welcome to this webinar hosted by the pennsylvania association of notaries pan the title of today's presentation is did you know we will discuss things you may not know and misconceptions about being a notary in pennsylvania my name is brian crocker i'm joined today by john marentzel we are both pan instructors we will begin with a housekeeping video move right into the presentation which will also be a video and then have time for you to get answers to your questions please hold your questions until after the presentation is complete we estimate our webinar will take anywhere from 30 to 45 minutes of your time let's begin [Music] hi there welcome to one of pans webinars i'm glad you could join us today let's go over a few housekeeping items before we start with the presentation before we start we recommend using google chrome or mozilla firefox for your internet browser when participating in our webinars those seem to work best with connection and functionality if you don't see the chat box on the right hand side make sure you click on the three white dots in the red box that will expand the chat box onto your screen make sure when you're sending a message in the chat that you set it to send to everybody mode also if you're asking a question make sure it's set to q a mode next you will want to make sure you check out the files tab this is where we will have files available to download for you you can find the files by first making sure you click on the word file then you will click on the up arrow on the right that will expand the file tab up where you will see all the or freezing of your screen that wraps up our housekeeping items now on to the presentation [Music] welcome to pan's video called did you know in this video we're going to touch on some things you may not know and some common misconceptions about being a notary in pennsylvania did you know remote online notarization also known as ron is still acceptable in pennsylvania ron has been temporarily approved in pa during the kovid 19 pandemic as of right now all 67 counties in pennsylvania are in the green phase some notaries believe since their count is in the green phase braun has gone away this is not true even though your county is in the green phase right now businesses are still required to follow the covid19 guidance for businesses you can find that information available under the helpful links provided in the file section the authorization of ron will expire 60 days after the termination of the covet 19 emergency declaration issued by governor wolf for information on how to apply the differences between electronic notarization and ron and how to do a remote notarization check out these two videos on pan's youtube page a link to pins youtube page is in the helpful links under the files tab did you know attaching note wording is acceptable before you attach notary wording there's more that you need to know if there is room on the original document to add the notary wording your stamp and your signature that is what the department of state wants you to do when there's not enough room that's when it's acceptable to do an attachment on the original document write on there a statement similar to see attached notary wording then with the date make sure the original document is stapled to the attached notary wording don't use a binder clip or a paper clip to attach to documents you want to make sure they are firmly attached on the attached notary wording page you can write a statement similar to this rhonda jones rental agreement again with the date on it this shows what the attachment should be attached to the attached node rewarding needs to have a venue a statement your notary stamp and your signature the notary used her embossing sill as well on this notarization blank pdf fillable notary statements can be downloaded for free from pans member portal speaking of embossing sales did you know embossing sales are not required to be used in pennsylvania there are many notaries out there that still use an embossing so when they notarize it's important to know your embossing seal can never replace your notary stem if you plan on using an embossing seal it needs to be used in conjunction with your notary stamp people always ask if embossing sales are not required why do people use it here are four situations when embossing sale might come in handy for more detailed information on embossing sales again check out pan's youtube page we have another tutorial video on embossing sales did you know all notaries are required continuing notary education every four years the education needs to be at least three hours and also approved by the department of state pan offers live seminars throughout the state that meets these requirements and if you don't find a seminar in your area you can sign up and take our state approved notary online course did you know if you don't have an active notary commission when you apply or reapply you would need to take a notary exam verlona took effect on october 26 of 2017 it's required that all first-time notaries and notaries that have let their commissions expire need to take the notary exam did you also know that on top of the education requirements every four years you need to go through the commissioning process every four years as well this means you will need to go to the recorder of deeds to record your bond your commission and take your oath you will also need to register your signature at the county pathologies office and lastly did you know your ten thousand dollar notary bond does not protect you the notary this surprises some notaries in pennsylvania they believe the bond protects them when in fact the ten thousand dollar notary bond protects the customer in the event the notary would cost them a financial loss one way you could potentially protect yourself is with some form of heirs and emissions insurance if you're interested in some form of eno for my work my boss dropped a sign letter on my desk and asked me to notarize it then went back to his office the letter had no notary wording i took it back to him and explained the no no rewarding process he said never mind and took it back the letter