With airSlate SignNow we save time and money. The documents can be signed in a much shorter time and you don't have to pay for sending them. Of course, you pay if you take the package but it is nothing compared to how much you get when you have to send it by post. Plus, in some countries, you have the surprise of not getting the mail at all or getting it too late.

all right what's going on party people it's like 1 30 in the morning doing trying to do a quick quick video for y'all um to show y'all some information that i learned over the last couple of days that's why i was sort of mia because i've been processing all of this stuff just to make sure i understood everything what's going on um but when i'm been up this late i'm up this late because i also was responding to a lot of your emails um sending out emails concerning people who wanted to know about information about the depositions um finished working on a video for um about the house inspections uh people been asking me information about uh providing support for them and helping them get going with the notary stuff so i've been emailing them um took a young man out this evening last evening on thursday for um to observe me doing a closing everything went well with that um he learned a lot because the closing went crazy um at one point where the gentleman his numbers was all wrong um the altar was telling him he owed over fifteen hundred dollars the cd was telling him he was getting back eight over eighteen hundred dollars and then the cd that he had from three weeks ago not three days ago three weeks ago was telling him that he was supposed to get back twenty eight hundred dollars so all the numbers was off got it all straight did the signing um and everything went well and guess we was there longer than an hour we really could have got in and out in about 35 minutes had there not been any problems so gentlemen malik that's who just came he he learned a lot and i'm glad he came and then me i'm going to get together probably in the next day or so this weekend and do a zoom and record him me and him talking and um he's going to um you know be talking about his experience with everything and what he learned and all of that so y'all can hear from him and because he came out um as you see i got a new book and it's called mindset see if i can get it without dismissing my white balance up this here's a great book great great great great book this is the book that got me really going forward to the mindset that i have um first time i heard about this book was when the miami heat when my lebron james first went to miami heat and he was talking about them winning the championship and he said eric spoelstra had them reading a book called mindset talking about growth mindset i found a book i went and researched it and it's a little small interview that you know you probably won't ever be able to find of him and i just happened to catch it i went and found that book and i'm gonna tell you that book will help you out it talks about having a growth mindset versus a fixed mindset look her up carol dewick you'll see videos on her look up carol dewick mindset and you'll see videos listen to her you'll understand i'm not even going to try to explain it to you right here um i want you to research this out for yourself telling you once you understand mindset it will change the way you do things and you gotta have you either a fixed mindset person or growth mindset you're one or the other you can change but you're one of the other and yes it's probably better to be growth mindset and you need to understand what that entails so enough said on that um but yeah i was emailing everybody making sure everybody was i responded to everybody all of crazy been doing a lot of closings and all of that and just so happened thursday i had just one which allowed me to get caught up with some other stuff helping some folk out with the websites all of that kind of good stuff so um tomorrow i'm booked for today friday i'm booked with four and everything and then i got one on saturday and i'm trying to do some stuff also to help some people out on saturday so that's why i was sending some emails out um now to the main topic of why i hopped on here tonight um that subject of notarizing the note came up again and i now have an answer now granted i know some of the old heads who have been in this game longer than me or even people who haven't been in the game along with me but are like don't notarize a note you are correct to a certain degree and there is a time when it can be notarized but the thing is who notarizes it and that is the answer that is that i mean that is the question who notarized it and i can tell you right now the answer is if you're not a attorney notary you can't do it if you're a non-attorney notary if you're an attorney notary you can do it that's something to say you are you can do it that's why i'm tired but if you are not if you are not attorney notary you're not able to do that so you so if you're in a notary but you're not an attorney can't do it and i'm gonna give y'all proof okay and this is coming straight from the nna um let me share my screen so as you see here is the note let me zoom in a little bit this is the note in the verbiage in question on this it says this is the certified that this is the note described in the security deed against and secured by the diesel trust data dot dot dot on the property located in blanket blank virginia and then they want me to sign registration all of that stuff as if i'm notarizing or basically really certifying i'm notarizing and certifying this note and that's becomes a problem um after talking to the nna they said this verbiage is not an acknowledgement verb so we can't got it but the title companies they don't see it that way what they're saying is because this is on here because this is on here we are to notarize the note however what they're talking about is they're saying we're notarizing this acknowledging what they say we're not certifying the note but we're acknowledging that we saw whoever up here signed it the problem is there isn't any kind of language on there acknowledgement language to support that what they're saying is because this acknowledgement this language is on here which is on the d and i just put the word um the d slash mortgage on here so you can see it um because yeah um because this language is on here they're saying when you saw them signed a d and you acknowledge that they signed a d therefore based on this language here you can notarize that they sign the note and i said now that i have a better understanding i cannot i cannot do that because there's no language the language that's on here is the language for notarizing for certifying the note so me and the indiana i mean many um title people was going back and forth back and forth and it was like well just attach an apa to it i was like for what i'm not certifying a note so when i contacted the nna this is what they gave me let's zoom in on that and basically and i'm going to find a way to make a link to this and put it in the description