air was 27 years of age when he was murdered he went by the nickname buoyed by his family when he was a little boy he lived in a tiny one-bedroom apartment located at 7:22 Sunset Boulevard and Auburndale Florida and you're gonna see photographs of where he lived at the time that he was murdered and in the early morning hours of August 19th of 2016 Adam was executed on vacation for over that tiny one-bedroom apartment he was forced to his knees at gunpoint by his assailants all while he was begging them for his life for the sake of his five-year-old daughter now you're gonna learn that Adam lost his life for an Xbox some games an iphone some liquor a little bit of cash that he had in his wallet a gold charm bracelet and a gold necklace that he had for his little girl that had a charm on it and said daddy's little girl that's what Adam lost his life over and you're gonna learn that Adam lost his life because he decided to use a dating app plentyoffish to go on a date you're gonna hear that Adam lived in the apartment where he was murdered for some time he had moved into that apartment with his longtime girlfriend Brianna Harper and they lived there together Adam had shared custody of his five-year-old daughter and his daughter would stay there during the times that was his time to keep her Pam and Brianna broke up the month prior to his murder she moved out Adam remained after they broke up that's when he started using the plenty of fish app to meet people to socialize to date and on August 18th the day before his murder actually only hours before his murder he met a girl by the name of hailey Bustos andhe plenty of fish app hailey Bustos was had just turned 18 the birthday was in July the month prior she has been charged with the first-degree murder of Adam Cole hair just like Andrei Warner house you're gonna hear from hailey you're gonna learn that hailey did not have a place to call her own she didn't have a regular upbringing she didn't have parents in a home that she went to every night she as you can imagine a girl in in that position she started hanging out with the wrong kind of people and you're gonna learn that that is how Haley came to know a woman by the name of Evelyn Belmont and some of the other people that I'm going to talk about including the defendant Haley had a friend by the name of Josh Ellington who was also charged with the first-degree murder of Adam Hilaire who's she hung out with it was somebody that she knew because she had dated Josh's brother in the past Josh's cousin Lawrence Ellington was the connection to Evelyn Belmont Lawrence was going to be going over to Evelyn belmonts apartment in the in the days leading up to the homicide and that's what they did they hung out at every window months apartment and Hayley and Josh went over to Evelyn's apartment with Lawrence Ellington in the days leading up to the homicide Evelyn's apartment was located and you'll you'll see photographs of her apartment as well you'll see a map was located at two to four to Bordeaux court and Auburndale and you're gonna learn that the distance between Adams apartment and Evelyn's apartment is I want to say less than two miles it's very close in proximity now you're gonna learn that Hayley went to Evelyn's apartment with Josh and Lawrence and during the course of the days leading up to the murder other people came and went they hung out they had a good time socialized Evelyn lived there with her young children this defendant Andre Warner also had recently started staying with Evelyn Belmont and Andre and Evelyn were good friends you're going to learn that one of the other people that was hanging out Evelyn's apartment during this time frame was a person named gary Gray who is the fourth defendant charged with the first-degree murder of Adam Hilaire you will learn that gary gray was also connected to Evelyn Belmont they referred to him as her cousin or crazy cousin she also had a nickname of Gucci he was not blood related to Evelyn but that's how close they were Haley didn't know Evelyn didn't know Andre didn't know Gary before the days leading up to the murder of Adam Hilaire she first met all of those individuals at Evelyn belmonts apartment now you're going to learn that Evelyn was getting frustrated at the fact that she had all of these people staying at her apartment because they weren't just coming and hanging out for a couple of hours they were sleeping there some of them for days consistently some of them would come and go but she was frustrated because her thought process was if you're gonna be staying at my house you need to help pay the dose and she voiced her frustration you're gonna learn that in the days leading up to the homicide this defendant Andre Warner was also strapped for cash that thursday august 18th 2016 the day before the murder hours before the murder Haley was hanging out at Evelyn Belmonts apartment the frustrations that everyone had about needing money to pay her bills was a topic and Evelyn suggested to Haley that there's a way we can get money and Evelyn showed Haley how to create an account on plentyoffish and told her this is a way that I have finessed in her words money from men whether be through prostituting or talking them out of their money in the way that she did Haley agreed to set up the account without motivation in mind and you're gonna learn that shortly after setting up that account and I think that the way the plenty of fish account will works is you set up your account and then it allows you to see people in your direct vicinity who are available to communicate with which is how she ended up communicating with Adam Hilaire they first communicated on the app itself then they exchanged numbers began texting each other during the course of that Thursday afternoon and finally agreed to meet up that afternoon Adam picked Haley up near the Bordeaux Court Apartments and you're going to learn that where Evelyn lived it was an apartment complex there's multiple apartments