Hi I'm Michelle! Welcome back to finely revealed. In this episode I want to talk about real estate again and in particular I want to talk about mechanic's liens. Oftentimes you will have friends and family help you out in making modifications or repairs to your property. but there are certain situations where you need a contractor or a handyman or a subcontractor with you as a contractor. Somebody to help you build a fence. dig a pool, re-landscape the yard. paint the house. add new gutters, redo the roof, redo the driveway, redo the walk, remodel entire bathrooms, remodel the kitchen add a finished basement. All of those types of things you should have an agreement with the party who's doing the work with a start and end time, and a cost. You should also have written change orders if you have a written contract so that you can keep track and things don't get out of hand. The reason that I'm telling you this is because if these people are not paid what they claim they're owed they can file a lien against your property. It's called a mechanic's lien. It's for anyone who does work to the property or who adds material to the property. Each state has different rules on this as far as who can file and how/ what the procedure is for filing. They are typically a short period of time for them to file these liens and it runs from the date that they last do work on the property or last add materials. Protect yourself from having this happen. You need to be clear about what you're paying, you need to get a receipt when you pay them in full and the best thing would be to have your contract marked paid or get what is called a lien release that they release all rights they have as to the property. You want to have that to verify that you paid right then. Then you want to keep those records just in case somebody gets ambitious and files something against your property you don't have to dig back later to show that you paid this - you've already got that proof!