had had appropriate rewarding i still should not have been able to notarize it because he was not present correct linda you are absolutely correct you did the exactly what we teach japan that's what's required the two most important things you do as a notary and they really go hand in hand is you need to demand personal appearance of your customer and then you need to id them properly um so yeah you did exactly what you needed to do there linda um great job uh nick wants to know is there a suggested script or bullet point list for remote online notarization ceremonies to ensure notaries are covering all bases i have heard nick that some of the vendors have a a checklist of sorts to make sure you're on the right track if your vendor that you're using does not have a checklist i would just be very careful to make sure you're following the notary law claire asked do you need more insurance for ron um so you're not required errors and emissions insurance in pennsylvania it's not required um what you are required is a 10 000 notary bond and you do not need an additional bond um but if you are interested in eno insurance like we mentioned you can check out our website and also call in the customer service all right uh earl if you're giving up your notary what is required of anything i am retiring uh you can do a number of things earl you can just let your commission expire and at that point destroy your stamp and take or send your all of your registers all of your journals down to the recorder of deed's office or if you are retiring mid commission i would actually uh write a letter to the state letting them know that you are resigning and then again you would do those other two things destroying your stamp so it's not usable and then also send or take your registers and journals down to the recorder of deeds all right so barb asks i have an e notary status but on the department of state website it states i do not does that actually matter um i would definitely recommend barb contacting the department of state more likely by email that's going to be your probably your best solution and quickest response um because something might have fell through the cracks on their end you definitely want to make sure that all your ducks in a row so if you think you are approved as an e notary you want to make sure it reflects on their end so maybe they don't have something on their end i would i would contact them uh sherlin good morning thanks for that very helpful what was the document mentioned in the video something about a blank document for adding a second page if your stamp doesn't fit we talk about when there isn't notary wording on a document and we've had had that topic in in prior videos or in prior presentations but the the primary solution to that problem is if there is room on the document and you have followed all the steps and gotten the customer's decision and permission to add notary wording that you add it to that page but if there isn't space that you can attach a separate piece of paper to the document itself with the actual notary wording on it that's what we were talking about that's not what you're asking for uh let us know uh send us an email uh gray gas it kind of ties into what you were asking um if there's no room on the dock can you add the wording to the back or does it need to be a separate sheet of paper um the notary law or the regulations don't address that but what we're going to teach you greg as a best practice we don't recommend putting it on the back of the piece of paper unless there's additional language on the back that whoever created a document um i wouldn't recommend putting on the back pan wooden just because it could seep through it wouldn't be legible um what the state wants you to do is put it on the original document or if there is no room go ahead and do that attachment how we talked about it in the video and i think another reason just to piggyback not to add it to the reverse side is if it's not already a two-sided document when you give it back to whomever is receiving it they may not look at the back very true uh i'll take margaret and judy margaret wants to know do the webinars count for the education required for your notary commission margaret they do not they do not uh judy i was asked to notarize an annulment witnesses signature is this necessary judy i don't think your place is to ask is it necessary i think it would be your place to look at the document see if there's notary wording on it if so and someone's asking for that service you can provide it if there's not notary wording and they want a notarization you can follow the process ask them which notary act they want if the wording wording's not there add it with their permission if they can't decide then you can refuse but you making a determination whether or not a particular type of document is needs to be notarized or not is not something a notary should be doing all right joe uh charlotte asked i notarized uh a large quantity of vehicle titles and the pen was running out of ink so the date is a little messed up they want uh an affidavit for me stating the date is not distorted because of fraud is this accurate and what should be stated in the affidavit uh charlotte that is something we commonly see from penndot um a lot of times if there is a mistake or something wrong with the title they will actually just consider it to face but there are some circumstances they're very rare but there are circumstances like the circumstance you're in where penndot will accept a notarized affidavit from you the notary stating what happened so you just need to describe in that situation what happened why um the date is distorted or messed up and then go ahead and send that off along with the paperwork again off the pet dot and again just to piggyback on that the notarized what really should be called a verification on oath or affirmation i know penndot still calls it an affidavit needs to be notarized by somebody else so you're making the statement but somebody else needs to notarize it for you erica says my commission expired on july 20th i already have been sworn in with my new commission do i destroy my