good afternoon fellow Realtors friends members colleagues I'm Chuck ASCII CEO Maryland Realtors I'm here with Bill Castelli senior vice president of government affairs thanks for joining us today bill ostensibly the reason for today's meeting is to give you review and insights into the cares Act which is the two trillion dollar piece of legislation Congress recently passed that extended a lot of benefits financial benefits including unemployment and some loans the bill will go into detail on in a few minutes that have been expanded for example to incorporate tor to include independent contractors and there so there's a lot of good stuff in there for us as an industry and for you because we know right now on top of all the other questions that you have one of the biggest questions is how are you going to pay your bills how are we going to get through this and so bill will go in to greater detail we'll be taking questions staff is following this event they're feeding us questions through our online our team on Microsoft teams so bill and I are also seeing the questions that staff sends to us so thank you Dan and Michael Kathleen and others who are Susan whoever else is on thank you so much for that before I turn it over to bill and you will really do most of the talking here what we see that people don't see bill yeah so what are we working on that I guess there's a little bit of a technical glitch we're doing a zoom meeting publishing it through Facebook live so apparently there's an issue with that but our technical people will be working on that in the meantime let me just go over where we are no people have a lot of questions as do we by the way about what it is we are actually allowed to do in the real estate industry under the existing stay-at-home order and the subsequent advice from the office of legal counsel in the governor's office we do understand and we have following all of the channels that that you are and we're set we have the same information you have but we're not in agreement 100% on what all this means and we also have had some inconsistent guidance from the administration about what this means to us I'm saying they're not getting the feed is that true okay dan says we are watching it I'm on the new feed talking all right we're going to take a break we obviously are having some technical difficulties please stay tuned I'm not on Facebook so I'm only on zoom we were told to turn off our Facebook feeds so that there wouldn't be because there's a delay and we didn't want a feedback loop so I'm told I am and then bill will talk and then you'll see Bill and that's good you don't want to see us both anyway so that's probably okay so let me just take two more minutes I promise you no really here to here bill and get information on those programs but I think it's important we hear you we are trying not trying we are going to find the right balance and that balance is between the thing that of course matters and that's our ability to continue to make a living in this environment we understand that of course we do we are of you our leadership team works with you they are practicing Realtors and part of this economy and part of this industry and as staff we know how important this is your our members we work for you and and so that will always be our primary focus there's no question about that and we're your advocates and that is never going to change during this unprecedented pandemic we are also citizens of our communities in our state and our country and it's planet and we have balance we have to find a balance between our responsibilities to the planet and our fellow citizens and our ability to get through this continuing and economically to survive it's a very difficult calculus many many things are going into this equation the well-being of our members of course that's number one the well-being of our fellow citizens has to be an element of that equation the how we come out of this and our reputation as an industry also has to be part of that equation there are many variables here including our perception within our communities and I can tell you very honestly we are in communication with the governor's office we know what his spokesman said well we don't know his did he really understand all of the implications of what he said did he in fact for example mean that if we are allowed to show property is that the same as saying that those buyers we are taking ground are exempt from the stay at home order he didn't actually say that is that what he meant if so we need that to be made explicit by the governor's office if they meant something else and we have to find other ways to do business then we will get clarity on that and then we will put that information out to you and work as hard as we can with you to help you get through these times that's what we're here for and we know you want answers we want them as as much as you do but I just wanted to spend just these couple of minutes to explain our thinking all of the very very difficult decisions and balancing that we have to be what we have to make and the policymakers quite frankly have to make and tell you very very frankly again it's been noticed that citizens are calling and asking how is it that I'm stuck at home and Realtors are out there and my neighbor's house across the street is for sale and I look out and cars are driving up and people are getting out and going in that house how is it that they're allowed out and I'm not and that is a thing and and you've if you read the Washington Post article you know Realtors say hand sanitizer and elbow pumps and you know it's otherwise it's business as usual so all of these things are in this equation this very complicated equation made even more complicated by the fact that we have not gotten consistent information from the governor's office so we are seeking that they are working with us we will be in touch with them and by tomorrow we will have an answer that's a commitment I am making to you and to the extent it's in my control and some of it is that we will have an answer for you and and we will get that out of all of our communications channels but I just wanted people to understand it's not a simple binary choice there are many many factors that go into creating our position and that the administration have to consider in order to develop ultimately what its policy is going to be and guess what folks as you know by now no matter what we say tomorrow that could change next week if we don't flatten this curve they're just going to keep shooting down ratcheting down and ratcheting down until there is a true if they see a car on the street they'll stop it and make you go home and and if that's what it takes I'm convinced this governor will do that if that's what it takes to flatten this curve and get us on the