How valid is a PDF document that I signed on my computer (image of my signature) vs my actual signature on the printed document?
Although every state has passed laws that involve e-signatures, under the federal ESIGN Act, your electronic signature on a .pdf is just as valid as your physical signature. The ESIGN Act provides that a contract or signature “may not be denied legal effect, validity, or enforceability solely because it is in electronic form.” This simple statement means that electronic signatures and records are just as good as their paper equivalents, and therefore subject to the same legal scrutiny of authenticity and burden of proof standards that apply to paper documents. So unless your signature was forged, given under duress, or you refused to sign via electronic means (or there's some other reason to invalidate the contract), the executed .pdf copy may be enforced against you.

What are the necessary components of a digital signature? Does there have to be a 3rd party?
What is Digital Signature?A digital signature is basically a way to ensure that an electronic document (e-mail, spreadsheet, text file, etc.) is authentic. Authentic means that you know who created the document and you know that it has not been altered in any way since that person created it.Digital signatures rely on certain types of encryption to ensure authentication. Encryption is the process of taking all the data that one computer is sending to another and encoding it into a form that only the other computer will be able to decode. Authentication is the process of verifying that infor...

Are there any alternative easier/free ways for electronic signatures for documents?
In an era when most of our documents, driving directions, and Groupons can get pulled up on our smartphones, most of us no longer own printers or scanners. Forthrightly, we don't miss these space-sucking products – that is, until we get an email asking us to return a document with our signature. Short of going to and paying for the services at a Kinkos, or waiting till you're back in the office, you may think you are out of luck. Fortunately, there are several electronic signature apps you can use to sign documents electronically. Most companies may let you sign using a secure digital signature, but this is a different realm altogether. What is a signatureA signature is simply someone demonstrating their intent to approve something—it could even be a written "X" instead of a sign. The e signature solutions hold a similar legal weight as physical ones on paper. You can also email your client a contract document. You can also write in the email, "If you agree to the attached contract, reply in an email confirming your approval." Their emailed positive response will count as a legal approval equal in weight to a signature in the court of law. Same thing for PDF form documents that they write their name into, save, and email back to you."Signing something using your computer is much more convenient than validation a hard copy.Alternatives to electronic signatureRegrettably, the whole world is not as tech-savvy as you, and there may be certain people or businesses that don't know how to use the electronic signature service. There are commercial operations which will record your data, then print an electronic marker on a document to confirm your identity. There are of course tick boxes for less essential documents. If there is any question of identity raised, a court will decide if a contract has gotten correctly executed and if the form of execution was adequate. Also, there may be stipulations in legislation as to how the particular document must be signed using the electronic signature software. You don't even need a third-party application.

What are the best electronic signature (e-signature) services?
Sometimes we really don’t understand what we mean under “best”, even this question doesn’t elaborate what the best service means? Which criteria the author believes the service fits the best? price?best design? Reliability?Let’s better talk about “suitable” for this moment and current needs. As the previous answers mentioned, do you need the service to be available on all major platforms or a signature that will stand up in court?Do you need a free simple solution, a feature-rich service that charges on the amount of signatures/documents signed or on monthly basis?Do you need to work with your documents on the go with low or no internet connection (while travelling, in the airport or plane)? And you can ask yourself with tons of such questions to create a matrix of features-service to choose the one you need. Or you can use 3rd party platforms like Alternativeto to initially select the provider you are interested in.When we conducted a closed beta testing for signNow recently, one of the goals was to understand the main criterias SMB owners from US use to choose a solution or switch to another one.We interviewed more than 230 businesses and what’s interesting, while the top factor goes to Security&data privacy, price or for example, digital signature availability is not in Top-3 of choices. Speed of an app/solution and multiplatform availability (works in web browser as well as on Mac, iPhone/iPad, Android and Windows devices) are what values higher. So, if there is a need to sign/send documents on Mac, iphone/ipad, android, windows and web browser and to work with documents offline, signNow is alternative to go with. We are still in beta, implementing some major requests from our beta users, but will be launching this September. And, signNow is free while in beta.

