hello Rebekah's dong divorce attorney here with you again today and today's Tuesday so it's Tuesday divorce tactics thanks for joining me again today today I'm going to be talking about how to deal with pets and divorce but first I just want to remind you mentioned that I bring these tips every single day and the reason I do that is because I am one of the top 1% of divorce attorneys in the country and one of the things that I saw in my practice is that people don't have access to really really good legal advice unless you have lots and lots of money so my goal my passion is to bring everyone my knowledge and make it available to everyone so that's why I do this and I continue to do this through private programs and my book and some of the other things that I deliver so that's how I help people I help people through social media and I help people through many other ways that you can get support which I'll tell you about more at the end of this today's presentation so today's topic is one that is very near and dear to all of our hearts or many of our hearts and that is you know how to deal with pets and divorce pets they're almost like children to many of us and as much as we love them in the harsh cruel world of divorce they are not seen as anything other than personal property that gets divided when the property is divided so it's just part of the property division case that being said the statistics on pet custody cases if you will are actually rising a study by the American Academy of matrimonial lawyers recently said that custody cases actually court cases where people went before a judge to to deal with what would happen with their pet those cases are up by 22 percent in recent years so it doesn't appear this issue is going to go away anytime soon so how can you best handle this situation number one if you're still married then and you're still getting along then and you know maybe just like a prenup you sit down sit down and write out a written agreement about what will happen with the pets if you decide to get divorced or not live together anymore custody agreements about your actual children are not generally enforceable just so you know if you try to do that in a prenuptial agreement or a post-ops agreement they're not generally going to be enforceable but agreements with regard to personal property ie your for a family member they will be enforceable if you are divorce or divorcing you can still come up with a custody arrangement with regard to your pet I've seen some cases where the people decided that the pet would just travel with the kids so whenever the kids were exchanged the pets were exchanged in that way the pets were always with the kids or if you want you can come up with a schedule it's just for the pets if you want if you do come up with a shared custody arrangement make sure you designate who will be responsible for paying for the pet veterinary bills food shots flea-and-tick medicine things of that nature and if you do decide to split the cost like that make sure you put in the pro rata share in other words I'm gonna do a 50/50 or you're gonna pay 60% I'm gonna pay 40% or you pay a TI P 20 or whatever and then make sure you include language that says something like if one party incurs a bill and pays for the entire bills and that person has 30 days to present the paid bill to the other party and then the person has 30 days of receipt to reimburse the other party so that's how you deal with that if a judge is forced to make the decision then the judge will have to look at things like that indicate who's more the owner of the pet like the adoption papers or who paid more of the bills or the expenses or who cared more for the pet and other indicia of ownership that's like the worst of the options I think because you know if it's the family dog and one person always fed the dog you know does that mean that that dog really belonged to that person I don't really know but you know the judges are gonna have to come up with some way to try to figure it out and it's not usually the best thing so if you can come up with an arrangement yourself that's really the best thing and a lot of people you know in the end they just decide that one person can keep the dog or the cat or the parakeet or whatever it is and the other person will just don't get a new one or maybe have visitation rights and get to see them every once in a while so in the end please remember that these pets do need to be cared for they need to be cared for continuously and so if you're the one who has this long grueling work schedule and the other party is maybe not working as much or home most of the time don't like take the pet just to spite the other person and then have the pet sitting home alone all day that's not necessarily fair to the pet so you know just like the rest of your case a little bit of common sense courtesy consideration respect it goes a long way toward you getting toward that goal of that amicable inexpensive divorce that I know that all of you want so and really the end goal is to get you that much closer to being able to start in your new life so so that's my presentation for
