is to improve the whole home improvement industry as a whole from the homeowner's side of the contractor's side so uh even though i've paid my lawyer quite a bit of money to create this contract i'm going to give it to you for free um i'm going to go through it first and before and then after this video you're going to be able to download it somewhere wherever that is focused on it beforehand that'll tell you it's probably be below in some sort of description anyways uh so this is the contract so all the areas that are highlighted is what you're going to need to change you're going to want to create go to file and make a new copy in order to make edits because you won't be able to make any edits to this one so you can have your own copy so the first section is just the definitions you can always put your your services here so not services just the service you're going to be performing uh i own a painting company here in denver so this would actually be changed out to say you know painting you know um you can leave it highlighted if you want uh it's not gonna matter because the but you know if you want to be no i'm saying so anyways so all these say service to be performed is just your service so all right there's the definitions and then the services again now the payment of services now this is basically stating your what this looks like now this is really really important uh and it's key so the total job amounts whatever the job is for this particular client the payments will be made as your payment plan so the way that we have are structured is 25 deposit to schedule the job and then 75 due at the end uh the key here are the two uh these two clauses here so the deposit is non-refundable that's key i do not want to take people's money and have to owe them money uh and try to give them a refund uh happens and a lot of times it's not my fault so uh non-receipt of payment so if they don't pay you then you can put a lien on their house that's essentially what this line is saying um which is key i've had people who didn't want to pay us um or just uh you know gave us a hard time when it came down to payment so this will come in handy you're gonna want to use that uh to your advantage i wouldn't pull that out of your back pocket unless you need to because you're just gonna piss people off but it is there so and then this is the term it's basically stating the term of this contract relationship between you and the customer so essentially it's sustaining that the contra the customer has zero say on how you perform the work you can hire subs you can do whatever you want to do in order to make sure that the job is completed the only way that they can judge you is at the end of the job the quality of the work so that's really it that's all that matters any change in service you're gonna need to provide that in writing and the customer is gonna have to sign off as well that's how we have it set up you can do whatever you want but this will cover your ass uh safety precautions basically saying that you're gonna follow the laws of safety that you need to order before the job matters beyond your control this is like any act of god any like weather issue or anything else like that um it's going to cover you on that you don't have any control over that um so yeah i could hinder your work actually happening professional capacity is basically saying they need to be professional throughout the service um there's no personal services there's no set hours you know you can show up whenever the hell you want essentially uh you shouldn't but you can you know like according to this contract and the expenses paid by the contractor you're essentially going to be paying for all the expenses if you don't want to do that and you want the customer to pay for it you're going to need to remove this line injuries is basically stating that you are you are solely responsible the contractor it's going to protect the customer on that payment schedule uh it's basically stating that you that the customer is going to pay based on that schedule you guys have set forth up top the other things is cancellation refunds uh there's no cancellation of refunds no right taxes agent entire agreement all of this is pretty self-explanatory uh can't breach the agreement rebates and then signatures make sure you change out the business state you put the customer name in here your name and then also the business name then this is where you print their name put their address their phone number and then have them sign right below that i'll actually add a line for both of you guys here as well and the total amount of the project so i'm giving this to you for free you know uh this was written by a lawyer um you know i'm not saying i'm not a lawyer i'm not gonna say anything other than that you can have this uh and do what you want with it i'm not responsible for whatever happens this is on you so hopefully you enjoyed this
