good morning everyone let me just do a check and make sure everybody can hear me okay this is governor doug burgum good morning governor yes we can hear you just fine okay super well grateful to everybody who took time to dial in this morning and i want to welcome you all to the hospitality erg conference call let me also give some gratitude to the team that's worked so hard to make these grants possible starting with sean kessel and the entire team at the north dakota commerce department and also the great work from the bank of north dakota president eric hardmeyer kelvin hewlett and the rest of the team over there and then north dakota hospitality association executive director rudy martinson thank you rudy for helping to pull together this call and thanks for everybody that's uh on the call today uh i don't need to tell this group of people how challenging the pandemic has been because certainly it's hit every sector of our economy from oil and gas with the collapsed complete collapse and destruction of demand last year to all the strains that are on health care all the challenges that we've had in agriculture for both pandemic and weather related uh but the hospitality industry uh across the world and across our country and across north dakota certainly has been on the uh the front lines of people who've been extremely challenged by this last spring as the the threat of the pandemic was emerging we asked a lot of you last spring to help slow the spread and we know that now as cases continue to climb to you know tremendously higher levels than even we were at last spring we're now asking everybody again to do their part and we appreciate that particularly as in north dakota we've got a hospital capacity issue and uh hospitalizations continue to climb and uh and then of course uh the last in september october we made it through the first five months in great shape but the number of people who passed away uh with covet in september and october again we want to continue to make sure we're fighting to take care of every individual and make sure they've got the care that they need we know that the sacrifices that you're making and your team members are making are are super challenging i mean as a small business owner in my life and know how hard it is to be trying to manage uh your business model your employees and your challenges as you go forward and again that's why we've been at the state of north dakota working uh and at the federal level also last spring with the ppp program uh which i hope all of you participated in uh but we also uh you know that there's you know an incredible sacrifice but also incredible uh incredible relief that's been given during this time team as well and here today we want to talk about those programs and make sure that everybody is aware of what of the grants that we have available from the commerce department and the interest buy down grants we have available from the bank of north dakota there's a group called the emergency commission which i have the honor of sharing it's made up of six individuals and i want to thank my fellow members secretary al jaeger and then our legislative leaders rich wardner and chet pollard and the appropriations chairs from the house and the senate representatives delzer and holm and senator holmberg respectively they're the group that approves the cares act dollars that's then go to the legislative budget section which has approved these grants and again directly following the passage of the the cares act at the federal level last year north dakota began acting quickly to distribute the money to the industries and areas where the state needed it most and there's 1.25 million of corona virus relief funds that came in this particular bucket for the states to allocate and because of our strong success in the first six months in fighting the pandemic we were able to allocate uh the majority of those dollars for economic support 29 went to economic support for individuals and that includes the record dollars that we put into the supporting the north dakota unemployment trust and of course by doing that that helps keeps rates down for businesses across the state going forward so no rate increases there but a record amount of relief provided there hundreds of millions of dollars paid out through that program 27 million dollars on economic support for businesses 28 for public health and safety and 16 of that went for continuation of government but through the work of the bank of of north dakota uh which we're so pleased to have as a as a tool in the fight here in the in north dakota and the department of commerce we've allocated 369 million dollars to support individuals and employers again through the unemployment insurance trust fund we've also allocated 100 million dollars to the bank of north dakota for what are called the covet pace recovery or the cpr loans in cpr2 and nearly 100 million dollars to commerce for the erg and the hospitality erg programs and we're here to talk about that uh recently uh congress was approved by the emergency commission for the remaining uh 25 million dollars of erg funds plus an additional 29 million for the hospitality erg funds and which will support businesses like yours if you're in the food service business whether you've got a drinking establishment whether you're an entertainment venue or a production company that supports uh entertainment at those venues those are all organizations that qualify uh underneath uh the hospitality erg and of course our our hotel businesses also fall into that as well we encourage you to take advantage of this relief it's there to support your businesses through this extremely challenging time and as you might know