hi guys is your divorce and family law attorney attorney Terry asked Aaron here in the state of Georgia in Atlanta and surrounding areas is where we serve and today I want to give you three mistakes that people make and modifying child-support downward okay you're wondering why your child support hasn't been lowered you're wondering why the judge has denied it we're here are some reasons that the judge is denying your child support modification number one you refuse to turn over financial documents that will benefit you okay this is for your benefit because if you thought you were just going to go into court and say judge lower my child support my income has been lowered I can't afford these child support payments thank ya you need to think again because you're gonna need to be able to provide financial documents showing that your income has been lowered okay so whether that's gonna be a termination letter whether that's gonna be a letter from your employer saying such whether that's gonna be pay stuff just showing that your income has changed the judge needs to see those things also you need to fill out a domestic relations financial affidavit you have to do that you're asking for the judge to modify child support so listen the ball is in your court to do it you need to do so that your child support can be modified okay and we're talking about a modification downward we do have videos for other modifications but this is a downward modification of child support okay number two quitting your job wait a minute wait a minute you created that mess right listen you can't just go into court and say hey judge modify my child support I decided to quit my job what no the judge is not going to modify your child support because you quit your job in fact the judge can impute your income okay the judge can say listen you chose to actually quit that job that was making a hundred thousand dollars so no I'm not gonna Moore your child support I'm gonna keep the child support where it is so listen don't go out and quit your job unless you have a very very very good reason okay and there are very limited reasons as to why you would quit your job and I get it I hear some people say well you know I wanted to start this new business well you kids still have to eat whether you're starting a new business or not okay so don't go out and quit your job expecting your child support to be modified number three failing to provide during the time that you're actually in the process of modifying your child support so this is not quite it doesn't quite have an effect on your actual modification but it can get you into some trouble okay you're fouling to modify child support maybe you don't get to court for six months and then six months you refuse to provide anything yeah the other person can actually file a counterclaim for contempt saying that you hadn't paid anything I get it sometimes we run into situations where you have lost your job your income has been lowered you can't keep up with the payments but paid something pay some good-faith payment so that you won't get in trouble okay all right so we need you to do those things those are just three mistakes there is so many more mistakes that could be made but those are three mistakes that we often see and I'm gonna give you a bonus show up the court on time yeah just simply showing up to court I cannot tell you how many times I've sat in the courtroom when someone has rolled in late on their case and their case was dismissed and you've waited six months nine months three months however long you waited to get the court just for your case to be dismissed because you were not there simple yeah you would think so but people do it okay these are three mistakes that people make in modifying child support I don't want you to make those mistakes that's why we're giving you these tips okay I'm attorney Terry and Taryn here in the Atlanta area Atlanta and surrounding areas have a great day
