this is a quick lesson on the florida statutes the florida statutes are the rules and laws promulgated by the florida legislature and then they are put into a compilation sometimes is referred to as a code but we call the florida statutes the florida statutes occasionally code um real quick though I need to give you the warning see this cute little guy his name is Max he is my dog in this picture he is asleep but he's just very sensitive to all kinds of noises so sometimes he'll hear something or binky here's something and he starts barking really loud and shrill and I just warning you that we might hear something like that happen because I'm just not that good of a pet parent Max and I we we wrote the book on unconditional love I just put up with what poor max doles out sometimes alright so moving on the florida statutes will have a lot of laws of obviously and one of the areas that is commonly found in the statutes are rules and laws regarding business organizations and so i want to show you how to find them and also of course how to or how to find statues when you are in a statute book but i also want you to see how they're organized so i'm going to quickly show you that but first we're in an online course and students are asked to find online sources of law in other words a source of law such as the statutes found online we would need to take some precautions to ensure that you are actually finding the florida statutes that are reliable because there is so much out there on the internet that you can stumble on to unreliable sources and that's not good under any circumstances and certainly not when you're trying to describe the law alright so the qualities of reliable of a reliable online source is what the first accuracy is the web page that you found authored by a person who's qualified to write it is it a lawyer writing about the law who is this lawyer is this any lawyer or is it someone who is an expert in that area of law that's important so who wrote the page and can you contact this person what is the purpose of the document or or the website that you are looking at and why was it produced is the person in there qualify that wrote it qualified to write the document as I already noted so there is also a distinction between the author of the document and the webmaster many organizations have webmasters they care for the website they give it all it's tender loving care and do that kind of thing but the author is often someone different from that person the next quality of a reliable sources authority does the site show who the author is who publishes the site extensions on the website like edu referencing that it's published by a school are an educational academia of some sort gov govt that would of course be dance published by the government so you want to be sure you check the domain of the site and make sure that you know what institution is public has published the document and are the qualifications of the publisher listed some things are just a self apparent like government websites whether you trust the government or not government govt and they're giving information it tends to be accurate that's as far as I'll go with that objectivity is another quality what goals and objectives does the site try to meet one of the big things is is it masked is it a masked advertisement you know sometimes what blogs for example many times the lawyers will start a blog on their website and they'll take care of it and they could be considered experts in the field but they're not objective necessarily because they're probably looking for business from the public while their information may be accurate it the goals of that site is advertisement and so be very careful about using that type of information and calling a reliable source the information obviously might be biased I view any web pages you would an infomercial so you're watching television and all of a sudden and something comes on and it looks like it's news but then really you start to see that you know call now on the bottom right hand corner you realize that you are not necessarily looking at an unbiased television show the same is true with the internet current or we also call this currency not currency as in money I wish they would hand me money but the websites out there don't do that this is critical is the information current the law must be current to be useful to you look at the websites properties at the bottom of the page and see if it's been updated recently it's dated 2012 and it's 2014 you may not have current information in front of you and the law is constantly changing thus it is really important to make sure that your website is current coverage coverage means what what is in these what if you go to a website simply put if you go to a website and you evaluate the links are the themes the same in the links if you go to a shopping website coupons I'm a coupon clipper I go to a coupon site and I'm going to find advertisements of products there as much as I'm going to find coupons so as as a result the kind of thing you need to be careful of if you see other advertisements there because it could just be a nice advertising site and not really something that's meant to covered cover accurate information also sometimes there's a little catch to downloading I'll do internet searches and all of a sudden I see this the name of a document and the title is so beautiful it's exactly what it's searching for word i'm so happy and then i realized i have to in order to access more than the first page or two of that document that i thought i had a great link to I really need to subscribe or download software to open it so it's really critical as well so those are the keys to the simple down and dirty keys to evaluating web pages the idea is that you have reliable information and that you are using great care in finding what you need all right so one of your assignments is to complete an online worksheet type of thing where you are asked to find the florida statutes and you are asked to locate within the florida statutes that you found online some laws that describe business and how to set up certain types of business now i'm not looking for a long answer to these questions in fact Mark Twain wrote if I had more time I would have written less those are powerful words that you should keep in mind when you're writing because it's easier to understand and you will become more valued as a writer in your organization if you can learn to drill things down sometimes you have to start large and write a lot in order to understand the little so I do that a lot i'm just that's my biggest weaknesses i write a lot and then I start having to strip away a lot of the information that I've written about that's how I try to understand things it's okay if you do that but your final products should be short and concise all right enough about that digression getting started using a web search I want you to notice this page has a simple search I went to Google I searched florida statutes and bam this is what I found perfect now what's important here I have Florida Statutes plenty of links i can look to but take a look at what I found look we have ww le diste FL us statutes that might be a reliable source it looks from the web link that it could be because wow it's written