yesterday afternoon we removed we moved the remaining counties uh in north dakota that were under the moderate or yellow risk of our north dakota smart guidelines into the high risk or the orange level and again we know this puts strains because those guidelines include 25 percent occupancy uh recommended for businesses it's recommended that the businesses require masks for their team members as well as public that may be visiting their establishments and we ask that businesses do all they can to help lead during this pandemic and again the key thing on occupancy is is just common sense we're trying to achieve fewer transmissional moments so use trans use your common sense because we're trying to keep uh people that aren't already family groups uh or in their own group uh from interacting with others in a distance of less than six feet when they're unmasked again also for these grants you can take a look we know that some of the activities that were that could occur safely such as outdoor dining with uh groups of folks uh in the summer uh that the risk of transmission and we're seeing this rates as the transmission cases go up across the united states particularly in the northern regions we know this is partly because we've moved inside and and in areas of where there's ventilation so even having an opportunity to get fresh air open windows do all those things can help you and your you and your team and going forward and also we want to say again just to understand the exponential nature of how this highly contagious disease works it took us seven months uh or over 200 days to get to 5 000 cases uh in 20 days we went from 5 000 cases to almost 11 000 cases so we're in that point of the curve now where the growth and transmission is really occurring and that's why as we head towards thanksgiving it's important in the next couple weeks uh that we take measures mitigation measures to help slow the spread uh so that we don't literally run out of hospital capacity in north dakota and it's not just for cobit cases it's also for we've got uh over 80 percent of our hospital capacity right now is being used for non-coveted but those are important things whether that's heart disease or cancer or trauma or somebody you know falls and breaks their hip i mean we they're all the reasons we need our hospitals uh at any particular time and also it's heading into flu season and last year uh we had hundreds of deaths and hundreds of hospitalizations related to flu and so again encourage you and everybody that works for you also to get your flu shots because by getting your flu shots you can help reduce the strain uh this winter on uh hospital capacity this is not something we're gonna have to do forever because we have an opportunity we see that we saw the the positive market reaction yesterday was just one of the five companies that's moving forward through phase three clinical trials for vaccines uh but it's possible that we could in q1 start to have effective vaccines that could help dramatically reduce the mortality of this and of course that will take a lot of pressure off the economic side of things and so again very uh encouraged and very supportive of the administration's warp speed project where they put tens of billions of dollars into accelerating uh the the work related to vaccines so will these uh recommended mitigation numbers mitigation measures again we we which we appreciate that your businesses are following uh you know these are are painful in the moment uh but they do play an important role in helping save lives and livelihoods and we're going to have these mitigations in place only long enough to help bend the curve in the right direction and reduce the strain on our hospital system and we won't be doing it a day longer we're trying to in north dakota we've taken a very balanced approach with a light touch of government compared to many other places uh this requires that we rely on individual responsibility and community responsibility to try to slow the spread and you're an important part of those communities so again it's with great gratitude that we thank you for everything you're doing thank you for protecting your team members thanks for protecting your customers thanks for uh being in the fight as we try to slow the spread of this contagious disease and again thank you for your critical role in our state's economy and thanks for your resilience and perseverance through this unprecedented situation uh and lastly while we can't speculate on on what may or may not come out of washington d.c in these uncertain times but i my best guess is that they're given the rising cases that we're seeing now in over 40 states across the nation and certainly we're in the middle of a covet storm here in north dakota because from the great lakes from illinois and wisconsin uh which have got record numbers of cases all the way through to wyoming idaho utah colorado we're seeing rising cases across all those in north dakota while our positivity rate is in the mid teens for percent positive on test rates we've got neighboring states that are in the thirty percent forty percent fifty percent uh rate in terms of number of people tested coming back positive uh that would be overwhelming for us so again many of you already have done great work uh because in the middle of this coveted storm north dakota is faring well uh relative to the the region and so again thank you for all the work that you've done thank you for the many of you that have been following the north dakota smart uh restart guidelines uh since they were issued this summer uh thanks for being innovative on your business models and moving towards more curbside and takeout uh thanks for and again