If school curriculums no longer teach cursive writing, how will kids be able to sign their name in the future?
Lots of great answers already, mostly focused around the current state of technology and the mistaken impression that signatures have to be in “cursive” to be valid. But there are two other issues with this question. First is that it’s based on a hypothetical situation that doesn’t exist and isn’t likely to in the near future. Over 70% of elementary teachers in a recent survey still taught cursive as part of their regular lessons, which makes this one of the most commonly taught topics in our schools. It’s not in the “Common Core” standards, the political hyperbole goes, but then again, those standards aim to address cognitive development rather than basic life skills. In addition, school boards being mostly elected officials and thus held to the sway of (often ill-informed) public opinion, the massive outcry over the imagined threat to our society from a nonexistent lack of teaching cursive is pushing more local and state ed departments to adopt or create standards in which cursive is a required skill. Yay, us!…because, you know, having something as a required skill means so much for mastery long-term (looking at you, Algebra II and Geometry)….In any event, I suspect we’ll continue seeing a resurgence in cursive teaching because politics is more important than logic in so many education policy discussions. But the second issue is, to me, the greater one. Replace cursive with driving with a stick shift or any other life skill, and you have a great conservative rant in general: “why aren’t the schools teaching ____”? What, the parents don’t have any responsibility to teach anything any more? I don’t know about your kids, but mine can drive a stick, change a tire, cook an egg, and write in cursive, and that’s absolutely out of any context with what they might or might not have learned in school.Parents, teach your dang kids. Not asking you to be the calculus teacher, by any means, but if your kid is missing a basic life skill, look in the mirror first before you visit a school board meeting. We can handle the cognitive development and speak all day long of fancy pedagogy topics, but if your kid can’t sign a document or flip a pancake, that ain’t our fault.

Is electronic signature legally binding in India?
Yes, e-signatures are legally valid in India. In fact, e-signatures have been recognized by the Indian law, with the passage of the Information Technology Act in year 2000.As per the IT Act, two types of signatures have the same legal status as handwritten signatures. These primarily include:(i) Digital Signatures: In this case, the signer is issued a long-term (1 to 2 year) certificate based digital ID stored on a USB token that can be used along with a personal PIN to sign a document.Note: Previously, the signer was issued a long-term (1 to 2 year) certificate based digital ID stored on a USB token that could be used along with a personal PIN to sign a document digitally. Now with Aadhaar, that complicated procedure isn’t required anymore. You can simply use signNow’s Aadhaar eSign to create a digital signature on the fly using your Aadhaar ID(ii) Electronic signatures: These electronic signatures combine Aadhaar identity number with an electronic Know-Your-Customer (eKYC) method (which includes sending an One-Time-Passcode to the mobile number linked to the Aadhaar card for verification)These Aadhaar based e-signatures and digital signatures are valid as long as they satisfy these conditions:(i) Electronic signatures must be uniquely linked to the person signing the document. (in the case of Aadhaar based signatures, they are linked by the unique Aadhaar ID)(ii) At the time if signing, the signatory must have control over the data used to generate the electronic signature (for eg: they should be able to directly affix the electronic signature to the document)(iii) There should be an audit trail of the steps taken during the signing the process(iv) In the case of digital signatures, signer certificates must be issued by signNowing Authority recognized by the Controller of signNowing Authorities appointed under the IT Act.Few of the exceptional cases in which documents cannot be signed electronically and must be executed using traditional handwritten signatures include:(i) Negotiable instruments such as a bill of exchange or a promissory note(ii) Powers of attorney(iii) Trust deeds(iv) Wills and any other testamentary disposition(v) Real-estate contracts such as leases or sales agreements. If you are looking to get legally compliant electronic signatures on contracts, invoices, quotes etc., try signNow, India’s first Aadhaar eSign solution that offers a complete fill-and-sign functionality with business workflows.
