hello this is tips on defending yourself in court some of you simply don't have the funds to hire an attorney you don't want a court-appointed attorney and you feel that you can represent yourself adequately in court I personally don't recommend it there are some important reasons why that's probably not a good idea but you do have that right to represent yourself in court generally speaking with some exceptions let's look at three tips if you're going to engage in that self presenting you want to observe these three tips the first one is the quote I didn't do it approach is not very effective prosecutors and judges are used to hearing that quote unquote pleading your innocence and arguing with the prosecutor whether or not in front of a jury regarding your guilt or innocence isn't gonna cut it it's not enough for you to express your own opposition to the prosecutor taking action against you okay what you do want to do and this is tip number two what you do want to do is to focus on the government's weaknesses in its case against you now the reason it's so important is you want to you want to communicate to the prosecutor that their case won't won't live up to snuff in front of a jury you want to take away their motivation you want to take away any impetus they have on their side to continue to prosecute you in other words you basically want to make them a little bit scared that if they use all of their resources and energy and time prosecuting you at the end of the day it's not going to be a worthwhile investment for them because the case is very weak okay for example if you've gone through what's called the discovery which is the police reports and the witness statements and all of that stuff you've combed through that and you find discrepancies you can identify them you can back them up with contradictory statements or maybe you have an investigator a friend or you hire an investigator now they're not so expensive like before and you can uncover that some of those statements or allegations are very inconsistent or not very believable then documenting that stuff and letting the prosecutors see that can be very important because they'll think it's just not worth their time in other words you want to amass as much bargaining power as possible because you may be able to bargain something with the prosecutor where you avoid jail that's always the the order of the day at first is making sure jail is off the table or at least if it's not possible to get custody off the table to minimize it as much as possible maybe look at alternative sentencing that sort of thing you're not going to do it begging and pleading or arguing you're going to do it by amassing leverage bargaining power and documenting everything to show the prosecutor that they're barking up the wrong tree so to speak and they're really wasting their time so you must have that evidence in your corner if you can get it it's very compelling and it can make a tremendous difference much more so than doing what everybody else does which is essentially arguing on things that don't matter okay all right then the third thing you want to do tip number three is you want to amass an arsenal of materials that show that this type of accusation is out of character for you for example if you're being accused of petty theft embezzlement some sort of theft crime you may want to get character references maybe from previous employers or people who have trusted you to look after this stuff how sitting anything like that at all anything that shows that you've been entrusted with property before and you were never suspected in that situation of having taken anything so in other words you want to show for that specific type of offensive it's a if it's a offense involving dishonesty you want to try to amass character reference letters from people that show that you actually are very honest and that you have demonstrated and you've lived up to being trusted being somebody who can be confided in and somebody who doesn't run off with other people's property and the reason that that's so important is it'll help show the prosecutor that this isn't this is very this is quite out of character for you the other thing that could show is that this is in fact if you did do it and then the evidence is overwhelming the prosecutor can see this is sort of an outlier in your character maybe this was something this was an isolated incident isolated event and maybe they'll give you some sort of alternative sentencing or something called diversion diversion is nice because generally speaking there are exceptions but generally speaking you don't have to enter a plea for that to happen because once you enter a plea no contest I will contender a guilty you know that's gonna go on your backgrounds very difficult to clear that up okay other types of a file give you another example when it comes to any offense involving violence or battery or or inappropriate behavior against somebody like a sex allegation something like that again playing up the fact that you are now this time you're not looking at you're not trying to show that you're honest because it doesn't really correspond with the accusation being made as opposed to petty theft or something like that here you want to show evidence that you you know other people have been around you that maybe they've you've been around their family members or their friends or they've seen you interact with other people and you've never done anything inappropriate or sexually inappropriate or anything related to harassment again that way you you separate yourself as much as possible behavior wise from the allegation being made and then the prosecutor may have very severe doubts as to the credibility of the accuser or the accusers now this is not ironclad of course because there you know there's other evidence of course that perhaps make sure your guilt but it certainly will help to minimize or we will certainly give the prosecutor pause as to how aggressively they're gonna pursue their case against you know none of this stuff is ironclad because really at the end of the day the most ironclad defense you can have is having experienced criminal defense counsel in your area geographic area it could be statewide locally is preferred and having somebody who knows the court and the prosecutors there and the judges and who's already developed a reputation a law firm that has a team of investigators and attorneys working the case sort of around the clock so what I'm telling you I would hope are very helpful tips but nothing quite replaces the effectiveness of having experienced criminal defense counsel know all the ins and outs of the evidence rules and all that stuff but if that's not a position you can put yourself in if you can't make that investment hopefully these tips will help you out it's not legal advice okay you may want to run it by an