thanks for just taking care of your communities and your customers uh your your your livelihoods are important to us we're in this fighting together and again thank you for being on the call and i'm going to turn it over to the team at commerce and bnd uh and again best wishes to all of you and and happy thanksgiving and hope that you and all your loved ones are healthy and safe thank you governor i want morning once again and thank you sean good morning once again and and thank you all for joining us today my name is sean kessler and i'm the north dakota interim commissioner of commerce on behalf of the north dakota department of commerce in partnership with the greater north dakota chamber the north dakota hospitality association and the bank of north dakota we all welcome you to our special business briefing to provide guidance on the application process business eligibility and expense eligibility for the hospitality economic resiliency grant for those of you listening please share this information about the hospitality economic resiliency grant to anyone who's unable to join today a recording of this call will have information available excuse me along with information materials is second special business briefing on tuesday november 17 at 10 a.m and we will address questions received and announce the exact date and time commerce will begin accepting applications for the hospitality erg you may hear that referred to as the herd throughout this presentation today is all about the hospitality erg we'll begin with an overview of what brought us to this point and detail on who and how you can apply we will hear from our partners and we will answer your questions the hospitality economic resiliency grant is a federally funded business support grant federal dollars were provided to each state to use where they saw the greatest need in response to the coven pandemic the hospitality erg is intended to support main street businesses across north dakota the hospitality industry continues to be the hardest hit by the pandemic with the agreement from the emergency commission which is chaired by governor burgum and the north dakota legislative leadership commerce has been entrusted to distribute almost 54 million dollars to help restaurants cafes bars breweries theaters and professional production companies that remain viable open and serving customers i would like to welcome rudy martinson with the north dakota hospitality association who will share the impacts felt by his industry the purpose of the non-profit north dakota hospitality association is to advocate protect and promote the restaurant beverage hotel and other hospitality industries in our state this industry has seen an immense economic impact due to the pandemic and we are proud to have their executive director here with us to support the hospitality erg i will follow with information about how this grant can be used and then we'll go into more detail on how and when to make the applications we'll also hear today from calvin hollat to talk about the covet 19 pro recovery programs at the bank of north dakota kelvin is the market manager for economic development finance and government programs at the bank of north dakota the bank works closely with the department of commerce on large-scale economic development projects and supports the bank's efforts to provide effective economic development and finance programs to wrap up our briefing today we will hear closing remarks from matt gardner and the greater north dakota chamber i would also like to take an opportunity now to thank the greater north dakota chamber for all their support of these special briefings this year we've been they have been an integral partner to reach out to small and large businesses and their immense support is greatly appreciated so with that i would like to welcome rudy to make a few comments welcome rudy thank you sean you're welcome so good morning again everyone and thank you i want to start by thanking the the department of commerce and the greater north dakota chamber for for hosting uh this call today to talk about uh the assistance that's coming for the hospitality industry uh from the federal and state government and i would also like to thank the department of commerce the emergency commission and the budget section all of our state leadership in both the executive and legislative branch for recognizing uh the need to provide some additional help for the ho pitality industry in north dakota um i've been specifically asked to talk about some of some of the impacts that led us to this moment in the hospitality industry due to the cover 19 pandemic and i think it we all we all feel instinctually but there are some numbers behind it that that the travel industry the hospitality industry which is on the front line of the tourism industry obviously are some of the hardest impacted by um by the coming 19 pandemic including uh you know required closures or restrictions or adaptations in in how we do business um disproportionately impacted by that and have put many of our 3 000 plus hospitality businesses in the state of north dakota in danger of of closing frankly um the the pandemic nationwide has resulted in an estimated 434 billion dollars in losses for the u.s travel industry total shortfall in restaurants and food service sales in the united states top 200 billion dollars during the first seven months of the pandemic and in north dakota specifically the impact of loss visitation visitor spending due to the pandemic is now estimated a total 994 million dollars in economic impact so um which includes 77 million dollars in state and local tax revenue lost due to decreased visitations and and those of you in the