welcome back to my channel i pray all is well if this is your first time here welcome if you're already part of the family welcome back um today is going to be um i'm kind of just throwing a lot of information into one video first things first um i'm gonna call this like kind of i guess housekeeping um and this is particularly for the newer signing agents or those who are just um you know newer in the business or thinking about getting getting into the business um i cannot stress the importance of you cannot be a loan signing agent until you learn how to be a notary public what i mean by that is you need to know what a notary public is you need to know what you're allowed to do you need to know how to read notarial wording what to do if you don't understand it you need to understand when is the proper time to attach loosely certificates how to attach these loosely certificates um that everything and you know um i can't really i'm not going to say specifically what you what you should do or where you should research because every single state is extremely different the process to becoming a notary public is very different um so that means we also follow completely different rules to save yourself um trauma headaches drama all that in the long run you need to understand how to be a notary public in your state there is no if and shortcuts about it um before even signing up for a course like a loan signing agent course you when you're taking um i think i don't think i don't even think every single state requires a course but if your state requires a course you need to use that as a free resources as a free resource you don't need to speed through the course take your time to actually understand the information if it's something that you're still confused about you need to buy a book get on youtube you need to do your research okay before being a loan signing agent you are a notary public okay the other thing with that is you need to understand even the small details every single state may have like a specific pin color so if if it's not um designated on the actual document what color to use blue versus black um you need to know what color ink you're supposed to use in your exact state the other thing is um i kind of played myself when i the first time i notarized my document i had never physically used the stamp before so i actually completed my first notarization it was on the hood of a car and i tried to stamp the document on um i believe it was either the hood of my car or it may have even been like a folder which is not that firm so i kept trying to do my stamp and it kept messing up because as you know if you can't see the whole border with all of the words very clearly the step will not suffice so something else i recommend is when you do get your stamp play with it okay you should always i as i said in my uh what's in my notary bag um video i always have clipboards so that if there is no firm surface i can easily pull out that clipboard and go ahead and apply my stamp to it every single state is different i'm here in pennsylvania i've been fortunate to find a facebook group along with mentors who have been notaries in my states for a while so i'm able to ask them questions and get all of that answered i recommend the same thing try and find a facebook group try and find a mentor in your state but you need to utilize resources so that you know how to be notary public in your state i i cannot stress that enough and so i also have a video hopefully i can figure out how to like put it somewhere um what to do while you're waiting to become a loan signing agent that video is very very important i understand that you know we all want to make money you know the whole 75 200 per hour of course it's excellent money but i'm trying to tell you if you don't know what you're doing if you um really screw something up not only can it mess up whether if it's a loan closing not only can it mess up you know the funding and your relationship with that title company that can also lead to possible legal issues and so with that being said um that's something else that i wanted to discuss um is just legal issues um and just how to basically save your butt i'm not of course i'm not an attorney i you know i'm not here to provide legal advice i'm here to just give you guys um basically what i've been told and what i've read in different um types of resources so yet you can be sued as a notary okay that is definitely a thing especially when you are doing loan closings um but you can be sued for anything anything that you apply your stamp your stamp on that can come back um and haunt you um here in pennsylvania we are required by state to carry a actual notary journal as i said i'm dual commissioned here in pennsylvania and in florida in florida it is not required i actually had a call today it is strongly strongly strongly recommended that no matter whether it's required or not you need to have a journal because if god forbid something does come back um you know for whatever reason it doesn't matter what the case is the first thing they're going to ask you is for documentation um in that journal and the best thing um to cover your tracks is to have that journal filled in as accurately as possible um name address that notarization took place the all the information on regarding the um designers identification if you attached a loose leaf certificate you need to go ahead and put that in as well and what type of um notarial act that you actually um and what type of ontario act that you actually perform and so i think i forgot to mention that earlier i y'all know i get scatter brains sometimes but but newbies i really i really don't want y'all to just rush in and just ruin everything for yourself you also need to know the different types of notarial acts you know there's acknowledgments there's directs there's simply witnessing signatures certified copies there's so many things um that you could do everything is state specific so before um you know you even honestly