how do you challenge an incorrect or unjustified parking fine i'm barrister daniel barnett a practicing barrister and the presenter of the league lau on lbc radio and i'm putting together a series of films to guide you through the appeals process sort of satnav for justice if you're not already subscribing to this channel for legal explainer videos please do subscribe and click the notification bell underneath in this video i'm looking at councils which generate millions of pounds from motorists every year but it doesn't have to be that way because this is your guide to challenging council parking tickets [Music] more than half of those who appeal to the independent adjudicator in england and wales win their appeals and so it just might be worth you fighting a fine first you need to establish what sort of ticket has been issued is it from an official body such as a local authority or is it from a private parking enforcement company private enforcement tickets look very similar to council tickets but the way of dealing with them is very different this film is about the official tickets referred to as penalty charge notices these will include the name of the issuing authority the local authority or transport for london if it's not a council ticket you'll need to look at my video on how to challenge a private parking ticket which you'll find here there are three steps to challenging a ticket an informal challenge a formal appeal and an appeal to the independent adjudicator let's take each of those in turn if you've had a penalty charge notice known as a pcn placed on your windscreen step one is to challenge the fine informally now you need to do this within 14 days if you meet this deadline but your informal challenge doesn't succeed most councils will still allow you to pay the fine at the reduced rate for prompt payment don't be tempted to pay the fine at this stage if you intend to appeal but don't ignore the ticket either because otherwise costs can increase substantially now as this is an informal challenge there are no fixed grounds of appeal it's simply a case of clearly setting out in a letter or an email why you think the fine is unfair you'll find the address for challenging the penalty notice on the back of the ticket it's worth noting a 10-minute grace period for motorists was introduced in 2015 section 2 subsection 3 of the civil enforcement of parking contravention's england general amendment regulations 2015 all the links are in the notes below by the way states and i quote no penalty charge is payable for the contravention where the vehicle has been left beyond the permitted parking period for a period not exceeding 10 minutes so if you parked your car legally in a designated parking bay not a yellow line you should be given a 10 minute dispensation after permitted parking ends...
