pre marcie's law filing so no contact with the anchor bar the defendant has two prior criminal convictions that i found one was a i'm sorry one conviction but two cases one was a 2018 domestic abuse disorderly conduct that was ultimately dismissed but she had two failures to appear during the pendency of that the other was a 2018 retail theft with two two failures to appear uh her second failure to appear resulted in a five thousand dollar cash bail but that was a felony retail theft case the information we had at time of filing was that the defendant was likely moving or headed to kansas or florida and this is while this is a misdemeanor theft it's a theft of over sixteen hundred dollars uh is the allegation thank you mr anderson well i would first note that i think that the uh the cm found the cf file from a couple years ago that the state referenced um that the miscourt appearances were the same days and those two files in other words that they were scheduled together um yeah i think that the reason there was such high cash bail uh eventually in the cf file is that that was a the court date that was missed was a jury pre-trial so the court set the higher cash bail at that point um prior to that miss um she i know she had a representative she had numero we had numerous numerous status conferences in that case that she is making her court appearances on a signature bond i don't recall what happened at the miss pre-trial in any event my recollection is miss dao is a lifelong resident of the area i don't know her current financial situation because we did not have contact this morning but we are requesting a signature bond thank you well whether or not it's uh the same day it is two cases and so that's just all the more um impetus for the defendant to make her appearances if she's got not one but two cases that she must appear on non-appearance uh does uh tell the court something when it's two cases versus one uh so we it looks like the last couple criminal matters she's had she's not appeared on and i guess it is telling if one of them was um set for trial and it was close to trial mama ordered 500 cash that is money you'd have to post in order to be released if you're able to post the money in our release make sure make sure you make your court appearances if you were to fail to make your court appearances you'd forfeit the money a bench warrant january 8th he apparently arranged a voluntary appearance on january 12th and then and when i found out on the on the 12th that's when i first let mr the lord speak please thank you and then failed to make that voluntary appearance that he had scheduled and now appears involuntarily and it appears he had one other prior failure to appear in a 2015 case mr anderson we are requesting a signature bond based on what mr ingles has represented to the court he is a lifelong resident of douglas county it's an operative revocation charge he has numerous relatives who live locally and no ability to post any money thank you well yeah i mean there are those sympathetic factors children and and illness and that sort of thing but um looking at the file here i'm hearing that there's a prior failure to appear in another case and it looks like it's really sort of two failure strip here in this case i am looking at the notice i'm looking at the minutes there was oral information provided to mr ingles giving that january 8 date there was a written notice that gave him the january 8th date apparently at some point after january 8 he knew there was a warrant for himself so i'm not sure how he learned of that warrant or why he may have been confused and then uh a hearing was held on january 12th based on his schedule his request and then he didn't appear again and uh never made a voluntary appearance so sir i will order that 250 cash that is money you'd have to post in order to be released if you're able to post that in our release make sure you make your court appearances if you were to fail to make your court appearances you'd forfeit the money a bench warrant would be issued that condition of no operation without valid license will continue we'll get the matter on with judge tim appearing with mr nelson mr lalor appearing mr nelson if you could verify a current address please okay let's see is this no um looks like this is a warrant appearance uh based on the appearance here today i'll quash the warrant it looks like the warrant is from a status conference uh with judge gonek when there was no appearance court issued a warrant forfeited bail or bond based upon the appearance i guess i have uh quashed the warrant mr nelson any information regarding your client's non-appearance his microphone isn't on your honor i'm not able to hear a thing he's saying sorry can you hear me now chad okay oh mr uh nelson when when does anybody ever listen to me anyways so uh okay so starting over um i had been in contact with mr tolega by telephone yesterday his representation to me was that he merely made an error as to the proper court date he had believed that the court date was the 27th which would be today he had made some arrangements for certain persons i could talk to he's interested in his case and some of those kinds of things and and just made a simple error obviously discovered his error fairly quickly and then undertook to get into contact with me to discuss what his realistic options were he i certainly explained the scenario to him possible scenarios uh he agreed with me your honor that um it would be uh important uh to quash that warrant sooner rather than later um he and i did talk about the possibility that given the non-appearance even if it's the next day or two days later that there would be at least a consideration of ordering [Music] additional cash bond i was my understanding mr talega's understanding at the time that he had posted uh 500 cash uh in order to be released and talking with him he is indigent your honor but on short notice uh he was able to raise uh 250 dollars of additional cash funds it's my belief that he would certainly be willing to post that today and represents that that would be uh something that he could do in order to ensure his future court appearances and uh represents to the court your honor through council that this was a simple error on his part and one that he is unlikely to repeat i'm not aware that he has a particularly lengthy record per se but you know i certainly leave that to the to the state in order to give what it feels is a relevant rendition of that i'm not aware that he has a long history of um missed court appearances we haven't had too many court appearances in this case but yesterday was the first one you missed thank you mr lalor you know the state would recommend the court reinstate the prior cash that was ordered forfeited on the 25th that was 500 and asked for another 750 cash prior