northern tier of the state who rely on uh canadian travel have felt the impact of that border being closed which the the the the estimate of the specific impact of that is 400 000 fewer passenger trips resulting in the north dakota so um i'm not here to completely be doom and gloom about it obviously that's just kind of a snapshot of how the the industry in our state has been impacted in a very real way and on the front lines of this particular this particular pandemic and the resulting economic situation that that is happening because of it um again want to express gratitude and thankfulness that that the state and the federal government have recognized that through some earlier grants uh as a result of the cares act and federal aid are continuing to recognize that uh during during this newer round of economic resiliency grants and want to again thank the the administration and the department of commerce and legislative leadership for recognizing that need and the details of this program uh sean is going to lay out for you now so i will turn it back over to him thank you rudy you're welcome so due to the continuing need of assistance that rudy just laid out the hospitality erg will focus on hospitality businesses including restaurants bars breweries cafes and similar on-site dining establishments in addition to those business categories mentioned the grant will also focus on businesses affected by previously mandated closures such as movie drama and music theaters and facilities used to host community and private events and professional production companies that support major venue meetings and events i'd like to make a couple comments specifically regarding the support for restaurant that this grant provides if you live in a mid-sized or large urban center in north dakota you have multiple options to choose from when you want to go grab a bite to eat in many of our smaller north dakota towns that is simply not the case in fact the local restaurant may be the only remaining place residents can obtain food grocery stores are struggling in small towns many have closed so the importance of the restaurant in towns without a grocery store is more magnified the restaurant is more than a place to grab a bite to eat it's the social hub of a community where coffee clutches occur in addition the restaurant may be the only food option for seniors and they may provide meals for meals on wheels programs or other like programs i had a conversation with josh aspig for those who don't know josh he's the state director for aarp about this very topic and he made this comment to me meals programs are designed to help older adults maintain independence and avoid isolation they are a necessary service to ensure older adults can stay safe and independent in the communities they call home so not only do small town restaurants provide an option for seniors they provide needed employment can be a source of revenue for a town if the town has a local option sales tax they can be a destination center for tourists haven't we all traveled to another community to go to that particular restaurant restaurants are oftentimes considered an essential component to potential residents choosing to live in a community restaurants are more than restaurants especially in small towns they are essential service providers they are community development and in small towns they are economic development well thank you for that indulgence the hospitality erg funds will be used to reimburse reimburse receipts to eligible entities for costs and operations such as payroll rent utilities technologies and other expenses that comply with the federal guidelines we will not be able to provide reimbursement for items that receive grant funding from the initial economic resiliency grant or other federal cares funded programs such as the payroll protection act known as the ppp the economic injury disaster loans oftentimes referred to as idle or bank of north dakota cares funding programs or any taxes associated with these operational costs eligible applicants who submit proper receipts and documentation may receive up to twenty five thousand dollars and entities with multiple locations may receive up to seventy five thousand dollars with a maximum of twenty five thousand dollars allowed per location so just to be clear if an applicant applies for and is awarded sixty five thousand dollars that means that two sites can receive twenty five thousand dollars apiece and that the third site can receive fifteen thousand dollars no single site can receive more than twenty five thousand dollars additionally in order to receive hospitality erg funds grant recipients are required to comply with the north dakota smart restart protocols applications are expected to open later this month please attend the november 17 special business briefing at 10 am and we will announce the exact date and time that the grant will open these grants will be considered on a first come first served basis funding will be approved if the application meets all the criteria and funding remains available additional information will be available at ndresponse.gov the grant team must be a licensed restaurant to include food services and drinking establishments that derive a minimum of 51 percent of their sales from prepared food food trucks are also eligible and they must derive a minimum of 51 percent of their sales from prepared food and 75 of their income needs to come from north dakota sales a bar lounge or brewery with a current has to have a current on sale liquor license issued by the appropriate legal authority an entertainment venue to include movie drama and music theaters and facilities used to host community and private events