today we're going to give you a compressed version of the important takeaways of sb91 there is a lot to take in but we put together the most important parts in an easy to digest video remember the contents of this video is not to be considered legal advice contact us for a consultation rental assistance program sb91 comes with 1.5 billion dollars in state funds to directly help tenants pay covert rental debt covered 19 rental debt is considered rent due between april 1st 2020 through march 31st 2021. these funds will be paid directly to the landlord here are the important points to consider about the program the landlord can receive up to 80 percent of unpaid rental debt in exchange for forgiving the remaining 20. if the landlord accepts he or she can never pursue the additional 20 in any fashion or evict the tenant for this debt the program gives top priority to households below the 50 percent area median income level second come communities who have been heavily impacted by coffee 19 and third will be the households below the eighty percent area made an income level if a landlord doesn't accept eighty percent the tenant can still apply for the funds and their twenty five percent of the rent owed will be covered landlords can attempt to recover the 75 through small claims as of august 1st 2021 we've included a link in the description of this video to learn more about how to apply and who qualifies for the rental debt relief program extensions ab-3088 applied extreme limits on a landlord's ability to evict tenants due to non-payment of rent from march 1st 2020 through january 31st 2021 sb 91 extends these protections through june 30th 2021. sb91 extends on ab1482 all rental properties are now temporarily protected and tenants can only be evicted for just costs as defined in ab1482 this now includes single-family homes new constructions and tenancies which have been in effect for less than one year must give tenants notice sb 91 requires landlords to provide new sb 91 information or disclosure before february 28 2021 to any tenant who has any outstanding rim balance as of march 1st 2020 this disclosure must be provided to tenants before a landlord can serve any new 15 day payer quit notices which have also been updated any ab-3088 disclosures or 15-day notices are no longer valid as of february 1st 2021 the new 15-day notice to payer quit sb 91 requires landlords to use an updated version of the ab3088 15 day notice to payer quick as of february 1st 2021 ab3088 15 day notice is no longer valid as of february 1st landlords cannot serve any new notices to tenants before serving them the sb 91 disclosure notice this notice is available from fast eviction service please contact us for more information tenant obligations tenants are still required to return a covered 19 financial hardship declaration and pay 25 of rent due for every month they don't pay full month's rent at least 25 percent of friends from september 1st 2020 through june 30th 2021 is due on june 30th 2021 landlords can continue to require verification of financial hardships to hire income tenants tenants have 15 days as of the date the landlord serves a 15 day notice to player quit to return a signed covet 19 financial hardship declaration if the declaration is not returned by the tenant within that time frame the landlord may be able to file for an eviction you can contact us for more information on how to proceed if the tenant fails to pay at least 25 of rent due for each month they fail to pay rent the landlord may file for an eviction as of july 1st 2021 landlord obligations landlords are not allowed to serve any new 15-day notices before they notify the tenants of sb 91 and its benefits landlords can also easily be dismissed in eviction court if the judge doesn't see a landlord's diligence to try to assist the tenant in obtaining the rental assistance sb91 offers landlords are not allowed to charge late fees or any fees stemming from non-payment of rent from rent out during march 1st 2020 through june 30th 2021 to tenants who have returned their signed declaration the money a 10 security deposit cannot be used to cover rental debt under sb 91 unless the tenant provides written consent to do so if a tenant makes an attempt to pay you rent it must be applied to prospective rent and cannot be applied to satisfied covert 19 rental debt in other words it should only be applied to rent as of september 1 2020 and it should be used to cover the 25 due on june 30th 2021 first small claims ab-3088 specified that any rental debt could be collected through small claims court as of march 1st 2021 this has now been delayed to august 1st 2021 if the tenant has paid their 25 percent of rent due on june 30th 2021 and has returned a sand declaration for every 15 day notice you serve them the 75 will become consumer debt and could be collected as of august 1st 2021 local ordinances any local ordinance in place on or before august 19 2020 could remain in place until their original expiration date any extensions changes or new local ordinances made after august 19 2020 will take effect after july 1st 2021 other important takeaways a landlord cannot use rental debt as a negative factor during a prospective tenant's screening process in other words a landlord cannot report that a tenant failed to pay rent due to recovery 19 related financial hardship nor can a landlord report it to a credit agency etc if a landlord closed or limited access to a common area such as a pool laundry facilities etc for the purpose of