old stamp how would i do that yes we recommend that when your commission is up and that's actually one of the reasons stated in the notary law that you would destroy your old stamp so that it cannot be used by anybody else uh if it's a pan stamp i would expose the impression part there's a lock on the back to hold it in place you can gently without making your fingers black peel the impression part off and chop it up with scissors or if you're unwilling to get your fingers all black you can take scissors or a razor blade to that impression part so that it is no longer usable so i'll take charlie and dawn here charlie just had a comment said the eno insurance through pan here is very reasonable i am also a notary in new york and the same policy and company is four times as much so we appreciate that um that's great to hear i'm glad that we can uh be assistants to you there charlie and don says on a power of attorney does the principle statement of um do you understand what you're signing are you signing this willingly have to be a separate written statement or is that just a verbal question posed to the principle um if it's verbal only should i note that they understood and signed willing and willingly in the notes remarks section of the journal entry so yeah those questions we recommend asking um or it's a good idea to ask is only acknowledgement make sure the customer does understand what they're signing their intent to sign and that does not need to be on the document um that's something that you will have a verbal conversation with the customer just to make sure they understand what they're doing um and it's up to you you'll get in your own routine um do you want to put that in the remarks section you absolutely can um nothing against it um is it required by the notary law it's not um but if you want to make note that you asked a couple questions and they did understand more information the better it's not going to hurt don i'm going to take a look at uh questions from katherine ann from sue okay uh catherine wants to know if there is no notary wording can you add the wording after determining which type of notary act is needed the answer is y s but again you want to follow proper procedure which is to ask the customer which notarial act they want you to perform and if they can decide then get permission to add the wording if they can't make a decision your only choice is to refuse we do have a webinar that's all about what to do when there is no notary wording i believe that that's still out there on our youtube page let's see sue wants to know does the recorder charge for recording the registers well first of all there are 67 recorders of deeds in pennsylvania soon i'm not laughing at you i'm laughing to thinking that everybody's every one of those people is different um i don't know that would be something you'd have to check on you might want to call them before you go or before you send the things in they are required to take them we have heard in the past that some of these recorders don't want to take them they don't know what to do with them that's not your that's not an issue that you need to worry about but to answer your question i don't know whether they charge or not all right so i'll take kathy and mary in here kathy says did i read correctly that we can be efficient at a wedding um kathy that is actually a misconception in pennsylvania notary cannot officiate a wedding um some states a notary can now there's not many of them i think florida might have been one louisiana i know is one for sure and i remember the other two nevada maybe maybe nevada as i say there's three or four but yeah pennsylvania is not one of them so don't go run around marry people that's for sure kathy marianne good morning what is the date that the remote notarization ends so there's not an official date but what i do have here is just a really quick prepared answer um remote online notarization is temporarily authorized for all pennsylvanian notaries as of right now the authorization will expire 60 days after the termination of the coven 19 emergency declaration issued by governor wolf so that declaration has not been um issued so whenever the termination comes into place 60 days after that's when it will go away claire wants to know if a license or id is expired but they have a receipt to update is that acceptable by receipt if you mean the camera card the answer is no but and this is reasonably new information uh penndot has just announced that they are extending issued driver's licenses and penndot issued photo ids that expire or expired between march 16th and august 31st and they are good now until august 31st meaning that uh if something's already expired as long as the notarization is not after august 31st you can accept it for the purposes of identifying somebody for a notarization now there are some details that you want to uh be aware of including how you record that in your journal i would highly recommend uh looking at our frequently asked questions document which is under file uh question number 12 gives you everything you need to know awesome i'll take um elaine and rose elaine asked a private question she just said how can i see the presentation again since i got kicked off a couple times so the video that was in the presentation um it's about a five minute video and it's going to be uploaded to youtube about noon today so um you will be able to go back and watch that as many times as you like and you will also receive a replay from pan of this whole presentation along with the q and a's that we're answering right now um five hours after we shut down so usually around like 4 p.m you'll get a replay from pan as well and then rose asked um i recently retired i did not charge fees at work if i notarized from home do i need to open a special bank account for fees my notary address is my home address i don't expect to notarize much rose um you're not required to charge fees if you do plan on charging fees when you start notarizing from home um you don't need to open up a bank account but you would need to make sure you're keeping track of what you're charging your customer make sure