other side of this the didn't it is that no matter what happens it's temporary we are going to get through this and we are going to go back to work probably not as usual because I think a lot of the tools that we have adopted we're going to continue to [Music] use I'm kind of liking zoom meetings I miss everybody but you know we can do some of this work from home I know about you but I'm pretty productive that at home so that's all I wanted to say I hope that makes we're going to be come out of this stronger than ever so that's all I have to say please let me know if you have any questions or comments and from with that I'll turn it over to Bill I thank you chuck and good afternoon everybody I'm gonna give a quick overview of some of the federal and state programs mostly the federal programs that are available the good news is that many of these programs are going to be available to independent contractors ie real estate licensees if you go up to our website MD realtor org and click on that co vid panel that's at the top of that front page you'll get to our Ovid page if you look on the right side at the top of that column of Link's is a document that's entitled federal and state kovat 19 Assistance Programs and for today's purposes that is going to be what I'm talking about those programs so I would encourage folks to go up to the website take a look at those programs and the main reason I want you to click on that document is because it has links to go for more information but also links to go to apply for some of these programs or to give you information about where to so as a general overview let me tell you what kind of assistance that the state and the federal government are putting online for those of you who are small business owners maybe you have an employee or two that the state has a couple of programs the state programs are not available at this point for independent contractors at self-employed there's a grant program and a loan program that we'll talk about in a little bit and then the federal program that were recently approved include not only payroll assistance helping you as an employer including if you're a head of a company and you have independent contractors as your workers to help you protect and pay for those individuals over an eight week period it also is targeted for you as an independent contractor so that you can apply for this through the small business it there will be a program on other kind of loan low-interest loan programs that you can get from the Small Business Administration including an upfront grant of $10,000 which is a grant and then there will be unemployment insurance that's been extended to real estate agents and by that I mean all independent contractor so typically an independent contractor would not be able to get unemployment insurance but you will be able to apply for that so let me quickly go through a couple of considerations before we get into the actual programs if you're an independent contractor and you're looking at trying to protect your income right now then the first program I would ask you to look at is the payroll protection program that was recently authorized by the federal government and independent contractors are going to be able to apply for that program as of April 10th there is a link on our document that you can click on that will take you to the SBA approved lenders list and that's how you would actually start the application program but that's what I would say is first take a look at that if you're an independent contractor those SBA programs are going to be argued it or at least available to you if you're a small business employer then you might want to take a look at not just the SBA programs which tend to be more generous but also the state programs and these programs are not exclusive so if you're taking a small business loan from the from Maryland fact that you have that loan or grant does not disqualify you from taking the SBA assistance and vice versa at an SBA loan you can still apply for the state assistance as well second thing I would ask you to look at is if you're not looking for payroll protection ie you know you are unemployed you're you are partially unemployed then there are a couple of options for you one is sick leave option which ends up for self-employed being a tax credit and then there will be unemployment insurance that you'll be able to apply for us so keep those things in mind but I'm going to start off first with the payroll protection freak and the payroll protection program is designed for businesses but it will also include nonprofit but it's a 501 C 3 non-profit many realtor organizations are 501 C 6 is an ER is actually looking to try to extend both programs to other nonprofits besides 501 C 3 so that these programs will be available and what would happen is you would apply to an SBA approved lender again that link is up on a document on our web click on that it will take you to a list of lenders what I would encourage you to do is jump in line quickly just to queue up with the lenders you will not be able to as a self file your application until April 10 next week there they're putting the application together and then actually the applications pretty much together they're just not accepting the applications from self-employed till April and this loan is designed for small businesses which are folks under 500 employees which or individuals like yourself and you are there to protect basically at least 75% of your income so if you could you if you apply for this loan you can get it for 8 weeks the time period that that it's set for is basically February 15th through June 30th and you can apply that payroll protection to any eight weeks during that period it's a flexible program that can apply to any of those any of those times so for example if you're an independent contractor you want to protect your payroll ieu your payment then you would apply for that and then you could potentially even apply for unemployment if you're out of work at the end of that payroll protection period eight weeks so what I would say is go up there get in line queue up do the application it's about a two page application with another two pages worth of disclosure it's not complicated but the great thing about this loan is it will protect up to 250% of what your pay roll is going to be during that eight week period or a month what your month period so it's supposed to cover you for eight weeks it'll include a role other fees that you pay with payroll including some rent as well as interest payments onward things like that now the great thing is that if you're able to maintain about 70% of your payroll including paying independent contractors ie real estate agents that and you do not reduce and force those number of employees this little loan is going to