either this is Jonathan Ginsberg I'm a social security disability attorney and today I'd like to talk to you about the importance and the relevance of age in education and Social Security disability decision-making and this is really a trend that I've noticed for the last few years that it's becoming much more difficult for people who are younger and by younger I mean forty five or less to get approved not impossible but but more difficult I think that once you hit that 45 year threshold 48 50 certainly it becomes a good bit easier to get approved so when you're applying for disability benefits if you're 35 let's say you're going to need to show that you have a very very serious medical condition probably close to listing level my listings I mean the Social Security's listings of impairments you don't have to be exactly in a listing but you need to be pretty close if you're trying to argue functional capacity you're going to need to have at a younger age you need to have very very strong support from a treating doctor typically in the form of a functional capacity evaluation or some sort of a narrative report but once you hit age 45 I think judges are much more willing to give you the benefit of the doubt generally people who are 45 or older have had a long work history and work history is a big deal for Social Security judges they appreciate the fact that people have worked for 20-25 years because people if you've worked for 20 to 25 years you don't just stop working to sit at home for two years hoping that Social Security will pick up benefits for you so generally folks who are 45 48 have a long work history that works their advantage the second and more practical thing is if you're 45 48 49 the number of years that Social Security disability the trust fund will be on the hook is a good bit less it's only going to be 10 12 14 years as opposed to if you're 30 years old the disability trust fund could be in the hook for 20-25 years and believe me disability judges are under a pressure to salvage and keep that trust fund solvent so it's just more difficult for a younger person to win because their judges will be putting social security on the hook for a lot longer so again when you're a little bit older when you're 40 45 48 it's going to be a little bit easier I think another factor is that when you're a little bit older in your late 40s it's more difficult to recover quickly from a serious illness or injury if you have back surgery for example it's much more difficult to bounce back and I think judges recognize that and again I think that there's just an inherent credibility when you're a little bit older as opposed to someone...
