today i'm going to explain what arbitration is and why you should think twice about signing an arbitration agreement if you are in california and we're starting right now [Music] hello my name is brandon ortiz i am an employment lawyer in burbank california welcome to my channel before we begin let me just remind you that this video is not legal advice i'm just giving you general information if you have specific questions about your specific situation you should contact an employment attorney and without further ado let's begin so a lot of people when they hear the word arbitration they think that that means that they are signing away their right to sue and that's not a hundred percent accurate you still have a right to sue if you know you get wrongfully terminated from your job or if you're sexually harassed but the problem with the greened arbitration is that instead of bringing that claim to the court system and having an opportunity to tell your story to a jury you are contractually obligating yourself to take this to a a supposedly neutral third-party arbitrator and arbitration works a lot like court you'll file a lawsuit but instead of filing it with the court you will file it with an arbitrator or an arbitration agency you'll have discovery like you have in court and you'll have uh what is similar to a trial it's called a hearing but it's it's essentially a trial except instead of having 12 jurors and a judge you have just an arbitrator who's acting as both a a judge and as the jury at the same time and if you read your employee handbook or you read any new higher paperwork you know they probably uh describe this as this really efficient quick way to resolve disputes and it's cheaper and it's less hassle and it's more convenient unfortunately that's not reality the system unfortunately uh is inherently corrupted and uh you know there are some good arbitrators out there and good neutrals out there unfortunately they tend to be far and few between and companies by and large know who the arbitrators are who are fair and refuse to use them and so what you have is this system where the arbitrators know that if they make a favorable ruling or favorable finding for the employee they could lose business and if you're if it's a big company you know big fortune 500 company a big um multinational corporation it gets sued a lot okay and so that's a lot of potential business for an arbitrator and so studies have shown over and over and over again and i know just from my own experience and i know from uh you know speaking with other employment lawyers just hearing anecdotally the results you get in arbitration are far far more slanted in favor of the employer than the employee employees lose more often in arbitration if they win in arbitration the...