they're getting an itemized receipt but you need to keep track on your end uh for tax purposes um that's something we really can't go into much that's not our expertise what pan recommends is contacting a uh a licensed tax uh tax consultant pretty good idea are you gonna look at kimberly or does that mean uh that's you i'll do kimberly and laura then awesome uh kimberly just has a comment about uh pan having the attachable notary statements on in our member portal under pan forms that is very true thank you kimberly and laura says i have an mv-44 which is a penndot motor vehicle form that she needs to notarize but the document itself was emailed uh to uh by the officers for the owners to sign and notarize as long as the people that are signing and having their their signatures notarized are in front of you it does not matter whether the document itself is a copy the original facts not faxed all right um i'll take erica and caitlyn erica asks piggybacking off judy's question is there any instance where a document doesn't require notarization or should i notarize add language if asked to notarize a document erica that's not our call as the notary um what needs to be notarized what does that's your customer's decision if your customer comes to you with a document and they want it notarized um and there's no notary wording on it your customer needs to let you know what note react they want um if they can't decide you would refuse um they can go talk to a attorney they can maybe decipher for them what they would like but we can't shoot so it's really not our call whether it needs it or not if the customer wants it we would add it for them what i would recommend doing erica is a couple weeks ago we had a webinar on recognizing notary wording but also what you do for your customer when there's no notary wording that one is a really good watch um check it out if you haven't done so already because i think it's going to explain a lot of scenarios that you might be coming into and then caitlyn asked what is the pa title notarization considered what type um so it was known as the old affidavit now it's known as a verification on oath or affirmation the language on the title reads sworn to and subscribe before me so if you have a pan journal that's known as the number two a verification on oath or affirmation i'm back here doing my boy band motions right there you go all right i'm gonna take a look at questions from claire and danielle claire asked can you be a notary in two different states the answer is yes as long as you follow the requirements for becoming a notary in each of those states danielle where is the location the exams are being held daniel i can't really specifically tell you what we recommend is that when it's time for you to take your exam through pearson view that you sign on to their website and create an account and then when you use the drop down the drop down will only show you locations where the exams are being held so again there's a q a out there under our blog also in our frequently asked questions document and it gives you the link to get to the pearson view page all right so i'll take laura and claudia here laura asked does the commonwealth of pennsylvania in the county need to be on every document that is notarized i'm going to tell you yes there is one instance where it doesn't and that's if you are dealing with motor vehicle transactions if you're working with penndot titles or secure forms for example just pretty much penn dot forms that's going to be submitted for title work or registration they do not want to see venues on their documents um i know it's really breaking what we've always told you but if you don't do penn dot work yes you want it on every single document that you're notarizing that's a requirement um claudia says am i allowed to notarize paperwork for my brother um sure you could claudia um just make sure you don't have a direct or a financial interest in the particular document you shouldn't be gaining anything out of it um as long as you don't have any interest uh you could all right and mark uh aaronson our president privately reminded us the states that allow notaries to marry people are maine south carolina florida and nevada i think we had most of those all right i'm going to take a look at carol's question i didn't read it yet so bear with me if i started out as a notary in philadelphia and then transferred to montgomery county what recorder of deeds would i turn my registers into when i stopped my notary commission it would be the one that you most recently uh held an office of record in so if you started in philadelphia but moved to montgomery you did you did the address change you are you have a montgomery county office of record when you retire when you resign everything goes to montgomery county all right uh question came in who would we need to talk to to make ron permanent for example should we should we reach out to our state rep yeah that's not i mean if you have you know an interest in that that is somebody you could reach out to i know um there was a bill brian you might remember as i say it's a bill was what written up or i don't know if it was on the governor's desk or where it was at for for consideration i don't want to tell you i'll tell you the truth um i know there's been legislation floating around i i pay attention but i don't really concern myself with bill unless it's actually happened right um nick maybe that is a question that you would want to email our president mark aronson if he could so kindly maybe throw his email address in here um he would be able to give you more of a concrete answer on that em notary.org if a customer asked which notary act they want and it's not the actual correct notary act that they choose we still use the act that they ask for um again you making a decision about what's correct and what's not correct it's not your call to make if there isn't no rewarding on the document you've asked them what they wanted they've made a choice doing what they want is not wrong we still recommend that that in the journal over in the remarks section that you disclaim that there was not notary wording on the document