conditions to continue so a total of 1250. this is the i guess i'll start off with uh the defendant's confusion on december 7th 2020 the defendant appeared before judge clonic uh with attorney nelson when his next status conference was set january 25th at 9 30. this is his second failure to appear in this case he had one on august 12 2020 he did show a couple hours later um that was for an attorney check for preliminary hearing the defendant does have a lengthy history and does have a lengthy history of failures to appear in douglas county he's got a 2019 bail jump with a failure to appear a 2019 operating without a license with a failure to appear a 2018 disorderly domestic disorderly conduct with a failure to appear and three convictions before that none of which have failures to appear in minnesota he's got a i believe he still has an open warrant in carlton county he also has a 2020 st louis county pending case with a failure to appear that's for drugs possession sale hypodermic syringe needle driving after revocation case here's another 2020 case for theft in minnesota with a failure to appear he has three driving after revocation cases between 2018 and 2019 i'm sorry four all of which though their misdemeanors there he failed to appear or pay in lieu of appearing and a 2017 shoplifting case with failure to appear and then six more make that eight more traffic violations most of which are driving after revocation for which he had failed to appear or pay in lieu of appearing and i would note it does appear as though his uh the minnesota case where i mentioned a warrant the warrant is no longer active thank you carlton okay well i'm hearing about a number of failures to appear in the past um what one question i had here i don't mean to interrupt your honor but one question i did have regarding that was i wasn't sure if mr talaga had made voluntary appearances each of those times or whether he had actually been apprehended i guess part of the reason for my curiosity there your honor is i do think that there is an important difference between a failure to appear and then kind of persisting in that fair to appear and not appearing until you're basically apprehended versus having made a mistake and then coming in voluntarily as mr talaga does today i do think that there's a big difference between those two scenarios your honor and so that's the reason that i would bring that up i'm not aware based on mr lalore's rendition whether those all entailed him appearing in custody at those uh at those instances and i think that it does matter and i would note that mr talega does appear voluntarily obviously today yeah well i guess it would matter in the sense that it would add to a method or practice or procedure if in fact he misses court and then voluntarily appears i hear six i'm not counting any of those eight traffics or something where it's a pure or okay which he did neither of but on the criminal matters i heard six uh not counting the two in this case so uh it does count for something but it also counts that that's uh what he does uh i heard in 2018 2019 and 2020 cases we had these failures to appear in other criminal matters so apparently that is uh something in his history that shows he does uh and and this is a second non-appearance so it is a quick turnaround that is good he's here but i am concerned that it's yet another non-appearance showing up when it's more convenient for him and then asking and arguing for some lower bail than what perhaps is warranted this is a felony matter it's uh a serious matter and as i look at it now i see the minutes uh show some of the recitation that mr lalor did and i'm surprised at myself for giving 500 with that history um on a felony case and uh i certainly would not uh consider 250 if 500 doesn't get his attention and make him write down everywhere that it was the 25th and not the 27th i'm not sure why 250 would um so i'm i'm disinclined to give less cash bail than cash bail that didn't work last time uh so um you know he warrants the 750 but i'll order 500. sir i'll order an additional 500 cash bail that is money you'd have to post if somehow you can post it now if you've got a credit card or something you don't have to go into custody the officer can take you over to the click of course office otherwise you would have to go into custody if until you can post if you are able to post that means your cash bail is a thousand dollars if you fail to appear again that would be forfeited a bench warrant would be issued and with a felony matter your cash bail could be thousands and thousands so we're gonna give you a court date now make sure you uh pay close attention to it your honor did the court reinstate his 500 yes i will if i have not i will okay thank you all right so and i apologize i'm not sure if i requested it or not but if not uh same conditions as on the previous yeah i'm assuming it was no drugs i don't know what else may have been there but whatever conditions sir you had prior uh continue to comply with those conditions uh so let's see this mr lalor's file see how quickly we can get it in um okay sir we can the judge is using march 15th but i can go uh february 8th we do have time with mr lalore's time on february 8th yeah i i feel like february 8th would be the preference your honor february 8th sir for your conference with the judge i will get you notice again pay close attention to it and the officers will have to take you into custody today what time on the 8th judge i'm sorry i don't remember um another 250 yeah 500 you actually need another 500 here it's an additional 500. uh nine o'clock february 8th okay thank you nine o'clock february 8th okay let's see so this must be ms mcconnell in custody here miss mcconnell did you receive a two-page probable cause statement i guess it did i'm sorry you said yes yes i did okay all right thank you mr nelson okay uh let's see uh ma'am uh we've got a probable cause statement for you ms uh mcconnell uh janae love mcconnell appearing mr lalor appeared ms mcconnell if you could verify a current address please 1311 john avenue apartment six okay we don't have a complaint yet ma'am um but i did find probable cause on this uh this statement mr uh anderson can you i'm not sure can you appear with ms mcconnell on this kind of thing or do we need to wait for charges if you would like us to appear again we did not have contact from her this morning so i don't know what her desire is for a council ma'am we've got mr anderson from the public defender's office here he may be able to make a special appearance with you would you like mr anderson to appear with you today yes please all right uh so mr lalore we don't yet have a complaint what is your request for ms mcconnell you're under the states requesting fifty thousand dollars cash no contact with victim one no contact with