professional production company that provides technology and audio visual audio visual services to meetings and events those are all eligible entities let's cover now that we've covered the eligibility um i'd like to make a few comments about who is not eligible to receive these grants government owned events venues that do not generate more than 51 percent of total revenue from rentals or ticketing from private events retail food groceries or gas stations who do not derive a minimum of 51 percent of their total sales from prepared food religious or faith-based organizations and hotels that do not have a qualifying restaurant or event space applicants must self-certify that they meet the requirements and will comply with current north dakota smart restart protocols non-compliance with smart restart protocols will result in the repayment of all grant funds the approved grant funds will be distributed if the proper receipts and or documentation for operating expenses are submitted with the grant application acceptable applicants include any entity whose business is physically located in north dakota they certified that they were financially viable prior to the covet 19 pandemic including operational and workforce needs they certify that they have a negative financial impact by the covet 19 pandemic the business must be in good standing with the north dakota secretary of state or the appropriate tribal business licensing authority if required they must be licensed and inspected by the north dakota or tribal business authority they must submit receipts for eligible operational costs incurred between march 27 2020 and the date of the grant submittal i'm going to repeat that because i've had a lot of questions about that date you must submit receipts for eligible costs incurred between march 27 2020 and the date of the grant submittal applicants will self-certify that these criteria will be met as they are responsible and they will be the responsible applicant to ensure that they meet these criteria so we've covered grant amount but i'm going to mention it again because it's important as mentioned in an earlier slide 25 000 is the maximum grant per eligible entity and 75 000 is the maximum for eligible entities with multiple locations if any entity receives grant funds for more than one location they cannot spend more than 25 000 per location we know ownership structures vary widely and the cap of twenty five thousand dollars for a max of three locations or seventy five thousand applies when the majority owners are all the same grantees will be chosen on a first come first serve basis among all recipients who have self-certified that they are complying with the current north dakota smart restart protocols and properly compute completed the application when commerce opens the application window now if additional information is required applicants will have 24 hours or 10 business hours if the request is submitted prior to a weekend or holiday to submit documentation this is a one-time request and no appeals will be considered please be prepared to receive emails from commerce in the initial erg round emails were sent by commerce were missed on occasion because they were directed to a file not normally reviewed so please check your settings and the files you don't review daily in case our emails land there eligible expenses must have been incurred on or after march 27th and no later than the date of the application now let's move on to some required documentation applicants are responsible for providing sufficient documentation for all costs justification for why these items are eligible and proof of payment documents must be clear legible and unaltered hand-written documents are not allowed they must show a detailed description of each expense they must clearly identify how and when the costs were incurred again between march 27th and the date of the application the applicant is responsible for indicating which cost category and expense falls into a receipt showing proof of payment and all expenses provided must be clearly tied to the north dakota physical business location if multiple items are on a receipt it must clearly highlight or mark which items are being claimed for reimbursement and you're limited limit the upload to one receipt per line item on the application just a quick comment about fraud for companies suspected of or engaging in fraud the department of commerce in consultation with its assigned legal counsel will review the evidence and determine whether to forward the information to the appropriate law enforcement entity for investigation i'd like to turn over the call to uh calvin holid kelvin is the market manager for economic development for finance and government programs at the bank of north dakota he works closely with the department of commerce on large scale economic development projects and supports the bank's efforts to provide effective economic development finance programs calvin thank you for joining us today sean good morning thank you very much for giving us some time to talk about our programs this morning you're welcome so i'm going to talk about um two of our programs this morning in particular our cpr one and cpr2 loan uh our programs which stands for coveted pace recovery program so on the next slide as you will see um i want to i want to talk first about the covet pace recovery 2 program and that may seem a little backwards to talk about the second program before the first but i want to make sure that we cover this effectively for you because this is a grant program as has been noted by everyone from the governor ford we understand that businesses were really impacted by the covid pandemic and also understand