and that it was the customer that chose verification on oath or affirmation acknowledgement whatever it was that they chose all right so susan asked why is signing the journal no longer required i renewed my notary recently noticed that the new journal no longer had a signature block it used to be required so you could compare it to the id presented susan so a signature has actually to best my knowledge not been required in pennsylvania um as you know for your register or your journal now that we call it um it's uh it's permitted if you want to add that to the remarks section a lot of times people will have their customer sign the remarks section what i see a lot of a lot of times what happens notaries by journals from other companies for example the national notary association they make a journal that could be in compliance with all 50 states and there are some states out there that require the notary to get their signature of their customer but that's not a requirement in pennsylvania nor has it ever been if you want them to sign though you definitely can have them sign the remarks section nothing wrong with that all right uh tina says now that my county is in green can i notarize in person i have a prepared answer for that all businesses may be open some with capacity limitations but must follow the covet 19 guidance for businesses so the answer is yes you may offer in-person services in green face counties i am actually going to paste the link for those guidelines into the chat box also this same link is available on our frequently asked questions it's also available on our helpful links document all right so i'll take marion and helen uh marianne says not sure if you got to this yet but what is the date that remote motorization will end in delaware county uh we did touch on that marianne earlier but a quick answer i'm gonna give you because we talked about it a couple times here um the authorization for ron will expire 60 helen says why were the documents names changed from affidavit and acknowledgement these were so simple and easy to identify i wish i could give you an answer helen um remember we don't notarize base off the title of a document we also just we're just looking for our notary language so the old affidavit is now known as a verification on oath and the acknowledgement did not change the actual name of the act but the notary statement has changed and actually simplified it it used to be a big paragraph that you had to worry about about five or six sentences now they shrunk it down to one sentence where it says this record was acknowledged before me on a date by your customers so in that instance i think they actually did just over time you'll get comfortable with it and i think it's gonna make your life a lot easier i mean the easiest way to say it is the law changed and the law calls the act something different so i mean blame it on the legislators if you want to but um it took me a long time to get used to it yeah still yeah exactly uh let's see christina are these webinars posted on the pan site or could you email them i was unable to attend the last presentation on july 16th uh we do have i believe the past three topics out there on our youtube page uh the youtube page link is in our our uh helpful links documents you can go there and you can find that particular webinar it may not be the actual date that you want but there will be one out there for the topic that you're looking for we typically will pick the uh the the version of that webinar that had the most and maybe the best questions so kathleen asked uh don't you need special authorization to notarize auto documents like penndot forms so you need a contract through penndot to able to acquire the secure forms that you need but technically under the notary law you are allowed to notarize anything that's required notarization with that said myself i know brian will back me up on this pan as as a whole we highly highly recommend you do not notarize penndot documents unless you are a penndot agent for example titles um one tiny mistake on the title can deface it it will cost your customer money to get a new one the deal could potentially fall through and then they're going to be upset with you and they're going to come after you um even if you would notarize a title for your customer they still need to go to a penndot agent to fill out the rest of the paperwork and send it into penndot that's something you cannot do so it's safe safest just to have a authorized penndot agent handle the penndot paperwork all right so i'm going to take margaret's question but i'm going to acknowledge mark put his email address out there for the person who had questions directly related to legislation nick was thanking us for an answer margaret's question can i as a mother notarize a paper for my son and if so what kind can i do i'm going to tell you what the law says margaret and unfortunately you're going to need to make the decision for yourself the law says that you as a notary may not notarize if you the notary or your spouse has a direct or a financial interest in the document and or the transaction so it doesn't mention your son specifically but just because it's not your spouse it's not you specifically if you have an interest in what your son is doing either directly or financially i would recommend not doing it now making the decision uh whether you have an interest or not that is up to you all right i'll take patty and cheryl lynn uh patty asked uh the company that i had worked at prior to covid may be holding i believe that their address may be associated with any mailings i may receive regarding my notary how do i check on that patty um especially if you're a member i highly recommend contacting our customer service team they can look into that for you because um you want to make sure that you do file an address change if that was considered your office or reco d um you have 30 days to file an address change when you move from one location to another and then also for our records we can make sure we have the correct email for you um your mailing so you're not missing anything from us so definitely give customer service