victim two as the court uh would note from having reviewed the probable cause statement uh the allegations include two class c felonies extremely serious crimes each uh potentially subject to 40 years imprisonment as well as a class i felony the defendant does not appear to have a significant criminal history but in this case the defendant has actively tried to destroy evidence or have others destroy evidence for her while the well law enforcement was attempting to investigate and i believe it was occurring while shortly after she was taken into custody additionally we believe any contact with the victims will cause further interference in the investigation we would also request no intentional contact with children under the age of 17. the priors to ask i'm sorry mr lalor i'm just going to jump in here and i want to hear whatever else you have to say but just before i forget ms mcconnell did you also receive a victim and identification key was there also a document that said identification key on it no ma'am didn't get that the clerk is indicating they're sending that or resending that so we want to make sure we've got that identification key so if there's a request for no contact ms mcconnell knows knows who those victims are what's that i'm sorry i can't hear what is there one filed in oh there isn't one file mr um lalore uh you're referencing some victims has there been a key filed i'm checking right now it wouldn't have been it wouldn't have been e filed because we can't do that without a case number but i see there's notes that the keys were sent to the public defender i don't know if this one was sent as well it was not the clerks are indicating they never received any key so if the clerks didn't then mr anderson didn't and ms mcconnell didn't i'm not sure how we can uh deal with that i'm pulling it up right now your honor i can uh just looking at it here i i can send it to the jail and mr anderson i guess in the clerk if you want me to your honor yeah did you want me to send it to the clerk as well well i don't care they'll get it sooner or later let's just get it to ms mcconnell and mr anderson if it doesn't slow anything down sure send it to the clerk i don't need to see it today um you know we'll have it by the time of the complaint but let's get that out and contact with children under the age of 17. regarding priors uh the priors that we're showing are a 1999 conviction in minnesota for possession of false or altered identification card the defendant was on probation probation was revoked and a 2014 disorderly conduct in bayfield county that's all i'm showing mr anderson if you received that key yet i did okay jailers haven't received it yet it looks like well i guess we can uh come back to the victim part of it we'll make sure that ms mcconnell has that victim information before we end here today but i suppose we can talk about the other requests mr anderson uh ms mcconnell how long have you lived in superior i live in superior now for almost five years and how long have you lived in the twin ports area in twin parts iron river brewery i've lived here since 2000 and looks like you were employed but are probably not employed now is that fair most likely i would guess and do you have any other source of income or assets no i do not commissioner we are requesting a signature bond um obviously the point of of bails to sure appearance in court sounds like she has no ability to post cash bail has lengthy ties uh to the northwest wisconsin um twin ports area and uh it doesn't sound like she has a much of a history at all and certainly no recent history of missing court appearances so based on that we are requesting a signature bond thank you you still haven't gotten the victim key there yes she's got it now oh i'm sorry okay i didn't realize that you had it okay well i'm not hearing a great uh history uh a couple of things one that did result in probation revocation so that is uh some of the history that would be concerning the the potential charges are great uh the class c felonies uh each punishable vibe to 40 years prison is uh is substantial exposure um let's see mammal order uh 20 000 cash that is money you'd have to post in order to be released if you're able to post the money in our release make sure you make your court appearances if you were to fail to make your court appearances you'd forfeit the money a bench warrant would be issued conditions of your bond that you not have contact with victim one or two or minors under the age of 17 no contact in person in writing by telephone mail electronic means or a third party if you were to violate those conditions you could be charged with bail jumping a separate criminal offense uh mr um anderson february 9th for initial appearance then now we we object to that the um wisconsin statute is that if a person is arrested um without a warrant the complaint shall be filed forthwith um two weeks from now obviously doesn't qualify as fourth with um she she has a right to have a preliminary hearing within 10 days given that amount of cash i don't think the state can do an end run around that requirement by requesting an initial appearance two weeks after the person is arrested and cash bail established we request initial appearance tomorrow uh mr lalor anything further well your enter other than a conclusory statement that mr anderson's opinion forthwith uh is not two weeks away i didn't hear him cite any authority uh that that initial can't be scheduled for that i'd also note that the preliminary examination time limits are from the time of initial appearance in the filing of the complaint so we have a case here where a 15 year old victim who is out of state has to be interviewed which requires coordination interstate coordination a use of a computer to facilitate a child sex crime of a child that is out of state and as such we don't believe the february 9th date is unreasonable and that's the date we ask for thank you forthwith has a readily understood meaning and it's not two weeks thank you well just looking at i i do see that there are some complexities with uh somebody who is alleged to live in another state i do however see that it is alleged in the probable cause statement that that person has been interviewed and that the uh the computer and such has been seized um so i will order um com complaint or initial appearance let's see what are we at now the 27th uh we'll go to a week from today that's the third kind of splitting the difference here folks february 3rd initial appearance 1 30. ms uh mcconnell will have a notice sent to you for that next date and time ms mcconnell if you want to be represented by an attorney from the pub defender's office you need to call that office to do a financial evaluation the jail has the number for it okay yeah we were having difficulty contacting you today we couldn't
