hello and welcome to our video my name is John Watson a consumer protection turning state of Alabama the question will look at today is if you're dealing with the debt collector the question is should i keep a signed copy of any letter i sent to a debt collector and the simple answer is yes you want to have proof of whatever it is that you sent to that debt collector now we're not talking to this video about should you do it by fedex certified mail fax we cover that in other videos but this is just the question is do i keep a signed copy well let me give you some ideas or some reasons why so under the fdcpa that's the Fair Debt Collection Practices I you might send a dispute letter and because the debt collector gets that dispute letter then when they update your credit reporting they have to show it as being disputed and let's say they don't do that and you saw and they go well you never told us you disputed it we got a letter from you but it was a letter saying guys thank you so much for being the most awesome debt collectors in the world it is anything about disputing you go well actually I've got one right here I have a copy of signed copy or maybe you sent a validation letter and because of when you sent it and what's been going on that debt collector has to stop its collection activities until it decides to validate the debt well you want proof that what your letter said was I'm demanding validation of this debt you might send a cease-and-desist letter say hey don't ever contact me again and they continue to call you right to etc and then when you soon they go well no you just told us that you didn't think you owed it you didn't say stop communications or I refuse to pay you go well here's my signed copy then we have the TCPA telephone Consumer Protection Act and so you might have a debt collectors blowing up your cell phone with robo dial calls so you send a letter it says guys don't call me on my cell phone anymore here's my cell phone number I'm taking away permission if you think I ever gave permission to call my cell phone and they continue to call well you want to be able to show that that letter actually took away permission we had one of these where the letter did that and then there were hundreds of calls afterwards and each call could be minimum of five hundred dollars all the way up to $1,500 / call and we had hundreds of calls I'll let you do the math on that very big case very important to know exactly what our letter set so how do you do this well here's simple way print out two copies of the letter sign both though one you mail or fedex or certified mail or however you're doing it but the other you keep and you signed it like three seconds after you sign the first one put it in a folder label the folder this was a letter I sent to Midland funding or portfolio recovery or whoever am sure collection this is a letter I set on sep tember 22nd 2016 great put in there stick your letter in there now I would also keep a digital copy so take that sign letter run it through your scanner or take a picture with your phone or get a little app for your phone to do a scan so it will be in a PDF form and then you can email that to yourself you can put on dropbox put it in Google Drive box.net email it to a yahoo or a gmail account whatever you need to get in the cloud so that way if you lose the physical copy and maybe your phone blows up your computer blows up you still have it in the cloud I know that probably seems like way overkill but it really doesn't take very long scan it in email it to yourself at a gmail or yahoo type account so those are our suggestions and you know to answer the question yes keep a signed copy I would keep a physical signed copy and a digital signed copy and then if you need that letter so if you don't need it okay maybe you wasted you know five minutes but if you need that letter incredibly powerful to have it instead of going well it I think I have a word version somewhere maybe I changed it i'm not really sure no to keep a sign physical copy assigned digital copy hope this is helpful to you if you have questions and you live in alabama feel free to give us a call 205 879 2447 you can always reach us at alabama consumer calm a ton of information there of course we have other YouTube videos you can watch as well it also has a contact us form on there but for a lot of people the easiest thing is just pick up the phone 20 5879 2447 you can ask for carolyn or randy and they can take down some information from you by phone then set up a phone call with me and I'll be happy to walk you through your options there's no charge for that we can do it all from you know the convenience of a video chat or just a telephone call it's that way you don't have to come down to my office so thanks again for watching this and feel free to subscribe if you like this and you haven't already subscribed and we'll send some more videos too ok thanks have a great day bye bye