be forgivable you will not they have to pay back any of your principal or interest on this loan at the end of eight weeks as long as you not have not let anybody go I would say take a look at that as their first step talk to your brokers as well about it I'm sure they're they're familiar with it as well that's the first program the second program is called the economic injury disaster loan that is a loan that also has a $10,000 grant option now some people who have already applied for the $10,000 grant option because these economic injury disaster loans have been available for at least the last month if you apply for that idle loan you would still be able to apply for the payroll protection but if you got the upfront grant of $10,000 that will essentially go toward what you are able to get under the payroll protection so it will just reduce the amount of your payroll protection from the receipt but you can theoretically do both the payroll protection program loan from SBA as well as the idle loan from SBA the only thing I would say to you is you can't use it for the same purposes so if you're going to do a loan for payroll protection and you can actually use an idle the economic injury disaster loan for payroll protection - then you would not be able to use the payroll protection loan for payroll protection but but you would want to use the payroll protection loan program for that anyway because that's the program that is going to be forgivable the idle loan is not use payroll protection for payroll and then use an idle loan for other kinds of business expenses that you might have those are going to be low-interest loans up to 2 million and it's probably a maximum about 4% interest rate it will depend a little bit that's eligible for all small employers under 500 as well if you already have an SBA loan you apply for it earlier then the Kovach pandemic it there's an another program called the small business debt relief program that it's intended to help you actually pay for your entrance and your costs on that current law you'd be able to pay for that as well for an existing SBA loan you might have last thing I'm going to talk about in terms of the federal grow actually second to last thing I'm going to talk about on the federal programs is the endemic unemployment insurance as I've said before you know typically you would not be eligible as an independent contract or final point in charge you are under the legislation that was passed last week by Congress how this is going to work is we've got a link to the site at the Maryland Department of Labor you would go to the Department of Labor site you would enter and if you scroll down at the bottom of that link you will see a little box that is talking about self-employed independent contract it is asking for your email put yourself on that list put enter your email just and this is not signing you up it's just getting you information because their systems are not configured right now to accept an unemployment request from a self-employed so they have to change their systems around a little bit but once that has been done they're going to use that email list and let everybody know hey the program is up and running you can apply for unemployment insurance at that point but what I would say right now is just so that you're aware of that that that is a source a resource available to you go up to the site enter your email so that you'll get advice about that what is the unemployment terms going to look like it's going to be typically the 26 week coverage of lost wages it's capped in Maryland in fact the maximum that you can get in Maryland is about four hundred and thirty dollars but you will also be able to add a six hundred dollar amount to that for dollars for the first four months of that unemployment insurance that's an added bonus that the federal government is funding and then what they've done on the underlying amount which again is capped at four hundred thirty dollars is they've extended that past the twenty six week period which is normally what you would get for unemployment insurance and this extends out to 39 weeks so if you were able to if you're going to take advantage of it you apply for it you the first four months you'll get the four hundred thirty plus well assume you know depending on what your would pay you're replacing so up to four hundred and thirty plus the six hundred and six hundred dollars on top of that that would end at the end of July and then you would end up having the normal unemployment rates carry you through the rest of you and it's thought to end around December you'd be able to apply for that as well and the last thing I'm going to talk about on the federal programs are family medical and paid sick leave so normally these are again not programs that you'd necessarily be available for but there is going to be a tax credit option that a self-employed person is going to be able to take and this would apply and reduce all of your self-employment taxes so what would happen is it's not necessarily continuance of your pay which is how it would work for a typical employer employee situation it's going to be a refundable tax credit which means that it applies against all of your self-employed taxes that you're paying and if it exceeds the amount of taxes that you have you're getting better check back for the federal government well whatever that overage is during that time so if they attended and these these amounts are capped as well but it would be for if you're out of stay at home or you can't work or you're there's also a component for you if you're required to stay at home to take care of an individual or you have children that are home from school you're gonna be obviously having to stay home and take care of them because they can't go to school and you in and you don't have a care for them so that that assistance will be available to you as well it'll be really in the form of those tax credits and the last thing I'm going to talk about are the two programs at a state level there's a third one for manufacturers that I get included on the list first one is a relief loan front it's up to a $50,000 grant or not grant but loan at a maximum of two percent interest rate and that is to help you pay any kind of expense business expenses that you have girl ran payroll anything you use it pretty much for anything the first 12 months you're not gonna have to pay anything on it and then you pay it's a 36 year or 36 month loan after that and you would pay after that first year then you would start paying on the 36 month loan and there's going to be another $10,000 grant program that you would be able to get potential access to as well but these programs are really just for small employers who have an employee other than themselves so if you're self-employed you're