it's not just one single family home he goes there he has his own vehicle he drives a white Chrysler Sebring he picks Haley up there's no specific plan at that time as to what they're going to do they're just going to hang out they stalk back at Adams apartment so that Adam can get changed and during the time they were there you're gonna learn that Adams roommate stopped in his name was John hun and join started living there after Adams girlfriend moved out and he didn't live there he didn't stay there every night but he stayed there occasionally and he was staying there during this time so you're gonna learn that when Adam and Haley went back to Adams apartment at some point John comes home they interact for a bit and then John leaves and goes on his way or Haley and Adam leave and John remains there but it's a very short interaction Adam and Haley go to Juanita that is where Haley's aunt lives with two cousins were both minors at the time and they go there for the purpose of Haley as I indicated she doesn't have a place so she has clothes kind of scattered throughout at different places so she wants to get changed she wants to bathe so Adam agrees to take her there and that's what she does and while Haley is getting ready to go on a date Adam talks to her young cousins ends up taking one of them to the store and you know just trying to leave him in the right direction give them some advice and once Haley's ready they decide that they're they're gonna go bowling they're in Winterhaven at the Cypress lanes off of Dundee if you're familiar with that area and that's what they do they go bowling according to Hayley they have a pretty decent time they spend an hour or so couple hours bowling and after they're finished bowling they go back to Adam's house or Adams apartment and you're gonna learn that when they are back at Adams apartment shortly thereafter Adams friend by the name of Chris Rogers shows up and Adam knew that he was going to show up and him and Adam we're gonna hang out for a little bit after Adam dropped Haley off that night so Chris arrives at the apartment and we're we're about after midnight now they chitchat for a little bit and then they all three leave the apartment Adam drops Haley back off at the Bordeaux Court Apartments Chris is in the back seat he sees this and then Adam and Chris go their way and they hang out for a little bit longer it's around 1:30 in the morning when Chris gets dropped off at his apartment you're gonna learn that there is a bar called the bonfire that's roughly two blocks away from Adams apartment and after he drops Chris off he goes to the bonfire to have a drink or to socialize for a little bit and from there he ends up dropping off a friend of his in wakeland and then returning back to his apartment no Adam probably thought that night that he would go to bed wake up the next morning go to work where he was scheduled to work pick up his daughter from school that afternoon unfortunately that's not what happened Hayley went back to Evelyn's apartment there's different individuals hanging out there including the defendant Evelyn belmont gary gray Josh Ellington Lawrence Ellington Denzel Rakowski who is a friend of Hayley and Josh's and Denzel was there with his young child who I think was about two at the time and I told you Evelyn had her young children there who were roughly the same age Haley will tell you that when she got back to Evelyn's apartment she went to sleep and she is awoken by gary Gray who tells her that she needs to come out because we want to know what Adam has in his apartment she does that she goes out to the main area of the apartment she proceeds to tell Evelyn and Gary and Andre all of the things that she saw in Adams apartment that they could steal Tumi's I forgot to mention that earlier a couple of TV's were stolen as well TV's Xbox she tells them that when they went bowling she saw a little bit of cash in his wallet and that's when they decide that they're going to go take what they want from Adam Hilaire now Hayley will tell you that she is the only one that knows where Adam lives so she agrees to go with Andre Warner with gary gray and Josh Ellington is asked to be the driver and the vehicle that they took over to Adams apartment was Andre Warner's vehicle this is somewhere around 3:00 in the morning now Haley directed them where Adam lived she will tell you that they parked somewhere down the road from the apartment at first and that Audrey Warner and Gary gray are the two individuals that go to Adams apartment her and Josh Ellington remain in the car Josh was to be the getaway driver once they're done stealing what they went there for she's going to tell you that shortly after arriving there one of them comes back to the car and tells them to pull up to the front of Adam's apartment and you're going to see that Adam lived in a quadruplex and only use the back door to his apartment the back door in the back of his apartment building was the parking lot so which is easier access to get to and into and out of his apartment the front door was only used to check the mail but where Haley tells will tell you that they pulled up to was the front door of his apartment and that at that time she sees Andre Warner and Gary gray going back and forth and bringing the things that they steal from Adam the TV's Xbox hats she doesn't see everything but she sees those those bigger things she says they make a couple of trips back and forth she will tell you that the way they got into the apartment was by knocking on the door back door and then when Adam answer to Andre forced his way in with by gunpoint she will tell you that once they are done unloading all the things that they want to are loading all the things that they steal from Adam Gary comes out of Adam's apartment she hears a gunshot and then Andre Warner comes running out and as he runs out of the apartment he actually slips and falls in the grass and she can see at that point that he has a firearm