Have you ever had your blog content stolen?
Sadly, the internet is rampant with clicky-fingered bloggers and writers ready to cut and paste content from your website on to their own without permission. Luckily, if you find your content has been posted online without your permission, there are ways to deal with the theft (and it is not my bruiser cousin Michael Corleone). Here’s an abbreviated version of an article posted on my blog Sidebar Saturdays outlining what can be done. The Case Of The Stolen ContentFirst, determine if the unauthorized use is considered “Fair Use” under the copyright laws. The copyright laws permit use of your copyrighted work without permission for things like criticism, commentary, news reporting, educational, and research purposes. If you want to learn more about fair use, see this article on PhotoAttorney.If you believe the use of your work is not considered “fair use,” then begin the process of having the infringing content removed.1. Send a cease-and-desist emailBefore you go all formal-copyright-ballistic on the person who has copied your content, send them a please-remove-my-content email first. Simply state in the email you are the copyright holder of the content in question and have not given them permission to use it. Provide a link to your content that has been stolen, the date it was published, and why you are the copyright owner (author, work-for-hire, etc). Then give a time frame by which the stolen content should be removed from their site or you will file a formal complaint (24-48 hours is usually enough time). The tone should be polite, direct, and business-like (without blustery). This process usually works (often without a reply).2. Send a takedown complaintIf a polite email gets you zippo traction, the next option is to take advantage of The Digital Millennium Copyright Act. The DMCA is a law that, among other things, extends the copyright laws and penalties to digital media and the internet. These provisions provide a process for the removal of infringing content, what most call “takedown notice” procedures.First, file a complaint (the “takedown notice”) with the service hosting the website with the infringing content. The complaint is a nicely worded request to the hosting service to remove the unlawfully copied content from the website in question. In addition, you can also send the notice to search engines like Google and Yahoo. Website hosting services and internet search engines have policies that outline the removal of copied content. It is a requirement per the DMCA if they want to avail themselves of the “Safe Harbor” protection (see below). Here are two examples of policies for legal removal requests: one for Google, and the other WordPress.If the website host has no takedown notice form to fill out, use one of these sample takedown notices: IPWatchdog, The Electronic Publishing Industry Coalition, or Innovation-To-Profits.These forms or letters are simple to fill out or write, and contain the following information:1. Description of your copyrighted work being infringed and where it is located (website URL);2. Identification of the infringing content and where it is located (website URL);3. Your contact information — name, address, telephone, email address;4. A statement that the copyright owner (you, or the agent authorized on your behalf) did not authorize the infringing use;5. A statement the information in the takedown notice is accurate; and6. A signature of the copyright owner or person authorized to act on the owner’s behalf.Once the hosting service has been properly notified via a complaint, they have two choices.1. Technically, the service provider is infringing the copyright laws by hosting a website with pilfered content. But the DMCA provisions provide them with immunity from copyright infringement lawsuits, something called “Safe Harbor” under the copyright laws, provided they take certain steps. They must take reasonable action to remedy the infringement by removing the infringing content. Failure to do this means loss of immunity. Invariably, when presented with the potential of a complex copyright lawsuit or avoiding liability, the web hosting service will almost always comply with a takedown notice demand.2. If the web-hosting service or search engine does not remove the infringing material, and instead believes the complaint was filed in error, they can respond to the complaint, refuse to remove the content, leaving you to pursue a copyright infringement action.If the material is taken down, the website host will notify the person who posted the infringing material that they have received a takedown notice. The person accused of the infringing act, can then file a counter-notice to dispute the allegations. The website host will then consider the circumstances and if the copyright owner has not initiated formal legal proceedings in ten days (which hopefully will not be needed), the website host will restore the content as required by the DMCA.One thing worth noting, if you feel you’ve received a takedown notice by someone seeking to silence critiques or other unwanted content (which does happen by overzealous free speech squelchers), dispute the notice and request the website host to repost your content.What not to do?The Shame ApproachIf you want to look petty, resort to shaming the infringer by blogging on your website or posting comments to your Facebook groups about how horrible the person is for copying your material. Shaking your internet blogging finger at the person will only inflame the situation, and may, depending on how deep you go into angry-Wolverine mode, set you up for a defamation lawsuit. (If you want to know more about defamation, see my earlier post on Sidebar Saturdays).Other things to consider?Duplication Detection SoftwareIf theft of your content happened once, it will happen again. Be proactive. Set up a search for stolen content using duplication detection software. Here are a few tools worth checking out.1. Google Alerts scans the internet for your stolen content, then notifies you. The great thing about this tool, it is free.2. There are also other sites with duplicate content detection software that are free, like SEO Review Tools, Article Checker, Duplichecker, and Plagiarisma.3. Copyscape also searches for duplicate content, but unlike Google Alerts and the others above, it requires a fee.4. Another premium services is Content Rescue.Trackback and Pingback NotificationsThese alerts do not really inform you if your content has been stolen, but they do notify you if someone is commenting on your content (trackback), or they are linking to your content (pingback) from their blog or website. Here is a brief article about the difference between the two notifications. Be aware that trackback and pingback notifications tend to be mostly spam, so moderating these notifications to look for someone who might be copying your content without your permission can be laborious and not worth your trouble.We writers work hard at creating content. No one should be allowed to take credit for our efforts and words. Unfortunately, our cut-and-paste internet world encourages content theft. Thankfully, the copyright laws provide relatively easy (but somewhat time-consuming) measures for protecting your creative content.

