[Music] hey guys brian bohr with berkshire hathaway and welcome to this edition of what am i signing this is one year's worth of real estate transactions a lot of paper and with more and more forms being signed electronically people need the opportunity to really learn about what they're signing so hopefully these videos help let's get into today's form so today i want to talk about the seller's property disclosure form or the seller property disclosure statement in minnesota it's a nice big packet uh comes with about 10 pages plus a couple pages at the end that gives a buyer information about radon so how do you fill these out so from a seller's side because both the seller and buyer are going to sign off on these at some point from a seller's side this should be filled out before you ever list your property these forms are going to ask you a ton of questions about the house your experiences living in the house what i tell people is be as thorough in these things as you can one the more thorough you are the more likely you're going to avoid any issues down the road any you know kind of vague areas where where a buyer maybe thinks that you didn't properly disclose something uh the other thing that i find is if a seller is really thorough in filling these out a buyer looks at it and says oh my gosh this guy knows everything about his house they're obviously not hiding anything they know that oh they lost four shingles in 1996 and they even have a note of it it just makes a buyer feel really comfortable now granted you can only disclose what you know there's going to be questions here from time to time that a homeowner honestly doesn't even know i say don't leave those items blank just write unknown so there's no questions that way and then for a buyer a buyer should be reading this statement actually read it don't just click the docusign thing actually read these when you're putting in your offer and the big thing why a buyer really needs to go through these this is a seller telling you hey here's the issues of my house here's what's happened over the last five to ten years that i've lived here when a buyer does their inspection if they find issues that are already on this disclosure form it's going to be really hard to convince a seller that they should be making those repairs for you because the seller said yeah hey i told you that i lost my four shingles in 1996 and i put it on the form and you signed on it so hopefully that makes sense it's kind of my two cents on the seller property disclosure forms but if you have any specific questions about the seller property disclosure form feel free to reach out to me i'll do the best i can obviously if your property is listed with somebody else i can't really give you advice on on what you need to be disclosing and what you can't my advice is disclose everything that you can if you're a buyer obviously make sure you read these and hopefully you guys find this information useful and we'll talk to you soon