and she will describe it to you as similar to the ones that law enforcement officers carry semi-automatic now she is going to tell you that on the way back to Evelyn's apartment Gary gray and this defendant Andre Warner thought it was really funny how Adam Hilaire was begging for his life and they were laughing at Adams expense they were saying how he was begging for his life and telling them that he had a five-year-old daughter and at that time they told Haley that not to worry about it because they had just shot him in the arm which was not true but that's what they told her now on the way back to Evelyn's Haley won't tell you also that she learns that gear gray has stolen Adams iPhone and because there were concerns that that iPhone could be tracked it is thrown out the window on the way back to Evelyn's apartment you know once they get back to Evelyn's apartment they start unloading everything that they had just stolen from Adam you're going to see as I mentioned photographs of Evelyn's apartment and in the front of her apartment she has attached to her apartment what some have referred to as a shed so it's a room that she can store things in and you're gonna learn that some of the things when in the shed some of the things went into Evelyn's apartment and you're gonna learn that now back at Evelyn's apartment they are celebrating what they had just done by drinking the liquor that they stole from Adams apartment Haley sees Evelyn and Andre Warner going through a wallet and money being pulled out she assumes it's Adams wallet and she will tell you that Gary in this defendant continued to laugh about what they had just done now you're gonna learn that Haley Gary and this defendant continued to stay at Evelyn belmonts apartment all the way up until that Sunday when they're all arrested and that Josh Ellington leaves Evelyn belmonts apartment early in the morning that Adam is killed so the same day just a few hours later he leaves and he doesn't ever go back to Evelyn belmonts apartment Haley is going to tell you that while she is initially told that Adam was only shot in the arm she is eventually told what really happened inside Adams apartment and what she will tell you is that Andre Warner this defendant tells her and I shot at him and the reason why is because I was barefaced that's Andre Warner's words because he chose to go into Adam Polaris apartment without a cover on his face and that's the reason why he tells Haley he shot him now later on the day that Adam is murdered in the evening closer to 7:00 p.m. Adams body is found in his apartment by his roommate John hunt Sean had gotten home from work he went to the back door which is the door they always use it was locked he saw Adams car there but he thought maybe could go on somewhere else so he waited waited waited tried to pull out him no luck waited hours actually until he decided that he was going to ride his bike up to the store to get something and so as he did that he made his way around the apartment building and he notices that the front door of Adam's apartment is wide open so he goes inside and finds his friend lying in a pool of his own blood face down in the kitchen floor and he calls 9-1-1 and you're gonna hear that 9-1-1 call that he made Audrey Dale Police Department respond along with the Sheriff's Office to assist with the crime scene because the Auburndale Police Department doesn't have their own crime-scene investigators so they utilize the Sheriff's Office crime scene investigators you're gonna hear from some of those crime scene investigators you're gonna hear from some of those detectives and officers who responded to the scene and who investigated the case they will describe to you their initial observations of Adam of Adam's apartment and how it was clear to them that things were missing from the apartment and you're gonna see from the photographs there's cords and remotes but no TVs so it's pretty clear that there are things missing now by this time there's crime-scene tape around Adams apartment and friends and family about them have found out what happened we are nearing the top of the hour which means we have to take a commercial break but don't worry we're hitting the pause button on the video in that Florida courtroom we'll get you right back where we're leaving on after this he once ran Hollywood but now Harvey Weinstein is a convicted rapist in a trial that meant so much to so many Weinstein was convicted on two charges of sexual assault and on Wednesday they'll be sentenced to prison for his crimes how much of his remaining years will this 67 year old spend behind bars court TV will be your source on the sentencing of Harvey Weinstein out more information as to who may have wanted to kill Adam the detectives interview John hon they interview Chris Rogers in both John and Chris described to the detectives the young Hispanic female and that's what you'll learn about Haley you'll see it's a young Hispanic female but they describe to the detectives the young Hispanic female that they saw Adam with the day before it they don't know her name and while Chris Rogers is able to describe the general vicinity of where they dropped her off he doesn't know the apartment building or the apartment that she went to but law enforcement go out to the Bordeaux Court Apartments they knock on doors they try to locate this individual with no success and they also follow up on any other leads that come from the friends and family as far as who Adam may have last hung out with such as the person that he dropped off to Lakeland before his murder they follow up on all that people that he knows from the bonfire they talked to those individuals I want to go back to the defendants and I want to go back to that Friday you're gonna hear from Haley how they spent the next couple of days leading up to their arrests and she will tell you that on that Friday her Aundrey Gary and Evelyn went to Winterhaven that day to try to get rid of the TV's they