you all and I thank you guys for tuning in every single week with me as I provide this much needed information there's a lot of you know misconceptions out there there's a lot of myths out there about the rights that fathers have so I just want to make sure that each week I am bringing you all heavy-heavy information that you need to know I'm going to write tag and we are going to get started with our question of the week all right so I just had this on my page okay so today's question is I am going to read it as if it is written I have a court-ordered parenting plan but my child's mother does not comply how can I get her to go by the parenting plan okay I'm bored this happens often so what can you do if you have a court-ordered pension plan even if that is 50/50 if that's 100% if that is whatever the time plan are the time champ agreement is it needs to be of course enforced if she is not complying with the parenting plan so what you can do is you can file with the courts to have her place in contempt of court for not complying with a court order okay you cannot do that um you can let the judge know if she comes to court on the contempt hearing the judge will acts are you know what's going on you know why aren't you complying she'll be able to state her reasons for not complying with the court order and the judge will instruct her to comply with the parenting plan now oftentimes they say they they say whatever reason is that they're not complying with the parents employment and what will happen is is that maybe they'll do it again so this is why you need to make sure that you have a track record of contempt because what this can do is this can help you establish if you don't already have majority term sharing this can help you establish a case our strong case or majority timeshare with the child so maybe you have I would say every other weekend which is the standard parenting plan in Jacksonville Florida in Florida the standard plan is every other weekend and one overnight visit per week so if you are on a standard parenting plan again which is every other weekend and one overnight stay alternative holidays okay you get father's day she gets Mother's Day you alternate years for Thanksgiving Christmases somebody gets the child in the morning someone gets the child in the in the evening or afternoon so if you're on that standard parenting plan maybe you want more time maybe you try to get 50/50 or split time sharing but you were not able to get it but now because there's a history of the mother not complying or going by the implant this can help you establish a case for 50/50 time sharing now make sure that you file your contempt so that there can be a paper trail of her not compliant because that's strong strong evidence we call that parental alienation when the mother is keeping the children away when the parent is not or the mother is not compliant that can be seen as parental alienation which means that the mother is alienating another parent from seeing the child spending quality time because we in the courts believe that parents should have equal time sharing you know equal love you know equal time spent with the child and so when a parent does that that does not look good to the courts because you know why you gonna hear this a lot of family locks it's not in the best interest of the child for the child you know to be basically taken away are kept away from another parent so you want to make sure that you are compliant okay you are complying with your head that you are actually seeing the child okay that you are actually seeing the child so make sure that you are complying with your half of the parents a plan that's gonna be key okay now don't go in there filing little contempt and you're not even exercising are trying to except maybe you're not showing up when it's time for you to pick up the child when you're getting the child when you get ready or when you are complying with the parenting plan when you get ready now you can't go in there extra content because if she comes in there say well he doesn't get her would he want to I have messages where I've shown up to the place drop the child off and he wasn't there alright you can't you know when you get there you you're late she has to wait hours on you to pick the child up so don't don't fathers can tell when it when you're ready you know to comply with the parents and make sure that you know there's a good history of you trying to comply with the parenting plan okay and that it is truly the mother that is not compliant with the parenting plan so make sure if you want to try to get majority timeshare there are also two things that you want to make sure occurs number one you want to make sure that you are in substantial compliance with your child support I'm gonna say that again you need to be in substantial compliance with your child support that means you need to be up to date you need to be current with your child support okay alright if you don't have the ability to pay that you or at least can show proof that you don't have the ability to pay because that's gonna that's going to count against you when you're trying to get that majority time-sharing with the child does everybody understand that let me know if you have any questions about that now with this majority time sharing that you may be trying to get are establishing a case for that you can actually have the child majority of the time there's your work schedule comply okay there's your work schedule allow you to have the child literally most most 5050 time sharing plans it's every other week when we went for a week with the mom on the next full week is with you does your work schedule allow you to take the child to school pick the child up from school be there with the child at night because you have to think about all of that because you're gonna be the full-time parent of the child during the week so I know sometimes fathers they're just thinking okay I want to get majority timeshare but make sure that you can actually comply with a 50/50 time-sharing pant plan as well okay another thing if you're the other parent has majority time sharing with the child make sure she can't comply meaning it has her work schedule change such that she can no longer keep the child when the child is picked up from school maybe she gets overnight job or a second job if she is going to be having the child with somebody else at that time could be with you so you need to monitor you know the schedule of the mom if there's a substantial change in circumstances that are unanticipated that is grounds for you to get majority time-sharing I know it's a lot of women it's watching here today so make sure is that you keep in mind when you're picking up a second job or when you are HAP changing in schedule that you are allowed to comply with your parenting plan and that you are keeping the child now the children can spend of course time with somebody else but the father should have that first right of having that child when you cannot keep that child or when your schedule changes so fathers be aware of any schedule changes because that is an unanticipated change you didn't know she was on pick up a second job you didn't know that you know she wanted to start going to school you didn't know that you know she picked up something else that kept her away from the children you know you could have that time it's anybody have any questions about anything that I said let me just make sure I don't have any questions so again for our fathers that are on here and the father the access question that was submitted I have a court-ordered parenting plan but my child's mother does not comply how can I get her to go by the parenting plan what you need to do is you need to notify the courts that she is not in compliance you need to have her in contempt of court if she spells multiple times while even after she has been in contempt of court the judge can't issue a writ of bodily attachment that means she can go to jail okay so it's important parents both parents did you work together work together so that no parent goes to jail and be in substantial compliance okay there is no reason that a mother outside of any type of violence that is going on should keep the child away from the other parent okay thank you guys for joining me