that while some businesses were able to take on additional debt to help get them through this time period there's also the need to help businesses with some grant money as well and so covet pace recovery 2 is actually the second cpr program but this is actually a program that provides a grant and what we have asked businesses to do um is look at their interest accrued from april 1st to september 30th of 2020 and and that's the um the amount that we're looking at um providing to businesses for reimbursement up to 50 000 so just to walk through the eligibility as you can see the business must have a physical location in north dakota been current on financial obligations as of march 13th and then our um our metric is sustaining a minimum 20 year-over-year gross revenue for their north dakota-based operations when we compare april 1st to september 30th of 2019 to that same period in 2020 so we're looking at the year-over-year loss and then if the 20 threshold is reached um then there's the ability to provide reimbursement for the interest recruit from april 1st to september 30th of 2020. so as you can see on the on the interest expense one of the things that we want to emphasize is that it is for interest on all business debt so that could be term debt uh if there was utilization of credit cards during this time period for business expenses that's eligible um if you were paying a lease on a vehicle i had a conversation with um a company that is a caterer and you know they have interest expense on the delivery vehicle that would be eligible so all business related expense is eligible to be qualified into this program and as you can also see the proceeds may not be used for owner or shareholder debt or for related entity debt so in our our funding amounts the maximum amount amount is 50 000 of that time period incurred and again these funds do not need to be repaid um the bank of north dakota has has been noted by others um has worked closely with the administration the emergency commission and budget section and so for coveted base recovery 2 we've been allocated 70 million dollars for this program to provide reimbursements as of today we have 608 applications in for about 16 million dollars so we have a lot of capacity in this program and we know the hospitality industry has been really impacted so we're really hoping that folks will look at this program get an application in and take advantage of this program so um so that is the covid pastry recovery program too uh what i would say um also is that our deadline for applications on covet pace recovery 2 is november 30th and as opposed to being a first come first serve program uh what we are doing with covet to pace recovery 2 um is actually taking all of the applications up through november 30th and then um at the after the close of the the program application period on the 30th we're actually going to rank all of the applications from highest loss um to lowest loss and then this pay down the line uh hopefully um coming close to or exhausting the 70 million dollars that we've been allocated so if we can go to the next slide um i just want to walk through an example of of how we're asking folks to calculate their their um capability in this program so as you can see you know step one is to look at your gross revenue in 2019 uh for the time period of um you know that april 1 to september 30th and in this case it was you know 180 000 in gross revenue um step two was to look at what was the gross revenue in 2019 and then look at what your revenue change is for that period in this instance an example that we created it was 70 000 which resulted in you know about a 39 change in gross revenue so in this example um you know we had interest expense of thirty thousand dollars and so that is the amount um that the company would be eligible to apply for um to the cpr2 program so if we can go to the next slide i want to just touch briefly um also on our covet paste recovery program 1 or cpr1 and on the next slide i'm going to give you a few um sort of overviews of of this program and the difference between cpr1 and cpr2 as i noted cpr2 is a grant program those funds that are provided on the buy down of your interest or interest reimbursement do not have to be repaid covet pace recovery one is actually a loan program as you can see we have created this program for businesses in north dakota can be used to support those operations in the state of north dakota and um have the capacity to show at conservancy debt you know before march 13th of 2020. as you can see proceeds can be used to support working capital um term out um copa 19 um bridge loans or paid credit card debt um and that amount may not exceed 20 but we we really created the cpr one program to be a loan program to provide debt capacity to our businesses across the state and on the next slide and what you'll see is some of the details of what's available in this program so we broke it out for businesses with 500 or less employees the maximum loan amount is 5 million or 6 months of operating expenses plus interest if the business is over 500 employees then the maximum loan is 10 million or six months of operating expenses plus interest and here's what is unique about the cpr one program as you know banking of north dakota provides a buy a number of buy down programs to and in cooperation with communities across the state in our in our pace programs so cdpr1 really emulates in many ways what we do with our pace programs in that bank of north dakota utilizing the karazhak funding is actually buying the rate down on the loan for a period of time so as you can see the interest rate is fixed at 375 for up to five years and then we have worked with our lead