Why doesn't Kuwait become an absolute monarchy?
This question came about after my answer to this question and my comparison of Kuwait and it’s successful neighbors which are absolute monarchies:Abdulaziz Al Meajel's answer to What are the politics of Kuwait like?Personally after studying the topic more in university and particularly the idea of direct democracy there is more choices for Kuwait than simply becoming a constitutional monarchy with a legislative parliament or absolute monarchy in which the monarch is both the sole executive and legislative authority. The issue in Kuwait is that of corruption, and the more layers there are between the rulers and the ruled the more corruption there is. We can elect as many representatives to the National Assembly as we want, and those corrupt individuals with the wealth and power to try and steer politics in the country in their favor will keep buying them out. However, can those same people buy out the whole Kuwaiti population?I have developed a political system (not fully detailed with issues that would need to be worked out), which I believe would work wonderfully for Kuwait after studying different systems such as that of Switzerland as well as assessing the current system as well as that of neighboring countries and with taking into account the traditional system of rule and culture. This system obviously would require a major change to the constitution in order to be implemented, and is unlikely to happen and is simply an idea of mine (what can I say? I’m a dreamer!) and it blends in aspects of absolute as well as democratic rule in a way where the ruler can rule freely along with or checked by citizens and both checked by a judicial authority which upholds the constitution.The ruler has absolute power to the extent that is checked by the people. The ruler is also Supreme Commander of the Armed Forces with authority to declare defensive wars.Legislation is through decree by the ruler or proxy (government) or through initiatives from the people (Consultation/Shura). 50,000 signatures for a legislative initiative proposed by a citizen will transform it into a referendum that must be voted upon at the end of the month along with other initiatives proposed. The ruler can either accept or reject the law after it has been voted upon and the results publicized and the reason for rejection must be stated. Meanwhile the ruler can rule through decree, a decree can be challenged through an initiative that gathers 25,000 signatures, setting it to a referendum and if passed will repeal the decree, and this is the method to repeal any current standing law.The Supreme Court interprets the laws and may reject any law or uphold laws proposed on the basis that the proposed changes contradicts Islamic Law based on the Qur’an, Sunnah, and consensus of scholars. It may also recommend laws based on that regard to the ruler. The Chief Judge of the Supreme Court is selected by the ruler and must come from a judicial background and he appoints members to the lesser courts. The Chief Judge retains the position until death or resignation or can be removed through a referendum proposed by the ruler solely and voted on by the people.The ruler once coming to power will nominate an heir who must be approved by referendum, if rejected, other candidates are proposed and the candidate must obtain at least 60% of the vote to confirm their position. The ruler rules until death or abdication. Removal of the ruler would require an initiative with 100,000 signatures that would be put to a referendum.Essentially, this system would give the ruler free reign to do what they wish if they have a vision to uphold in terms of development projects and the like. While the citizens can contribute to that vision if they have their own ideas or put a halt to the rulers’ decrees if they do not agree with it. Filtering out what is best for society while giving it the ability to progress quickly once a ruler with vision comes to power. Voting on legislation directly would also limit the influence of tribalism and sectarianism on the political field. People would no longer be voting for other people for them to be voting for a person of their sect or tribe, but rather they would be voting on decisions that affect themselves. That said there would have to be other anti-corruption systems in place in order to make sure the country becomes among the least corrupt in the world and works efficiently. This includes:1-Financial Transparency in government:-Government and state owned finances are made public and live through an online government website, accessible through a phone application. All financial transfers to and from are live and made public and is organized based on government institution and is divided between salaries, maintenance, and other transfers. Reason for the transfer must be provided as well as the sources of transfer and who it is transferred to and why.-All government and parliamentary officials, the Prime Minister, Deputy Prime Ministers, government Ministers, Ministers of state, Members of Parliament, those with a direct relationship to them, spouses, children, parents, and full siblings as well as employees throughout their tenure will have their finances made public and transactions live, however unlike the government finances what the transactions are will be kept private unless exposed through judicial warrant. Each member will have their direct relatives kept under their file. Sources of finances into the accounts are public however.2-Anonymous reviews of government institutions:-Every government employee must wear a clear name tag and keep their name on the desk.-After every interaction between a government employee and an individual coming for a service. A form will be given to the individual by the government employee to rate the experience and provide feedback to be handed in by the exit. Also in general while leaving the individual will be given a simple mechanism to rank their general experience.