Hey guys my name is Tiffany and I'm a notary public for the State of California and I currently work for Rate One Financial as a Loan Partner 2. So today I will briefly go over a few facts about notarizing documents and frequently asked questions that I come across. So stay tuned! Okay, so first off what exactly is a notary? Well, a notary is a public official who certifies or witnesses signatures on official documents. Next, a lot of clients wonder, why do I even need a notary when I'm signing documents? Well, just to kind of simplify things I'm confirming your identity. When I confirm your identity I'm looking at your I.D. and I'm also comparing it to the signatures that you're currently signing for the loan documents. And for real estate documents I actually have to get a capture of your right thumb print. And I put it in my notary journal. So bottom line is I have to prevent fraud. When I actually make the phone call to schedule my clients to come in a really popular question I get is what should I expect when I am signing my documents? So, since my area of expertise is in real estate loan documents I'll go into the process based on signing loan docs. So, the first thing that I need to do is to make sure that you're aware of what's actually going on. Secondly, I'll show you my notary book that way you can kind of follow along with everything. I have to actually enter all of the information based on your I.D. and as well as your signature and anything that's on your I.D. will go into here. Lastly because we're in the State of California and it is loan documents, I will need to do your right thumb print and actually use my ink pad to do that as well. Lastly on my end of everything I need to actually sign, notarize using my handy notary stamp as well as date and complete all acknowledgments and jurats as applicable. Now I think my most popular question is, "oh my god, why do I need to sign all these pages!" So basically, any loan that's conventional or is backed by the federal government, it has to require a lot more verification and identity. Unfortunately you guys mortgage fraud is a federal offense so by you signing those loan documents, you're agreeing that the monthly payment that you're making is actually those monthly payments that you're making. The amount that you're saying that you're making for income, that's actually the amount I'm making for my income. And that you're agreeing to the occupancy of how you're going to buy the property or refinance the property. So yes, it is a lot of paperwork involved. Also let's think about it, most mortgage are at least 30 years or the ones that we typically do so it's a huge commitment. So the signing of the loan documents contains information to insure that you understand what you're getting into. Okay guys, lastly I'm going to give you a list of things I cannot do as notary which I call my list of no-no's! So, if I can't properly identify you, I can't notarize the document. If you appear to be confused, intoxicated or just lacking any type of mental capacity I can't notarize that document. If you look like you're being coerced oops, not an option. No blank documents please, everything must be completed prior to me notarizing it. And unfortunately I am not an attorney, I did not go to law school at all, therefore as a notary I am not responsible for the accuracy or the legality of the document that I am notarizing. Also I'll get into huge trouble if I try to give any type of legal advice, so please please please do not ask your notary to interpret the documents they are notarizing.
