hello youtube i'm vince white i'm an employment attorney and we are answering public posted questions um from youtube today we have a question from youtube user alan d it was posted let's see it was posted loading loading loading still loading two days ago so i apologize alan uh for keeping you waiting but our response time is improving we're getting people answers quicker and quicker alan asks and he was posting on my video from june 20th can i publicly share the eeoc's findings in my case and alan posted a question which i will read now what is considered signing under duress or coercion how would an employee prove it okay so this is going to differ somewhat from jurisdiction to jurisdiction so i'm going to answer your question in the context of new york and you can then extrapolate from new york and it's similar in many jurisdictions but you need to find out what it is specifically wherever you are so people call me all the time in new york and they say oh i was i was forced to sign this agreement i said oh my god i'm so sorry how do they threaten you because that's generally duress or coercion you're looking at like threats of violence in most cases there's you know there's other ways to do it um but generally you're looking at threats of violence and a lot of people um they think the standard is going to be more like well they told me they wouldn't give me this money if i didn't sign no they told me they wanted me to sign before i went not going to do it generally speaking in most jurisdictions um they told me they would give me a bad reference so i didn't sign gonna meet that standard in almost any jurisdiction right um so if you have a specific set of circumstances you know like how were you coerced how were you forced to sign unduress i can talk about those but the general answer is threat of violence that that's going to be in many jurisdictions certainly in new york what you probably need to rise to or close to in order to set aside an agreement a settlement agreement that that was signed um for the purposes of maybe suing now or something like that right so your second second part of your question was how would an employee prove it any piece of evidence that can reflect that you feared for your life or feared for your physical well-being if you did not sign that agreement would be the best evidence here there's there's other ways we're speaking in generalities but that's going to be the best way to demonstrate coercion or duress uh in terms of signing a settlement agreement right and when i say any piece of evidence that includes your testimony right if you can you can go under oath and you can say hey...