um and if the link isn't up there when i first put this video up i'll get it up there somehow but for the bottom line is that if you are a non-attorney notary you are not allowed to notarize the note or certify to know what i mean please forgive me y'all i'm a little tired a little tired and talking slow moving slow so that is what all of this is saying pause the video if you need to so you can read this um and this is for virginia's you know so basically we have not been authorized to do this by the state of virginia and it's all outlined in here i'm just scrolling up a little bit so y'all can read through it like i said pause the video if you have to so you can read it i'm gonna put a link in so y'all can download it and look it up you know read it over for yourself what i'm understanding from this um like here second the act on the virginia note requires the exercise of legal qualifications and skills that a non-attorney notary does not possess stated another way a notary who certifies a note has engaged in unauthorized practice of law why because in order to perform the act the notary must closely inspect the security instrument to ensure that the note is described in and secured by that deed of trust a notary must provide legal advice that the note and the deed or trust are linked it is one thing to lice for a licensed attorney to make the determination quite another for a non-attorney to do so so there in other words what it is saying sorry about this going back up to the top in virginia you can have a note to be notarized but it says the security instrument security note is notarized so in virginia and certain mortgage transaction includes the notarization of the note so that's why i said you saying don't notarize no it can be but you have to be qualified to do that again people don't you know when you don't understand don't know the law this can happen but it's okay you learn and then you move forward with this so scrolling back down this is and and the reason why this is important because this here this right here this right here um it says the attorneys in virginia who helped pass virginia's notary law amendments during the past decade have confirmed to the nna that to certify the note is an unauthorized act in virginia so it is unauthorized for us to do that if you're not an attorney notary you need to be an attorney who's also a notary if you are then you have the skill set to go and the legal qualifications to certify the note and to notarize that that's the only time you can do this now the n a also informed me that if i wanted to well not so much wanted to know about what i want to they said if they need the signatures acknowledge meaning have an acknowledgement that says i witness them signing the note then i can attach an apa to it i'm not notarizing the note i'm acknowledging that i did see earl jones and jane jones signed a note and i said okay fine if i that's illegal for me to do i'll do that and that's what they was asking me to do but the way they was wording it it kept coming back to certifying a note and they wasn't being clear with me so when i talked to the supervisor for that title company and i explained to her i'm not saying that i don't want to do i said i just can't because the proper language isn't there and they kept saying well because the go back to that they kept saying because this is here because this is here that i should be able that i'm supposed to notarize this and they literally saying every time you see that you're to notarize and i'm like but if the verbiage isn't there what am i what are my notarizers and she said well you're acknowledging their signature i said where's the statement at that says i'm acknowledging this their signature well it's on the deed i that verbage on the d does not transfer over to the note so this is what was going on so it's clear to me now what was going on and hopefully that cleared up some stuff for y'all again contact the nna and i'm and i know people going to say well you still can't do that because you're not supposed to you can't attach a a apa all-purpose acknowledgement to acknowledge that you saw them signed a note then i would encourage you to contact the nna and discuss it with them that's what i would encourage you to do um and this only comes up every now and then and that's really the only options that we have okay um now i did suggest to the nna that they bring this topic up at the next um conference i also suggested it to the title company that i was dealing with that they maybe put instructions indicating to the you know in informing the notary what is really what they're really asking them to do um with this section here and the answer came back was nothing but quietness and i'm like okay this is where the problem comes in is that there's a situation like this and nobody wants to just okay yeah we need to to deal with that on a broad basis okay you need to deal with this on a broad basis it needs to be dealt with in a broad broad manner so that it's not a problem and everybody's doing the correct thing and stop my share and right now it appears that neither one wants to so that's why i'm doing this video so that you can be aware and i hope this video clear because i'm tired and i'm probably slurring my speech don't sound like it but hopefully i'm not and i hope my volume isn't too low um on this i'm trying not to wake anybody up in the house and everything so hopefully the microphone is picking me up well but the bottom line is simply this um in virginia if you're an attorney have the legal qualifications and skills you can certify the note basically because it's being secured by the deed if you are a non-attorney notary like me and like you then you can't however if they need a acknowledgement saying you know basically needing you to acknowledge that you saw them sign the document you can attach an all-purpose acknowledgement on there to that fact based off your release in virginia i don't know about anyone talk about other state but in virginia based off of um the proper way you posted notarized and this is what the n a is shared with me so again if you have any questions go to nna i'm not an attorney i'm not trying to give you legal advice i'm just sharing with you what was shared to me and everything and and it was a heated debate about this so that's where this stands at if you choose not to well you do whatever you you want but i'm the type once i see that things aren't going right i try to research it out and try to figure it out and unfortunately i just didn't have the time to when all of this first came up so i think i can't remember the person i think was darkness something that um made mention to that to me and we got it all straightened out now at least for virginia other states you may want to talk to the nna about this and ask them what the deal is so um thanks everybody i'm about to go to bed because i got to get up is what 1 45 in the morning i got to go to bed and get back right back up and take my son to work and um and then roll out for some signing starting at nine o'clock all the way to four
