my website as I'm doing this video it's not up on the website yet but it does the calculations for you right here you enter January first of what every year you're filling out this form or if you were hired during the during the year whatever you're hired date is because of course in October if you were if you were hired say in February or March you would not have 41 weeks earnings yet you would have less than 41 earned weeks earnings so you would be multiplying those year-to-date figures by something less than 41 to get the average weekly amount but just to show you how this works if I just put in let's say February 15 2018 well why did it do that February 15 2018 and then I'm paid October 15th 2018 is the date of my pay stub it calculates the number of weeks that are passed and then let's say I've earned $10,000 this year regular pay for some reason my formulas disappeared so it's not working but anyway I do it will be on my website and it will work here's one that does have the formulas you can see them up here this is one that's already filled out we started work we were working at this job on January 1st 2017 this is the using the pay stub I showed you and 41 weeks have passed during the year if you enter the year to date earnings that we're on that pay stub I showed earlier it converts to that gives you the monthly pay and I'll show you that's how it does it and it will do that you can put in whatever the item is on your pay stub regular pay vacation pay overtime pay federal tax these are deductions now Medicare and it will convert it to the proper monthly amount based on how I explained to do it dividing by the number of weeks that have passed to get an average weekly amount and then multiplying it by four point three three three by the way vacation pay sick pay and those sorts of things are regular pay so you would add these two figures to put on that top line of the financial declaration for regular pay overtime pay and bonuses which would be in the second line and then these are where you put the different deductions so back to the financial declaration I don't know if these figures match that pay stub or not I can't remember when I prefilled this form but your principal earnings from employment or 3000 dollars per month and you get nine hundred and nine dollars in overtime pay so I've read these figures aren't quite the same rounded it up a little bit to get that three I do round up though a lot of like this figure I would put twenty two thousand eight hundred fifty four dollars and leave off the cents here I'd put $73 and leave off the cents so I do round these figures up because they are just estimates of what your pay will be unless you get paid the same exact thing every pay stub then you put the total here of the this would be your total gross monthly income before deductions and then down here you put the deductions for every deduction on your pay stub you should be able to find something here this part right here is important if you have health insurance taken out of your pay stub it's important and children are involved in this case is important to specify the amount of your health insurance premium that is for the adult and the amount of the health insurance premium that is for the child and remember again this is a monthly amount so if you're paid weekly you've got to convert it to a monthly amount the way I've showed you get your average or the health insurance deduction would be the same every pay stub so multiply it by four point three three three if you're paid weekly or two point one six six six six if you're paid every other week multiply it by two if you're paid twice a month one way to figure out the adult versus the child if you can't get from your employer what it's costing for the child is just figure out how many people you cover and figure out how much it is per person so that if you cover yourself your spouse and two children four people are covered and if you're paying $200 a month then it's $50 per person and that would be $100 for the adults and $100 for the children if you covering yourself and two children and it's $200 2,100 them to make it eat the math easier then that's $70 per person so it would be $70 for the adults and 100 40 for the two children that's how that would work if one if you have a deduction from your check that's not on this list you list it down at the bottom and specify what it is and then you deduct you take your your gross monthly income minus your deductions and that's your net monthly income that goes here a lot of times this is on the first page but my spilled over to the second page here you might want to list all the members of your household and what the relationships are like do you live with your girlfriend or do you live with your new wife or do you live with your wife and stepchildren it helps for the court to know who all is in the household that these expenses and income cover again you only fill out your side and same thing for expenses you've got most of these are self-explanatory rent residents food and household supplies you just have to estimate what you spend per month all of these are fairly self-explanatory you'll see that there are footnotes for these and if something doesn't is not self-explanatory like adult incidental expenses number 14 there is a footnote in the back and I've just highlighted it adult incidental expenses include cosmetics hair nail care books magazines newspaper business do Spetz charity religious dues so there's a lot there some things on the expenses that that are kind of difficult or call some people problem one is the auto insurance taxes gas and maintenance you've got to figure this into one monthly amount so insurance is usually played monthly but gas you don't pay it monthly you pay it whenever however often you fill-up taxes is paid yearly and maintenance is sporadically I have I have come up with an estimate of typical car maintenance charges that I think would apply for most people most everybody does an oil change every three months and so that's usually about forty-five dollars a month during the year that I'm creating this permit may be changed or this explanation it may change a few years from now but it's about forty five dollars when you do an oil change that and you do it every three months if you divide it by three that's 15 dollars a month let's say that your maintenance is $750 every two years so that would be a chain new tires at about every two years plus other stuff that you spend besides oil changes divided by 24 and that's 31 dollars a month let's your whatever your taxes are you divide by 12 if it's a two hundred fifteen dollars a year that's seventeen dollars but you figure out your own taxes you may pay four hundred you may pay fifty a year but divide it by twelve to get that amount whatever your insurance is a month that goes here gas that's going to differ depending on what kind of gas mileage you're getting how far you drive a month but I fill up my car about once a week and it's about thirty five dollars right now to fill up my car gas prices are kind of low at the time I'm doing this explanation so thirty five dollars times that four point three three three I told you about earlier for converting a weekly to monthly and that's what you get then you add all these together and that's that's the total and so back to our financial declaration you put that figure here you put you do a subtotal here of this whole column two here and then you start adding things again and these again are most self-explanatory adult clothing trips some people up I figure out how much you you spend a year it's very easy to spend twelve hundred dollars a year which is a hundred dollars a month some people say I hardly ever buy those