by the Florida Legislature hmm pretty important since the legislature is the governmental unit that's actually writing down the statutes all right there promulgating the laws they're putting them in writing here we have a look 2014 florida statutes the Florida Senate this could be ideal the idea is when you make do your search or conduct your search look at what comes up on the list and know that sometimes its advertisements sometimes it is absolutely dead on what you're looking for in other words this is important in making sure your site is your information is reliable once you open that page all right so assuming that i find it had a reliable source and i decide that i'm in a place of information on the internet that i feel i can value and have written because it's reliable i want to show you how the florida statutes are organized on the official site that i tend to use and you will find this is the organization of the statutes anyway so these these principles are exactly that i'm going to explain real quick are exactly how the statutes are organized in the books even so even if i walked over to a set of statutes and opened up a book i would see this type of organization the statutes are first organized by title title means it is a large subject matter area title let's pick one that makes sense i don't have to explain much title 12 municipalities that means that title 12 is a body of law regarding the nasa tality if you look farther to the right you'll see it says CH period 165 185 this notation is saying to you that chapters 165 through 185 are about municipalities and just so happens to be in title 12 now I like to tell students to look at these this list of titles like you would look at your text book if you were looking for the answer to a quiz question if you went to the front cover of your textbook and moved a couple of pages past the front cover you would see a table of contents tada the table of contents gives you specific information about or i should say general information a title of each chapter so that you can begin to understand what is in that chapter so you turn to that chapter and start reading and wow not amazing it says exactly what the table of contents told me it would say so that is very essential to legal research being able to recognize that quality of almost all research materials all right I'm going to turn to the next slide which is a continuation of this list so we're going to pick up on the next title the one that appears after ports and harbors it just fits better two slides all right so Motor Vehicles comes along vessels aviation again all of these make sense they are these titles are reflecting a large body of law and within each title are chapters and wouldn't you know it I'm looking at this and I see while business organizations that could be valuable and it's in chapter 6 05 623 so title 36 that's what it is title 36 but we honestly we don't we're talking about the law and statutes we do not talk about the chap the title we refer to things in terms of chapters we'd say chapter 6 05 chapter 6 23 all right so let's look and see what happens when I open this title when I hope when I click on that link and open it tada I have now all of the chapters 6052 623 I'm still finding I'm in the same place where I started it's just expanded this list and showing me now the chapters chapter 6 05 floor to revise limited liability company act chapter 6 06 business coordination chapter 6 07 notice this one has three parts their various reasons the legislature does that but you know just know that this is a drill-down of this information okay parte Florida business corporation act drills down even further into three parts and the same is true for public affairs and exposition so that you didn't even think about the fact that we might have statutes on that on maybe you did again these chapters and there these are actually called captions their titles to a chapter I don't like to use the word title because it confuses people that I'm talking about the title they are named also in other words you continue to do your research by saying hmm what am I really looking for just as though you were looking in the content of a textbook alright let's expand one of these see you check my notes and see which one I decided to expand ok I'm going to expand the the chapter 6 10 cable and video services alright let's do that here it is capable and video services now look again it's broken down once again into smaller pieces and parts these are the most narrow focus and these are the statutes themselves in other words you have a book of statutes in front of you the book of statutes organized by titles and by chapters but each chapter drills down even more to distill the more minut concepts covered in that chapter department of state authority to issue state white cable statewide cable and video trade franchise definitions state authorization to provide cable or video service eligibility for state issued franchise franchise fees prohibited again this is one way to beat that was one way to begin your research or drill down your research and I accidentally click the button so I'm on the next slide you'll be glad because then I won't keep talking about it you get it now i just opened the stat i just clicked on from that list that i just had on the previous page i clicked on the statute and by the way statute is not statue it's statute and do everything you can to make yourself say it and spell it correctly I statute six dot 103 has definitions remember on that previous slide it showed us it was going to be about definitions we could predict that we were going to run into definitions look at this this is great the wonderful thing is statutes that have definitions tells us what a cable services it tells us what a subscriber interaction I'm sorry what a cable service provider is what a cable system is Wow so we've already been able to learn a lot about Verizon and Comcast all those folks all right now let me briefly explain something that's hard to explain uh-huh and I hope I can do it well there is a as you can see statute 610 dot 103 has a subsection 1 and then you see this a and this be and then you see subsection 2 and 3 and a B let me make some sense of this this is these are organized sort of like an outline and in higher in a hierarchy so 610 dot 103 sub 1 all right but if I'm looking at this statute I'm at 610 dot 103 sub 1 a in other words again it is just like an outline these can get very very unwieldy it can it can drive you nuts sometimes especially because the online version unlike the printed copies and the classrooms and libraries they don't use any indentations so you literally have to map out your hierarchy and pretty much memorized it because some of them will have sub 1 a 1 and sub 1 a 1 2 in another numeric style it's it's it's crazy I picked an easy one to help you out here but this is this is how we know I am looking at cable service what it means I would probably want to refer to sub 1 a I might be sub 1 a and B or sub 1 a and C but as soon as you get past the first hierarchy of the i should say the second hierarchy of lettering you you have to use commas if you're writing down the statute between them so this is separate from this but I would not need to cite it as if I were writing a list