really not going to be able to take advantage of those two state programs but if you are a self-employed or not a self-employed but a small business you've got an employee and you're looking at one of those loans I would say look at both the state loans because that you may be able to get a lower interest rate on the state loan compared to the SBA loan and you're not prohibited from applying for both so you know you might as well apply for both and again we have a link to those state programs as what so let's go to some of the questions [Music] and I I know one of the questions that we received earlier before it started was where we apply for assistance I think I answered that just go up to the webpage another person had heard about the ten thousand dollar program and had been encouraged to apply for it so you can either apply for if you're self-employed I would go and apply for it directly with either the economic injury disaster loan where you get a ten thousand dollar the first ten thousand dollars of that loan is grant so you don't have to pay back you can get it there where you can get a ten thousand dollar grant from the state as well if you're an actual employer with an actual employee and another person indicated they don't want a loan can I get unemployment insurance the answer is yes but not right now you're gonna have to wait a little bit for their system for them to upgrade their system so that it's self-employed folks um now point to some of the questions yes for unemployment insurance question was asked is it power $130 per week $600 and with the additional $600 per week yes that is a weekly amount that you would be eligible for so another question was payroll protection loan available for independent contractors with no contractors or staff and so we're still waiting for some direction on this but yes all the direction that we've received so far is if it's just you and you are your only staff person you will still be able to apply for the payroll but we're still waiting for some direction on SBA from that but it does appear that you will be able to try to protect effectively your own pay for that and we should get some of that direction we hope next week because they're opening up a role protection program as I said April 10 for your for the independent contractors does the forgivable loan program for payroll how if you're paying administrative staff that is 1099 yes so you they were protection will help you pay for your own independent contractors that you hire as well now the now if they're they're not going to be able to again it's the only limitation I would say that has been placed on it is and I don't think many of you would be in the situation a little protection loan is capped at a 10 million dollar cap so this is obviously for a bigger company over an eight week period with you know a large number of employees that would not be able to click more than ten million dollars it is also capped at an individual amount for a hundred thousand so let's say you add an employee or you yourself at an income of over a hundred thousand for the year and you were looking to protect that payroll they would cap it at a hundred thousand so you'd still be able to collect some up to whatever that weekly amount for that hundred thousand what if you're a new agent can you still apply there's some question about that because under the payroll protection program you theoretically had to be in business as of February 15th that was some of the initial guidance that was the hope is that we're going to get more clarity on that but well I've seen a couple of different things one that it's just available between February 15th but I've also seen some things stating that you had to actually be in business before bill yeah I mean just very briefly on that and this is not a different class or anything but if you have a personal assistant that you are paying on a 1099 I would be I would advise you to contact an attorney or your financial advisor your tax advisor that is because if that person is doing only administrative work under your control most likely that person should be a w-2 employee and not a 1099 employee and even if it's a licensed assistant when they do license work there's one way to pay on a 1099 versus unlicensed activity that has to be paid on it at w2 so for those of you watching who do have personal assistance please contact your tax advisor to make sure you are paying that person correctly under the worker classification laws yeah thank you God so we also had a question on independent contractors how will your losses be calculated in terms of the payroll loss so it looks like they're going to look back to other quarters which will likely mean they're going to look at your taxes that you filed in previous years to determine what your unquote average income was for those quarters in order to determine what that lost payroll amount is and that's going to be important they're gonna want that tax information in order to determine how much they're going to pay you but also to make sure that you are paying your employee or yourself the full amount for that payroll so that I mean the whole purpose of this program so that people aren't laid off and people can stay employed during this time and if you do lay off people during that time then the forgivable amount of that loan is going to be reduced so but yes if you it'll be calculated based on your previous tax returns and and then they'll give you that amount which is going to be closed as long as the Thunderer under thousand for that eight-week period do you have to pay into unemployment insurance for the unemployment insurance there's another question we received no you don't this is a special program that's set up and it will end as of December 31st and this year we hope if we're you know we expect to be through this god forbid we're not but we we so it will end at that point you will you will not have to already be participating in the unemployment insurance I will tell you that there is something sketchy at the state because they are concerned about running out of unemployment insurance so there those discussions are going to continue but that's the answer to that question an association that is not set up as a non-profit take advantage of these programs let's say possibly yeah if you're if you're depending on how you're organized you should be able to you know you've got employees you can take advantage of it as well do I know I know someone personally my wife works for a non-profit they've already put themselves in the queue for the program but yeah so I would I would explore that even if you're an association if Canadians apply for an employment if they still have settlements coming um so I would say you can apply for it but some of these questions on you know when is is