-Through government website and app, a complaints form for all government departments to be submitted either anonymously or with contact information. If with contact information, guarantee of 24 hours before response.3-Incentives for corruption reports:-Those involved in a corruption string or know of it and report it will be guaranteed full government protection, as well as a generous financial compensation. If involved in a corruption case, if they return any amount stolen by them or bribed to them it will be considered turning back on their old ways and will receive a full pardon. If they are unable to pay back in the case of theft or bribe in full then they receive financial compensation and protection but with a sentence not exceeding five years.4-Strict punishment for the corrupt, reward for the clean:-Involvement in corruption through the taking or giving of bribes or financial political transactions will amount to a punishment of no less than twenty five years imprisonment with hard labor. The amount bribed will be confiscated with the same amount as a fine.-In the case of theft (unless reason is poverty or for a different reason judged on a case by case basis), unless money is returned in full, punishment will involve the public amputation of a hand. If returned in full, punishment is no less than five years imprisonment.-Those accused of possessing finances with unknown origins will have the burden of proof placed upon them to prove the source of income, if the origin cannot be proven then the finances are confiscated under the assumption that it is graft.-Those confirmed to be involved in cases of corruption will be named and shamed with their four names (first name, father’s name, grandfather’s name, family name) publicized on state media.5-Media reforms:-Free Media considered tool to combat corruption and maintain the country and fix anything lacking or unmaintained as well as expose government shortcomings.-Freedom of expression except in that which insults the Islamic religion, the head of state, or the heads of state of fellow Gulf countries.-Online journalism through blogs and social media guaranteed, except through the spread of rumors that damage national unity with no basis to them unless identifying clearly that it is unconfirmed.Bureaucracy would also have to be reformed in order to ease dealings with the government and maximize efficiency. This would be through the creation of a “Smart Government” system:-The establishment of an electronic program or mobile application that is tied to a official government online website.-Every individual has a profile which displays their employment or student details as well as marital status and civil identification information, birth certificate, and documents and decisions made by all Ministries towards this individual.-The individual would using the application be able to renew their passport, as well as civil ID, as well as delay military conscription, sign up for government educational sponsorships and scholarships, register for a trading license, or for expats renewing their residency, as well as other forms of interaction with the government.-The government deals with the individual as a single entity rather than various ministries. Each ministry will have knowledge of the individual’s status from other ministries and documents in their posession without having to go from ministry to ministry in order to get papers and documents, everything will be done electronically and most the work by the government rather than individual.-The person in question will be able to have documents ordered (such as passports and civil IDs) delivered to their home or a collection point would be set.-Backups of the system will be set and will be accompanied by a paper archive in case anything were to happen to the electronic archive or vice versa.This would ease people’s dealings with the government and substantially reduce bureacratic and government corruption. There should also be an option to take a picture of damaged public property in need of maintenance or fixing as well as presenting the exact location in order to produce a cleaner, better looking, and well maintained country. However that is not the end of things, as there needs to be an infallible economic and welfare system which puts citizens above all else.Welfare Rights and Economic Adjustment of the State:-Free quality healthcare. For better efficiency through shared public-private partnership where new doctors can work in public hospitals with a government salary, private hospitals would be connected to the Ministry of Health network and citizens choosing to be treated there would have costs covered by the government with the receipt with the cost audited by the government.-Free quality education from kindergarten to university or training centers for skilled work. Banks may not use money held in individual accounts for any reason and may only use money from revenue earned except in the cases where individuals give the bank permission to use their money to invest and even in that case the bank must insure the money in those accounts so even if the investment fails the money remains as it was. Other means from which banks can earn revenue is through investment and particularly in local projects and companies as well as taking a set percent annually of the wealth of the individual as fees for keeping money in the bank which cannot exceed the set percentage set by the Central Bank. A set percent taken (same as the percent taken of wealth annually as bank fee) by the government for transactions made with foreign credit cards.-Investment among sources of national income:-Support for local businesses and productions particularly small businesses through government investment. Agreements signed between these businesses and the government would involve government investment in exchange for shares in the business which it receives revenue from and is able to sell whenever it wishes however the owner of the project whom the government had agreed with has preference when looking for buyers. This would support local businesses as well as provide a new source of income for the government.This system if put in place would increase income equality and essentially destroy any sort of poverty. This would also support the economy in terms of surplus in wealth for people to spend considering their needs are met in their entirety. This would also allow a portion of the population to generate ideas of projects and inventions and pursue them, supporting the vision of a knowledge economy.All in all, that is the system and reforms I would put in place for Kuwait which would combat corruption and fix the welfare system where efficiency and quality is put above everything.