a call um and they can walk you through the process there patty and then um cheryl lynn asked i'm not aware of this uh ron remote online notarization is this something i could be doing while working from home where could i find information on this and or a webinar sorry design dumb um i didn't know about this uh please don't apologize that's what we're here for that's what we're making sure everybody's educated on things like this we do this for a living um what i would recommend you do cheryl lynn is check out our youtube page it is under the files tab um it'll be a link right to our youtube page and there are two videos in particular that you should check out there's going to be a video that talks about electronic notarization versus remote online notarization because that's going to give you the details of what it is how to be set up as electronic notary and then how to apply and get set up as a remote online notary and then there is a video talks about how to do a remote online notarization so there's two videos i would recommend checking out but let me just tell you this though cheryl lynn there are fees associated with becoming a remote online notary you're going to need to go through an approved vendor and get set up with their technology and there are fees associated with this so that's something you would definitely want to look into before diving into it i would that's what i would recommend nick says would you recommend listing our remote online notarizations in our regular journal and simply writing ron record number blank um two-part answer nick if your vendor of uh remote notarization the platform that you're using does not have an electronic journal then you would be required to record your remote online notarizations in your regular journal the way the law reads though you are allowed to have a separate journal for paper it says tangible actually and electronic notarizations which would translate also to ron bless you john good thing from you good thing for mute right yeah here we go i'm not a good sneezer i know that probably sounds funny i sneeze myself into a headache i sneeze hard that's because you don't let it go you have to let it go oh man okay i'll finish answering next question though because the law says you can have two journals uh if your vendor does offer an electronic journal there is no reason for you to write those electronic or wrong notarizations in your paper journal so it's a decision you'll need to make on your own uh if the vendor does offer that electronic journal it's not necessary you could do you could write them in your paper journal if you wanted to though wouldn't be wrong awesome so erica had a comment and then uh marianne is the date the emergency declaration expired um so mary ann there's not a date in place so ron uh doesn't go away until the uh declaration let me read it off so it says how long will remote online notarization be permitted in pa that's the question it's a generic question we typically get and ron has been temporary temporarily authorized for all pa notaries and the authorization is going to expire 60 days after the termination of the covet 19 emergency declaration issued by governor wolf so governor wolf has not terminated that coveted 19 emergency declaration he hasn't went away with it when he does on that date 60 days after that date that's when ron goes away so hopefully i'm clarifying that a little bit i think the biggest confusion for most people john and i understand the confusion is they equate expiration of the emergency declaration with a county or their county going into green phase they're two different things they're two different things absolutely let's see um janet wants to add loan signing agent to her notary commission do i have to take courses actually janet there are no special courses that you are required to take to be certified because there is no certification although there are companies out there paying is not one of them that offers uh courses on being a signing agent there are companies that have bought into what it is they're offering and are requiring their signing agents to go through some type of course it's actually something you'll need to research on your own i would recommend looking at companies that hire signing agents independent signing agents and see what it is that they require you to do and follow their lead all right so claire asked uh so it's the venue and the notary wording that needs to be on every document notarized and that's it uh claire so what you're responsible to do is you demand personal appearance of the customer your id and then properly and when you review that document you're scanning it over for your venue your notary statement and you also want to make sure that there are no blanks left in the customers portion where once you do notarize it they they could fill it in later potentially so make sure there's no blanks left either the customer needs to fill it in or you would need to have them lined through an initial to blanks if there's no information going in there but yeah you're responsible to make sure the correct notary statements on there then you're going to fill in the venue you're going to fill in the statement then you're going to watch your customer sign or confirm their signature you're going to sign it you're going to stamp it and make your journal entry in a nutshell that's start to finish going to make a good notarization andrew would like us to explain the difference between a verification on oath or affirmation which is listed as a number two in our journal and an oath or affirmation which is listed as a number five in our journal i've had this question before and it is kind of confusing um let me start off by by telling you what is the same whether you're notarizing or looking at a verification on author affirmation or an oath or affirmation you're doing something the same you are administering an oath or affirmation out loud to the customer and they are answering you affirmatively now let's start with a number five which is the oath or affirmation that is typically a verbal exchange between the notary and the client it might be used uh by a