hey everyone welcome to my podcast this is danielle uh today we want to talk about authentication and so when we're admitting evidence there's a lot of rules to be able to admit the piece of evidence and decor of course everybody's got their piece of evidence that they want to show the judge like the audio recording or the video recording of your soon-to-be ex spouse cheating or that text message well it's very difficult to get that evidence properly into court and there's a certain process so we just wanted to talk about that so as you're also building your case you're probably watching this and it's on the eve of your divorce filing or you're just getting into dependency of your divorce this will be a brief snapshot so you really know how to collect the data that you need to build your case like i said always have an audio recorder you can get the old school ones from best buy or even online they're little sony ones they even look like the old tape recorder ones and they actually have a usb stick on the end so now they just slide into your computer and you can download the audio files right off like that because a lot of times when you when you have a phone you can't record on the phone well i think every single phone is like that now so if you have an audio record you can just put that phone on on speakerphone and use your audio recorder to record the conversation which is as you all know is perfectly legal in georgia with that uh we'll jump right in thanks justin authenticate authentication i know that's a tough word to kind of get out if you haven't seen it a few times in a row um well thank you for that you look nice tonight thank you thank you well justin let's start right out the gate why don't you give us the the legalese or the uh well i guess the i like to call it the civilian term of authentication um what the definition of it is please explain to us yeah i don't think i pronounced it right authentication uh when i started off this podcast but it's showing that a document or thing is what the pro proponent claims it to be in other words it's offering sufficient evidence that a reasonable person will always have that reasonable person standard in the law could find the item authentic awesome thank you um i guess we'll kind of dive into a few things about authentication um let's start with voice record voice recordings wait we're just all over our words tonight um how do you authenticate a voice recording so uh what you need to do is what we call lay a foundation uh that those are the terms in the evidentiary law that uh the witness is familiar with the voice of the speaker...
