By Act dated _______ ___ , _____ , passed before _____________ , Notary Public, Settlors established the __________________ , a charitable trust (the “Trust”), contributing thereto the sum of _________________ and ___ /100 ($ _____ ) Dollars cash. A copy of the __________________ is attached hereto and made a part hereof. II. The __________________ is a charitable trust governed by the provisions of La. R.S. 9:2271-2337 and is exempt from federal income tax pursuant to section 501(c) (3) of the United States Internal Revenue Code. III. Since the execution of the Trust, Settlors have determined to limit the charities to which it will make distributions, to charities which benefit the residents of the State of Louisiana, favoring residents of the Parish of _____________ and surrounding parishes and to make some minor changes which will facilitate the operation of the Trust. IV. As a result of this change in circumstances contemplated by Settlors at the time of creation of the trust, Settlors desire that the Trust be modified so as to limit its purpose to make distributions to tax-exempt charities which benefit residents of the State of Louisiana. V. This Court has jurisdiction and authority pursuant to La. R.S. 9:2332 to order a modification of the Trust, because if the Trust continued in its present form, it would substantially defeat and impair the purposes of Settlors to benefit, through contributions to charities, citizens of the State of Louisiana. VI. Neither _____________ Bank nor _____________ , Petitioners herein, have any objection to this modification. WHEREFORE, following the publication of notices required by La.
