hi I'm Steve Richardson one of the questions I ask my clients and the process of preparing a bankruptcy petition is have you made any payments to any of your creditors in the last 90 days that total more than $600 and do you owe any money to friends or family that you made any payments on in the last year want to know why I asked that question well let's find out the answer is that the Bankruptcy Court is trying to find out whether you're giving preferential treatment to a particular creditor you see the idea of the bankruptcy laws is that all creditors be treated the same way all secured creditors all unsecured creditors they're treated the same and I view your preferential treatment to one over the other that can cause an issue in your bankruptcy now with a credit card debt or a medical bill or something that's arm's length as it were they only look back 90 days and they only look to see if the payments were more than $600 so if you have small debt to a $300 and you've paid it off they don't need to know about that because the threshold is at least $600 over the past 90 days and total payments to a particular creditor but if you owe money to what's called an Insider someone who is familiar with your financial situation might know you're insolvent or to whom you have a particular personal connection it's not an arm's length transaction the look-back is one year not 90 days and it's not a minimum $600 of payment there requires disclosure it's any payment so that's why I ask that question and that's why you have to provide that information because the Bankruptcy Court wants to make sure you're not giving preferential payment to one creditor over another so if you live here in southern New Jersey and you're thinking about filing bankruptcy please feel free to give my office a call I'll be happy to sit down and discuss with you your situation and see whether bankruptcy is right for you