with of these I would not need to call this 610 dot 1031 a and then repeat it 16 dot 1031 be I could put 6 10 dot 1031 a and use a dash sign and say one a dash B so the reader knows i am referring to 1a so you can't commingle subsections that's as far as I'm going to take that work with it do your best I'll correct you as needed okay don't don't sweat the small stuff because that's why I'm here to help you improve okay next last cite your source always always always in this class cite your source or sources it's so critical and it's also critical that you know how to cite it now I have some paralegal students I notice on the roster and they are used to a different type of citation style I'm going to recommend to my paralegal students that if you use the style that we normally use in law I'm okay with that just do it right now but in business the APA citation style is what is typically used APA stands for American Psychological Association I know you're not psychologist but you know business people might as well be organizational courage that's all I can say so APA citation style is what I'm expecting the business students to use in this class so in in text that means i am writing a sentence about a statute and of course i want to tell the reader what I'm writing about i can't just say the law provides that we run around the block three times before we whistle and stomp our feet we would say florida statutes section and i would give the number and the subsections if there are any and the year of the statutes i'm reading it's what is going on right here in green provide provides that you should you must run around the block three times and whistle efore stomping your feet whatever I just said if you you can't just say this is the law you got to tell the reader in your writing if you need to most writings you'll need to say this is where I found this information and I'm going to hang my hat on exactly what it is I'm telling you the truth and that's really critical in all of your writing just like your English comp classes nothing changes in the law alright so the in tech ok so let's make sure we added this to 4 2014 here but the APA citation the difference between this type of in-text and this type of in-text citation is one is I finish a sentence and i want to add the citation or the reference note of where i found it so this would be at the end of the sentence and then of course would have a period at the end of the sentence so it carry we go here here this type of in-text citation it's part of the wording in a sentence you right in other words you're not inserting the statute at the end of the sentence to give it what we call a parenthetical reference here instead you are using the in-text citation like my earlier example pursuant to I'm just going to pretend I'm writing a sentence out of this pursuant to Florida Statutes comma section 6 10 1031 a 2014 all all dogs go to heaven period okay the so that's four in text citation Styles there are two types that are really important to your writing one is telling the reader as you're writing where you got that information that you're writing about and then finally a reference list would be at the end of writing but if you're writing a letter in this class or a couple of assignments where you'll do that you would just attach a blank page that has the reference list for me that's for my purposes you don't send letters with those but i want to see reference list from you so that i can help you with your improve your citation if you were writing a powerpoint presentation you would write the powerpoint presentation you may use in-text citations in your PowerPoint but you would also make sure that your last slide has an APA reference list and this is the APA reference style for florida statutes so it starts out Florida Statute so you can see the entire statute citation followed by a period space and then I say retrieved from you don't need to put the date and notice the i added retrieved from florida senate website I don't use at a lot of people do that but it's basically incorrect and you don't need to include the date either in APA APA is the vaguest form of citation I've ever used in my life but that is what it is and i copied simply copied and pasted the site eight or the URL address into the reference item here and notice also this is not appearing as a hyperlink if you know how to renew it will probably when you copy and paste it from a URL or just type it your software will probably turn that web URL address into a hyperlink you should remove that hyperlink and also notice there's not a period at the end so that the person who is reading your research or your paper can copy and paste it into the into their browser and those periods at the end can cause problems and in other words take a person to a page that doesn't exist just a couple little tricks also notice this is a hanging indent the first line of text is along the margin and then you indent everything after that first line of text is indented half an inch that is a function of your word processor you need to set your paragraph formatting for these references to have a hanging and you need help with that let me know okay um one more thing and I'm just about there two more things next where do you get some help well first of all in the course in the legal writing and plagiarism folder that I have set up in the resources here are some help items one of them is if you are using section symbols in your citation which APA does not require you would need to know how to insert those and those those this is a section simple crazy little two little s is stacked up on top of each other you don't use these in APA writing all the time but sometimes you might finally need to but that tutorial is in here here's an introduction this is what I call the cheat sheet but it really should have been trying to change my language on that and call it the reference guide so it's a little bit of help for you it literally even shows you how to cite our textbook and these statutes in the correct format and then here is a web page APA style citing legal materials it's a reliable source I made sure of it before I gave it to my students to use as a source alright this is a list of items in this folder of our course to help you with your citation on the last item I want to cover and that's when you other help and of course you can ask me for help I'm here for that that's why I'm instructing the course but there are three links that are available from our se of library of course and the librarians are in our College are outstanding I've worked with them for a long long time and I have myself had to rely on them so many times to help me with what we call in academia information literacy and citation and finding appropriate sources and and those sorts of tools are excellent for asking the librarians for help on they are fantastic and they know what they're doing they're trained for that subject guides and tutorials are available on the library website 24-7 and also there is ask a librarian and that would not always necessarily mean get an SCF librarian but librarian will help you with live chat text an email and these resources are there to help you improve and persist and be awesome students like you are okay so I will stop there I will
