hello there my name is stephanie rohl and i'm an associate attorney at stone law offices in las vegas nevada and i want to talk to you for a couple of moments about a situation that may be applicable to you where you are the trustee of a trust and you have some obligations you have some fiduciary responsibilities that you need to take care of and for whatever reason you are unable to move forward with that role whether you've been in that role for some time you just got into the role or you are nominated to step into the role as trustee if that is your case if that is your situation you do have some options available to you i'd like to have a conversation with you and also look at the trust documents to see if there is an alternate trustee identified if there is then it's going to be a pretty streamlined process to have you sign a resignation and get the new trustee to sign a certificate of trust or certificate of incumbency depending on the situation to step into the role and serve as trustee of the trust if there is no alternate trustee identified you may still have some options available depending on whether or not the trust has certain terms i would address that situation so for example if there is a trust protector it's usually a very streamlined process to have the trust protector identify and nominate an alternate trustee or occasionally and we would see provisions in the trust that allow for the income beneficiaries of the trust to nominate and appoint a trustee as well sometimes i come across trusts that don't have those options available and there is another route that we can take and that is going to court in having a judge accept the resignation of the trustee and appoint or confirm and appoint a successor trustee so there's all sorts of options available to you i would like to have a conversation with you to discuss what your purpose is or your reasons behind wanting to step down as trustee maybe it could be a simple solution where office could step in and help you in some of those areas maybe it's it's really truly a situation where you're in over your head and or physically there's there's just not an opportunity for you to continue on in that role and that's absolutely fine we want to make sure that we get the next nominated trustee into that role as soon as possible or get a successor trustee nominated and appointed as soon as possible if that's a situation if once again if you have this situation yourself or if you're contemplating stepping down as trustee there's nothing wrong in that and it's actually quite admirable for you to want to seek advice and assistance in that situation please give me a call so we can have a more detailed conversation about what's...