court reporter when swearing somebody in prior to their testimony i mean you've seen all the tv shows do you swear to tell the truth the whole truth and nothing but the truth so help you god they answer yes you're done that's an oath or affirmation also uh maybe you're called upon to swear somebody into office like the new chief of police or five new school board members you would probably read off of a script the what you're supposed to say and the person taking that oath would agree to do a good job in their office again you're not stamping you're not signing they're not signing it's a verbal exchange big difference with a verification on oath or affirmation is now you have a document whether it be paper or electronic uh and typically what's happening is the person who's signing is swearing or affirming that whatever's in that document that's true so that is the big difference one is verbal one is paper it includes signatures and stamps i hope that is the answer you were looking for andrew all right andrea asks i have a co-worker who asked me to notarize a form to get her driver's license um she said she's applying for a new camera card since she lost hers and the form needs me to witness her signing the form am i able to do this for her andrea you can um you can notarize that for her um with penn dot forms typically they don't want to see venues on their documents always keep that in mind if it is being sent off to penndot um but yeah as long as it has a correct notary statement on that form you could go ahead and notarize that for them no issues there okay i'm going to look at erica's question and kathleen's question again we're looking at 12 minutes until 12 right now so we're coming to the end of our time together so we're going to get through as many questions as we can i don't think there are that many more in here somebody wants to know what a loan signing agent is very quickly a loan signing agent is typically somebody who is a notary uh who takes paperwork to a borrower's home when they are taking out a mortgage and they witness the signing dating initially of those documents and in some cases they actually do notarize some of those documents so that's the quick once over kathleen says quick clarification i also have my notary listed under my work address i am now working from home and probably will be until january or later should i change my address to my home address during this time if you're not going to be changing employers kathleen i don't really see a reason to do that typically the department of state isn't going to mail anything to you when you're in the middle of a commission the only time they really mail you things would be at the beginning or at the ending of the commission now they're using email anyway you might want to change your mail your send to address with pan if you're a pan member but again if you're not changing employers i don't see any need for you to change your office of record from work to home all right so dawn asked um did you say that it's okay to have your customer to have your signer confirm that she signed it on the document versus actually watching them sign it don um depends on the notary act so verification on oath and witnessing or testing a signature those two acts the customer needs to sign it in front of you no way around it it says signed in front of me that's what this one in the statement it says it that the customer actually signed it in front of you now this is a common misconception amongst notaries i think this is something we'll be covering in the upcoming weeks with an acknowledgement an acknowledgement can either be signed in front of you by the customer or they can confirm that they signed in front of you what you do as the notary is you authenticate their signature because an acknowledgement nowhere in that notary statement does it says does it say the customer signed it in front of you what it says is this record was acknowledged before me that is the only act where your customer does not need to sign it in front of you they still need to show up in front of you the notary you still need to demand personal appearance of them but you either watch them sign it or you confirm their signature by just asking them is that your signature um yeah that surprises a lot of notaries and elaine's question really kind of dovetails right into dawn's question i work our managers also drop things on our desk to be notarized i know their signatures and i take a copy of their current license and keep it on file so do i still have to have them standing in front of me and signing in front of me i'm going to tell you right now that section 306 of the notary law which is pennsylvania title 57 states that personal appearance is required anytime the customer is signing something or the customer is making a statement so the answer to your question is yes they have to appear in front of you every time bottom line uh and again it's inconvenient for them but your job unfortunately is not to convenience them your job is to to do things properly andrew just made the comment he said yes that explanation helped him with between the verification on oath and the author affirmation so awesome jobs there um barb says i feel like i'm beating a dead horse but i have an e notary already is there more i need to do to become a remote online notary sorry i'm confused no please don't apologize barb there is more that you need to do if you want to start doing remote online notarizations you need to be need to go through an approved vendor because you need certain technology in order to do this with your customer and there are going to be some fees involved with that what i suggest you do barb is go to the link section or the files tab um in here and click on the helpful links because it'll take you to our youtube page where it's going to talk about the differences between electronic versus remote and in that video it's very detailed on the steps that you're going to need to become a remote online notary and then the next video how to do a remote online notarization is going to show you actually how to do it if you have any more questions after that barb please don't