were trying to sell them but they were damaged and they were unable to sell them so they actually just ended up dumping them in a dumpster she will tell you that they go to Lakeland so that Andre can get rid of the gun she doesn't know the person that he gave the gun to but she knows that that person was told that it has head on it again these are Hayley's words the next day which is a Saturday August 20th of 2016 she will tell you that her and Gary went to Lakeland to sell the Xbox the games and the jewelry - Gary's sister Shawna gray unbeknownst to Shawna that these were proceeds from a robbery and a murder she buys things she buys the Xbox she buys the game she buys the Midori he will tell you that later that night her Evelyn Andre Gary they go to a strip club and Tampa and hang out there and then she will tell you that the next day Sunday August 21st 2016 that they continue to hang out at Evelyn's apartment and she'll tell you that there were times when Andre would come and go but he'd always come back there were times when Gary would come and go but he had always come back they hung out at Evelyn's apartment that's Sunday and in the early afternoon she borrowed Andres car to go to her aunt's house and Juanita the same aunts that she had gone to prior to going bowling with Adam and you're gonna learn that while she was there the Winter Haven Police Department went there to talk to Haley on an unrelated matter and Haley was actually in Andre Warner's car in the driveway and you're gonna learn you're gonna see photographs that Andre Warner drove a white Kia at that time and when she sees the winter Hammond detectives get out of the vehicle she please it's the statement that fled because she was in the dead boy's heart the young cousins thinking that that was Adams car because they had seen Adam get to the bordeaux part court apartments it's some time now I don't even want to guess maybe an hour at this point later and they they wait they want to we're looking for the vehicle and they see the vehicle leaving so they conduct a traffic stop on the vehicle Andre mourners inside the vehicle he's driving and Evelyn Belmonts brother Mariah Belmont is the passenger in the vehicle was known to have a very large hat collection which was gone from his apartment they learned that Haley's inside Evelyn belmonts apartment she's taken down to the police station to be interviewed and you're gonna hear that initially she's not straightforward with the detectives she admits that she met Adam on plentyoffish she admits that she went on a date with him but she initially tells the detectives that he dropped her off and that was all she knew during the course of that same interview however she comes clean and she tells the detectives well the attorneys had to sidebar I want to bring in the brilliant Josh Schiffer to give us some legal analysis Josh what do you think so far of the state's open you know I think it's really interesting how slow-paced and methodical she's being this isn't an opening that's filled with a lot of action a lot of excitement as she's not there pumping everybody up it's really a methodical one step at a time introduction to a lot of different players in what's otherwise a pretty straightforward case I think she's making a good connection with the jury it's not what jurors who are expecting the big television style law and order style opening we're looking for but I think that she's making an impact this is a really sad case the facts are brutal and she's trying to drive home that emotional hammer and now absolutely every advocate has their own style hers is a little bit of a calmer style we don't see a lot of fire and passion from her but she is hitting on all the facts she's very matter-of-fact and as you said so well Josh methodical what do you think about her choosing not to use technology thus far in the open sometimes juries nowadays they video they think about it I really like to keep it simple stupid methodology I just get confused when they see too much stimulation coming at them and in rapid-fire I think like we've seen in some of our big recent trials such as the Durst issue going on there was so much technology so much audio-visual the story gets lost thank you so much and she's back at the podium let's listen that she paid attention to the things that were in Adams apartment and when she went back to Evelyn's apartment she told the co-defendants what was inside the apartment she told the detectives that her Audrey Warner Gary gray and Josh Ellington are the ones that went over to Adams apartment she told the detectives that Josh was the getaway driver that Gary took Adams iPhone and that Audrey and Gary were unloading things from Adams apartment and she told the detectives that heard Gary sold the Xbox in the games to Gary's sister and she told the detectives that Andre Warner was the person responsible for shooting and killing Adam Hilaire and you're gonna hear that the reason why she was not forthright in the beginning of the interview was because she was scared and she even makes the statement I'm dead you know Andre Warner was arrested at the same time he is arrested a search warrant is being executed on Evelyn belmonts apartment we're still talking about Sunday night now during the execution of the search warrant at Evelyn Belmonts apartment detectives realized that Gary gray is at this location he's arrested for his role Josh Ellington is located and arrested early the next morning you're gonna learn that during the search warrant of Evelyn belmonts apartment law enforcement found additional hats in various locations in the apartment some in the living room some in one bedroom some in another bedroom some in that little storage facility they also find empty liquor bottles the detectives go to Gary Gray's sister's house in Lakeland and sure enough Xbox the games the jewelry it's all there they recovered that on August 26 five days later hailey conveys more information to law enforcement about