when does it start how it triggers how they're going to determine whether you're unemployed or not are it's going to be future guidance essentially we're gonna we're gonna have to wait for some of those questions to the answer I would say that you know it is not unreasonable to think that the state will essentially say you know as long as you have that income coming in you're not eligible but at that point where that income starts that's when you would be that's when the clock would start ticket for your unemployment yeah and typical we're gonna have to wait for some there yeah but typically unemployment benefits would be adjusted down if you have income in a particular week after they ask you that it's been 50 years thank goodness since I've been on unemployment but they do ask you if you worked and then they count they recalculate your benefits so you're guaranteed a certain amount of week if you have an offset because you have income then it just gets offset and it's how it used to work I think that's how it still works but but I would expect there to be a very least an offset as opposed to a complete disqualification but again these things this is all new so some of the hasn't even been decided yet Villa and also one thing before we leave could be remnant as far as I heard some I so bring statistics the other day about the number the amount of money we're talking about as opposed let's say for tarp you know eight the number which which this Dwarfs that I think I don't remember how much you know it was not a trillion dollars it was hundreds of millions and the number of staffing available at SBA and at the state level and and and I I don't want to I don't want to mislead anybody into thinking that this is gonna be a quick or easy or painless process because to dole out this many hundreds of billions of dollars to millions upon millions of citizens into a infrastructure that is currently designed and staffed by people servicing a minut fraction of the number of people that are going to be affected I think we have to go in this with our eyes open to say this is going to be it not pretty and I don't see how they need a higher tens of thousands of people and train them and put this money out in a in a efficient way or even a fair way and I want to scare anybody but I also don't want to give people the false impression that this thing is just going to magically hold snap your fingers and and all of a sudden these these state and federal governmental agencies are going to have the capacity to deal with this stuff and in a quick and easy and efficient way cuz it's not I think they're gonna go and I think it's going to take time and you're going to need to get in line and be patient I don't know if you have any additional insight into that but yeah and I would just say two things and I think Chuck that's a great point to make which is there will be frustrations in terms of some of the application process but I will let you know that especially with the payroll protection program SBA approved lenders there's a list that you can link to they're also going to be using all of the banks credit unions all of these guys are essentially being deputized as probably not the right word but a lot of the they're going to be able to process a lot of the applications for the but at some point even if those guys are doing a lot of the work of processing the initial applications there would still be some back-end stuff at SBA as now they want to get this money out as quickly as possible so the turnaround times on a lot of the loans and grants are in some cases days not not months and and like a week or fourteen days so they're looking at trying to get some very tight windows as well now a couple more questions that come in one individual asked I pay unemployment insurance right now taxes how what's the likelihood of those premiums going up I would say it depends on ow bad the economy gets but yeah there's definitely a chance of that those premiums will go up I will say as far as the pandemic unemployment insurance and that's what they're calling the program that I talked about that is funded by the federal government so that is not going to be a hit against the state the federal government is going to be be paying for that the hit the state is going to have is just the normal unemployment insurance that they would be paying out so there will be a hit because we do anticipate that there will be more unemployment filed in the state so there is going to be that hit so it is it is going to be kind of good news bad news if you're paying those unemployment premiums if you work in Maryland but don't live in Maryland do you qualify not for the unemployment insurance but the SBA programs doesn't matter what state you're from so you can apply for those programs you might want to use an SBA you know it's up to you to decide what SBA local office you want to go through but the initial application process is all online so it really doesn't matter that much because whether you're applying at the Baltimore SBA office the DC or the Philly office they all direct you to the same online application [Music] some employers are reducing hours and pay therefore not laying off employees so I will tell you that yes they're looking at a payroll production program is to protect that payroll so even if it's a reduced amount they may be able to I mean the lone theoretical will be able to cover that lost income amount so that people get their full tell you will be able to loot use the program for that and again that turns into a grant if they keep those people employed at the end of this then that you know if you keep if you keep folks employed during that entire eight week that entire program the interest rates the underlying principle all forgiven at the end of that eight week period son of people are do we have to apply do we have to select a specific wonder for the payroll protection program yes you will you will see the list of lenders you have an option to choose someone off of that list I will tell you that if you have a local bank that you use your credit you need may want to check with them even if they're not on that list because they have been authorized to use these programs as well so it's if you don't see your local bank or credit union on that list you know just reach out to them and see if they're in process of applying for that too if you like using someone a particular lender now what does the lender have to do with the SBA loan the lender is going to be an important person in terms of the payroll protection program because ultimately that's going to be the face of the people you're dealing with so even when you're at the end of the eight-week period trying to demonstrate that yes you met the requirements under the program you kept people employed at nearly their