take your first loan signing in my opinion you you would probably need to do some general notary work and so i do have a video i have multiple videos about what is general notary work how to get general notary work but the thing is you have to remember loan documents are anywhere from 75 pages to maybe 200 pages you're not going to be notarizing every single every single document but you are going to be notarizing maybe seven or eight different documents and it's going to be a variety of different things some may be juris some may be acknowledgments you never know okay so before you even get into um all of that because we all know that it's not just the notarization you got to tell people where to sign explain the documents and all that good stuff you just need to know how to simply perform a an ontario act so my best advice would just to do um some general nerdy work in your communities you can do small things like property deeds wills trust simple things like that if somebody needs a document for school i've seen so many different type of documents these are simple one pagers two pagers that you can get some practice okay you want to go ahead and get comfortable with these things so that when you are given the more extensive real estate loan documents you know exactly how to handle those and i'm trying to tell you right now okay when you when you do become a signing agent um and you do get the pack of documents there are going to be documents that you have never seen before where you are going to have to ask questions so that's one thing now if you're calling the title company and orlando asking them you know what do i foreign part what do i put here or um you know what goes here and these are really really basic questions they're going to be looking at you like you're crazy you know what i'm saying if you don't know how to do simple things to be a notary public you should not be signing um any real estate documents okay you gotta remember these are people's homes okay i i know i've told you guys all the great things in the world about being a lone signing agent because it is absolutely phenomenal but you also have to realize how serious this is okay these these are people's houses okay the everything is not finalized until these documents are signed and notarized by you okay that comes with so much whether it's delay of funding um having a very very upset title company so again just to save yourself the headache do your work early other ways that you can just avoid any legal matters whatsoever remember that whenever regarding um being a signing agent we're there to show them where to sign and kind of give a brief synopsis of what they're signing so if they want to know what is their loan amount what is their interest we can simply so that on the closing disclosure now if they're asking why is my interest rate 2.75 or do you think that's a good interest rate absolutely not that's where we're like you know that that is not my role that is not my place to answer that question but i would be more than happy to um see if we can contact your lender and see if we can get some clarification for your question and so the last the last few things that i would say and definitely definitely please learn from my experiences because people are going to try you especially with general notiwork they're going to see if you know they can wiggle around the actual rules do not bend the rules whatsoever you stick to what you know if they are unable to provide whatever information or proper documentation that you need you tell them you are unable to notarize this document once they um you know find the proper documentation you'd be more than happy to complete it for them so with that being said i'm pretty sure it's like this in every single state whenever before you notarize any document whether it's for being a loan signing agent or just simple general notary work you have to see some proof of identification it's usually going to be a valid unexpired photo id which um usually a driver's license or a passport will suffice with that being said okay kobe is going on so there are some special restrictions in every single state what do i mean by that so if a driver's license is expired um and let's say it expired maybe three to four months ago check with your state to see if they are allowing extensions of expirations because i believe you know the dmv may be backed up or something like that so they have created special rules in case of an expired id but make sure that you are on the department of state's website even if you need to call them to confirm what ids will and will not work and then another thing just um it's happened to me a couple times if the person who's supposed to be signing the piece of paper is not in front of you you do not need to notarize the document i know that should be self-explanatory but i'm going to go ahead and say that because people will try you okay if if the person if the person is not in front of you and that um you don't you don't sign the document if the person does not have any id you do not sign the document no matter how much they sweet talk you they're gonna try and say oh i give fifty dollars no we're not doing that okay fifty dollars is not worth you losing your commission and possibly um having to deal with some legal issues that's it for this video i just wanted to um kind of do a strong strong psa to all the newbie signing agents i understand it's very exciting there's definitely um the opportunity to make a lot of money in this field to create your own business there's just so many positives but the thing is it's a process we're not going from step one to step 10 and skipping all of the important things if you guys have any other questions whatsoever if i missed anything you know i'm i'm still learning i'm you have to be a constant um student of the game so i'm still learning every day if i miss anything in regards to you know probably ways that you can get sued or other things that you should definitely avoid go
