hi everybody and welcome back to another episode of my buddy the lawyer again I'm Adam I'm a lawyer and I'm your host sitting here I got like a cup of coffee so I'm ready to answer your questions but today we're gonna answer the question of how do you add somebody to the deed for your home and to your mortgage now you know I like to lay out some scenarios when I'm answering these questions so here's your scenario you own your own home then a beautiful somebody catches your eye and it is love and now you want to mark your commitment by adding this person as an owner of your home by adding their name to the deed and to the mortgage and the question is is how do you do that the first thing you'll need to do is to add them to the deed most mortgages will not let you add the name of another person to the mortgage unless their name is also on the team now in order to modify the deed what you need to do is file something that's called a quitclaim deed you can obtain those blank quitclaim deeds from either the local circuit court the local recorder of deeds whoever is in charge of recording deeds in your county or online now you complete the form make sure that you both sign it once you've both completed that you'll need to file it again either with the clerk of the court with a recorder of deeds or whomever is in charge of recording deeds in your county now once that's done we can move on to adding somebody to your mortgage first thing you'll need to do is find out if your mortgage is assumable or not if your mortgage is assumable then you can go ahead and just add somebody onto the existing mortgage most FHA loans are suitable however many private loans aren't assuming that your mortgage is not assumable then you're gonna essentially be refinancing your home if you've already obtained a mortgage you already kind of know how that process goes so shop around find a good lender that's gonna give you a great rate complete compare/contrast fill out the application obtain all of the documentation that's necessary for the application make sure that you both sign it and fill it out may take a few weeks to process the application but once that goes through then you will have successfully added somebody else to your mortgage now once that's done you can get back to the process of moving in together anyway that's it I'd be happy to answer this question in more detail if you send me any follow-up questions otherwise keep sending your questions to us on email on Twitter on Facebook send them to my buddy the lawyer and we'll be happy to answer your questions also make sure you share this video if you liked it subscribe to our...