hesitate to shoot us comfortable doing this uh you are right not to feel comfortable bar because um the only person who should be writing in a journal is that notary and also just to be specific not to cast aspersions on that other person they should be making their entry at the time they notarize they shouldn't be behind it may be difficult to do that but you need to keep up you notarize you enter you notarize you enter uh never never never never never never never write in another notaries journal yeah that's what i was going to piggyback i mean the when you're doing that notary act everything needs to be done contemporaneously the law of states so that means you're placing that stamp and signature don before the customer leaves you should be making that journal entry to keep everything in chronological and separate order that's the purpose of it so you don't miss anything you just wanted to use the word contemporaneously didn't you i knew you did in the law in the law that's it i love that word uh carol comes in she says what type of notarial act would i use when asked to notarize a vehicle title this is something we talked about a little bit earlier earlier um so it was known as an affidavit the term sworn to and subscribe before me is on a title that's now known as a verification on oath or affirmation there is same act that just really changed the language to run slightly but it's known as a verification on oath so if you have a pan journal it's known as a number two and just in general you're not even talking about a title but any document you're doing what the notary statement tells you to do let's see we have one more question that came in i thought i was going to say we were caught up almost so document that says sign here before me is considered what if it just says sign before me and that's the only language that's on there that doesn't really mean anything but if it says signed and sworn or sworn and signed then that is a verification on oath or affirmation i would recommend watching one of our prior webinars on recognizing notary wording it does a pretty good job of helping you to see what the wording should look like and determining from that wording what you should be doing yeah because mainly you're going to see three acts on the document i'd say probably 95 of the time you're going to work with one of the main two which is a verification on oath or an acknowledgement there is a new one called witnessing or testing a signature which as time goes on you'll start seeing more and more i'm assuming um but yeah just go through that like brian recommended the webinar it says recognize note rewarding um because that's a good one we touch on those three uh so we got a whole bunch of things crystal made a comment so she makes her entry first and there's nothing wrong with making the entry beforehand or making it as you go so that when the documents finish d they don't run out the door i just played safe crystal i mean as long as you're comfortable doing that but if you would make it first and then you don't do the notarization um then you would need to put a single line through and um maybe make a note in there why you did what you did that's the only thing i don't know whateverization didn't go off yeah yeah so we have some bunch of thank yous we do have another three minutes before we need to close the room um alyssa says so anything that is that has to do with penndot should not have a venue or note rewarding on it what i'm going to tell you alyssa is pretty much anything that's regarding title work registration work if it comes off of penndot's website um a lot of their motor vehicle forms they either it's like known as a mv form it could say a dl form those forms leave venues off of yeah so it's not going to be there what we're saying is don't add it there you go yeah they don't want to see it i mean in the future does that mean we'll never see a motor vehicle or driver's license form that doesn't have a venue that's not what we're saying we're saying if it's not there don't add it because it will send them into oblivion lots of thank yous and it's just about that time for us to uh take our leave so we'll give it another uh 30 seconds or so for questions to to come in uh but once it is noon we're going to sign off what a great way you're welcome yeah as i say it was a very good session a lot of different style questions uh roxanne says i have i have to notarize documents that are dated in the future is that acceptable what date do i use in my journal the date i notarized or the date of the document roxanne you should not be notarizing documents that are dated for the future that document i always say doesn't exist yet if it's dated for the future and the dot and the only date you put in your journal is the date of the notarization i mean you used to put date of document but that doesn't exist anymore alyssa says and this includes no notary wording um i don't know what that was pretend i think it was because she asked the pen dog question about the venue she's asking do i when i when there's no notary wording do we not add a venue i think maybe that's what she's saying yeah because the dog the penndot if it needs notarized the penndot form it's going to have the notary statement on there but it comes to the venue it's not going to be on there and then you wouldn't want to add that hopefully a pennsylvania title and you are notarizing that pennsylvania title it is not an acknowledgement it is a verification on oath or affirmation they are swearing or affirming that the information they're providing in the spaces on that document that that information is true not an acknowledgement um that is a penndot transaction yes and no pennsylvania titles do not have a venue if that's what you're asking and highly suggest not notarizing penndot related forms um especially title especially um the triplicate forms that are required to send into penndot you should not be touching those um it's we recommend unless you are very comfortable with the uh what's required in the procedures of those forms because there are things that are required um which are different than what we teach you in our