the location of that iPhone where it was thrown out she couldn't remember it during the first interview so law enforcement get that information they go out to the location where Haley tells them that it was thrown out and sure enough they find items iPhone and some weeds near Evelyn Belmont apartment you're gonna hear from as I already mentioned many witnesses during the course of the trial in addition to Haley Bustos and the law enforcement officers involved in the investigation we're going to hear from and I already mentioned some of those the crime-scene investigators you're going to hear what their jobs are the lead crime scene investigator was John Della Valle he was responsible for processing the crime scene located at 7:20 to sunset Avenue Adam support meant he processed Adams the vehicle and he also processed the defendants vehicle we talked a little bit about this during jury selection but you're gonna see photographs you're gonna see video and your audio there's gonna be physical evidence admitted for your viewing and of course you're gonna hear the testimony of the witnesses you're gonna learn all of the efforts that law enforcement made to find fingerprints they'll explain the process that they took to lift what they call latent fingerprints if I'm a crime scene or from a vehicle or from an item of evidence and they are able to live some latent fingerprints from those areas and then they're submitted to another person who does the analysis itself and you're going to hear about that you're gonna hear or why a fingerprint may not be left or why it may be of no value for an identification you're gonna learn that law enforcement was able to identify the fingerprint of Haley boosters on Adam Polaris vehicle and the fingerprint of Gary gray on andre Warner's vehicle you will also learn about the efforts that law enforcement took to try to collect DNA and we talked about that during jury selection as well you're going to hear the process that the crime-scene investigator takes to collect impossible DNA from an item of evidence it's been submitted to the Florida Department of Law Enforcement who does the DNA analysis and you're going to hear from a DNA analyst who will tell you about all of the things that were submitted to her office in an attempt to obtain DNA you're going to learn that on one of the hats located in andre Warner's vehicle Adam Polaris DNA was on and on another hat inside Evelyn Belmont apartment and Adam hilarious DNA is on I talked about Adams girlfriend Briana Harper who lived with him for a long period of time she was spoken to by the detectives to see if she could assist in identifying any of the hats that were recovered during the course of the investigation and she shown some of the hats and not only does she identify them but she provides law enforcement with photographs of Adam wearing many of the hats and you will have an opportunity to see those you will learn that the detectives obtained all of the defendants cell phone records you're gonna see the communications between the defendants during this time period establishing their connection to one another if you're also going to hear from an FBI agent whose responsibility it was to take those cell phone records using the location data within the records to map out the location and the towers that were used by that those particular cell phones during that time frame and what you will learn is that the cell records of Gary grade they don't have any location data so he was unable to map Gary gray cell phone but for Aundre Warner and for Haley Bustos and for Josh Ellington and Evelyn Belmont he's able to map where they're at during the course of that weekend and you will see that it's exactly where Haley says they are that weekend they go to Lakeland to get rid of the gun they go to Winterhaven to get rid of the TVs her Gary go to Lakeland to get rid of the Xbox or sell the Xbox Saturn they all go to the strip club you'll see when she's when Haley's in Winterhaven at her aunt's house the other thing that he will explain is that during the time we believe the murder happened in those early morning hours all of their cell phones are using a cell tower that Adam hilarious home uses now the other thing that he will tell you is because of the close proximity to Evelyn belmonts apartment that apartment uses the same cell tower as well you're gonna learn that in addition to cell phone records being obtained all four of the defendants physical cellphone phones were recovered search warrants were drafted and executed and data was recovered from those cell phones and we talked about that during jury selection how cell phones are like little computers they have hold so much information you're gonna learn data was extracted from Andrei Warner's cellphone and it's gonna be clear from that data that he was heartened for money at that time finally you're gonna hear a phone call made by Andre Warner a couple weeks after his arrest this call is to his grandfather during the call his grandfather is talking to him about the grand jury proceedings that were happening that day this grandfather tells him that according to a witness that testified at the grand jury the state showed members of the grand jury a photograph of Andre Warner's hand with gunshot residue on it absolutely not true but this is what his grandfather is telling him during that phone call you're gonna hear that Andrei Warner responds by telling his grandfather no they didn't take no residue test and it took them a couple of days before they came and got me I've took plenty of showers I took a shower everyday and the residue only stays on your hand for 24 hours no this is just a snapshot of what the state anticipates you will hear during the next next week and a half and we're confident that once you have heard all of the evidence presented that air to you that Andre Warner is guilty of the first-degree murder of Adam Clair of the armed robbery of the conspiracy to commit the robbery
