Hello, everyone. In this video you'll learn about a feature called Patent Status, found in the IFI Claims database. We'll look at what the Patent Status field contains, why you might want to use it, and how to use it. When you're searching for a group of patents, you might want to know: Are all of these patents still in force? Were any of these patents terminated for some reason, or did they simply expire? In short, are they dead? Or alive ? And as to US Published Applications, you'll want to know: Has this application already been granted ? And if so, can I get just the Granted patent record, without also getting the record for the Pre Grant Publication? The answers to these questions can be found easily for US patents, in the IFI Claims database, using an enhancement in IFI called Patent Status, and in this video I'll show you how it works. So let's get started. There are just a limited number of values to be found as the Patent Status indicator, and here they are. For a Granted patent, you will find the status is either Active, or Expired - and there are two flavors of Expired, they might be Expired in the sense that they've simply reached a natural end of their lifespan, it's been too many years since they were granted or applied for, and they're expired. The word Expired is also used in the situation of a patent that is cancelled or terminated due to the owner's failure to pay the maintenance fee. And there are a small number of patents with the status of Withdrawn. For Published Applications, they will either have a status of Pending; or Granted - meaning that there is also a separate record in the database showing the Granted version of that Published Application; or, it might be Abandoned. Next, let's take a look at some examples of each of these types of patent status. Here's an example of a Granted patent with a patent status of Active. In the IFI database, in the Legal Status section, you'll see that the first line is going to say Patent Status in the description, and then in the box immediately to the right of that, you'll see what's that status is. I've drawn a box around "status active" to indicate that, even though these are in adjacent boxes in this little table, you can actually search for these in the Legal Status field as if it was a phrase, quote status active unquote - and that's in fact the way we will do these searches, as I will show you shortly. Here's a patent with a status of Expired. In this case it says "Expired - fee related". This indicates that the patent owner has not paid the required maintenance fee. You can also see here that the calculated or natural expiration date was not until 2028, but it's been marked Expired on a fee related basis. And this one is "Expired - lifetime". In fact it also shows here that the natural expiration date was back in 1967. Now this patent is Withdrawn. There are not many patents in the database with this kind of patent status. Most of them that are in the database look like this - you see this strange title, "Patent not issued for this number." I don't really know the particular legal scenario that results in this kind of record, but you will not encounter a lot of these in your searching. Here's another example ofa patent with status Withdrawn. This one's a B2. It more closely resembles a normal patent, but it is Withdrawn. And you'll see an even smaller number of B1s that are marked status Withdrawn, Now as to Published Patent Applications, here's an example of one that is Pending. This has come out as a Published Application but it's not yet granted, When it is granted, the record for the Published Application will be changed to show that the patent status is Granted. At that time, you would also find a separate record for the Granted patent in the database. And in that Granted patent record, the patent status will ordinarily say Active, as in the example that we saw before. This raises the question: If you're doing a patent search, would you want to get both of those records? You might instead want to get the Granted, but once the patent has been granted you might not want to also see the Published Application as a separate record. There is a way to get only the Granted, and I'll show you how to do that. Here's an example of a Published Application with a patent status of granted and here's a published application with a status of Abandoned. So, now that we've seen all the different types of Patent Status, and what these records look like, let's take a look at how the Patent Status can be used in searches, to refine your results. Many searchers will decide for example that they only want "active" patents, and you can use the Patent Status field to do that. You would NOT-out any records that have a Patent Etatus of Expired or Abandoned or Withdrawn. On the other hand, if you're doing something like a Prior Art search, then you would want to see any patents that are out there, even if they're no longer in force - and yet you might want to eliminate the records for Published Applications, where you're already getting the record for the Granted version. In that case, you can simply NOT-out the Patent Status of "Granted". Or, you can decide that you don't want inactive patents, and you would also like to eliminate Published Applications where there is also a Granted. In that case, you could do a search statement like this one. All of these Patent Status values can be used in any combination that suits your purpose in a given search. To demonstrate the kinds of searches that I just described, I've gone into IFI Claims and I'll run a search for anything with Hewlett Packard as the assignee. This is a very simplified version of a patent assignee search, just for this demo - and I get over 71,000 results. If I use the Patent Status feature to NOT-out records indexed as Expired or Withdrawn or Abandoned, the hits dropped down to under 50,000. Hewlett-Packard has patents going back to the early 1960s, so it's not surprising that so many should be Expired. If I leave in the Expired patents, as I would do for a Prior Art search, or if I were researching the company's patent history - but I remove any records for Published Applications where there's also a Granted record, the number goes down from 71,000 to 52,800. This reflects Hewlett Packard getting close to 20,000 Granted patents just since Published Application records began appearing in 2001. And if I use patent status indicators to remove both the inactive documents, and also the Published Applications that are Granted, as shown here in this search, I'm down to 31,000 records- well under half of the 71,000 records that I got initially - by filtering my results in IFI Claims, with the Patent Status information. So that's it! I hope you'll find that Patent Status, in IFI Claims, will be a useful addition to your search techniques. For more information, here are some links to additional resources.