and you may only buy $600 a year which is 50 a month or you may only spend 120 a year that's $10 but most people at least buy something during the year children's clothing you figure it out the same way entertainment that's again if you look at the footnote that's movies theater vacation sporting events compact discs rental videos that kind of thing figure out what to spend a month we've already covered in adult and still now these if you're making payments don't credit cards or other debts besides your car or house because your car is up here and your house is up here but if you're paying other debts now these aren't monthly expenses like utilities or utilities or monthly other monthly expenses these are debts where you've borrowed money or on a credit card or just borrowed it somehow you put who you owe it to what you used it for the monthly payment the balance and who owns owes it it could be you or it could be both of you both parties to the case that would be joined and then you put the installment the total of the monthly payments goes here right here I mentioned earlier you may have a month or a big or a debt that's not payable monthly and you put the particulars of it here here's some things are you in bankruptcy our obligations lifted above in arrears if they are you explain what is going on here I put yeah the mortgage payments three months in arrears or if these credit card debts or past due you can put credit cards or past due now this section is for assets now if if this is a divorce and you're if you're m rried anything accumulated during the marriage is marital property doesn't matter who owns that or who bought it or who paid for it or whose name it's tie well it does matter whose name is titled in because that would you would put it on this side or that side depending on who it's titled to or over here if it's titled to both of your names but you start with how much cash you have in a checking account or in your pocket or in a jar at home the next one is savings retirement accounts such as a 401k or pension plan how much is in it or what it's worth pension plans can be difficult actually this is a pension plan pension plans can be difficult to evaluate and that's beyond the scope of this video but if you're dividing a pension plan you may need an attorney or at least consult an attorney stocks and other investments go here real estate if you own a house or other real estate you list it here this in this case they own a house it has $23,000 worth of equity and it's in both of their names now if you own a hundred thousand dollar house but you owe eighty thousand on it then you put twenty thousand here so it's the value what you think the house is worth - what is owed on it so you need to figure out what's owed on the house and you need to figure out what you think it's worth we often start with what the tax appraiser says it's worth and a lot of counties you can look in Anderson County you can look that up online I don't know how many counties you can look it up online but you can always contact the assessor's office or go there in person to find out what they say your house is worth the value of all other property would be all of your stuff like furniture tools guns jewelry lawn equipment all everything that's not real estate or is not a bank account or money goes here so a lot of my clients will leave this blank and I tell them though you need to put something here because everybody owns something even if it's just the clothes on their back of course if it's just the clothes on your back it may only be worth 10 dollars but a lot of times this has significant value and then you put the total here now non-marital property is property that's either inherited oh I should have told you this is where property acquired during the marriage goes but it does not include property that was given to you by a friend or relative as a gift or property that you have inherited so in this situation down here now if you're not married everything goes down here is non marital property and what I recommend you do is use these categories and list them down here they don't have categories down here so you would start with what cash you have and so forth but I've given some examples these these would this married couple this couple if his 401k for example if he was working for this employer before he got married then what was accumulated in the 401k before the marriage is not marital property and I've got a demonstration of how you figure that out one way to figure it out is this you figure out he's got 14,000 in his 401k on the date the case was filed he's been working at them with the employer for 25 years he's been married 16 years so 16 out of 25 years is marital property so 16 divided by 25 so if you take the total that's in it today times 16 divided by 25 you get eight thousand nine hundred and sixty that's marital property the rest is non-marital so that's how we came up that's how I figured this out on my financial declaration you've got this part is marital property this part as non-marital by the way it puts down here it says who owns it so it could be joint or it could be you the date of acquisition so 401k is accumulated over time so I put n/a or nine applicable because it wasn't acquired on a certain date but this guy owns a parcel of real estate this unimproved doesn't have a house on it so it's a lot and he owned it before the marriage we put the date that he acquired it and it was a gift from his parent so or if it even if he fired it during the marriage since it's a gift from his parent it's not marital property and put the the total here I didn't feel this part out but if this is not a marriage or if you own some personal property before the marriage you could list it here and I would normally for personal property I often put not applicable for the date acquired unless it's a single item but if you have a various items of furniture cars tools and all that you've accumulated them over time and it would be non applicable and as I said earlier the rest of this form that you don't need to fill out unless you have over 300,000 in assets and if you're doing that hopefully you will get a lawyer to help you even if you have a lawyer the lawyer is going to give you this form to fill out because you're the only one that can gather the information for the lawyer but the lawyer can help you one other thing that's important to note on marital property versus non marital property the date that the court determines what is a marital property and marital debt is the date the case was filed so if you've been separated for three years but you're filing the case now the date you file the case is the date that you determine the part of your 401 K this marital versus non marital so or you know if the case has been pending two years the date that you decide what's marital versus non marital is the date of filing one other thing to understand a lot of people ask me well why do I have to fill this form out we've agreed on everything well anytime the Court is ruling on issues of property division alimony child support or attorneys fees it requires one of these forms and chances are in your case the court is ruling on one of those issues even if you have an agreement that says I'm keeping my property she's keeping her property and each of us that's going to pay our own attorneys fees and none of us we're not going to get alimony the court is still ruling on all those issues because it has to determine that your agreement is fair and the court has to know what you own what she owns and what your what the court has to know all about your finances and know that you have disclosed your finances to the other party so this form is required in almost every case I
