hello i'm vince white i'm an employment attorney and a viewer of the channel asked us a very clever question she wanted to know what is the difference between a title vii claim which is a statute that protects against discrimination in the united states for various classes of people and uh what's called a section 1981 claim or a 1981 claim so these are both claims that combat discrimination in the workplace and in the case of 1981 other places as well but they're not really the same and congress has been very clear they shouldn't be treated as its name difference number one title seven does protect against the spirit impact claims and 1981 does not that's going to be key now we can get into what disparate impact is i'll probably make a separate video on that so go ahead and check the channel for that separate video but that being said this is an important distinction two section 1981 does not require an eeoc charge to be filed now that's very important because while i find the eeoc useful for my clients it is kind of a failed agency they're not really properly funded properly staff they're not doing a whole lot to help fight discrimination anymore and if you're not represented by an attorney in the eeoc i have concerns for you right i have concerns about your case getting the time and attention it needs if you don't have counsel so that is you know that's an advantage 1981 in a way difference three 191 has a much longer statute of limitations now this is key depending on what state you're in you might have to have your eeoc case filed within 180 days or 300 days depending right but 1981 you're going to have up to four years for your statute limitations that's really important the next really important damage uh really important distinction to 1981 there are no caps on damages under 1981 claim title vii claims do have caps or soft caps in some cases on damages that can be really significant hurdles to a plaintiff who wants you know that big big payday 1981 claims however do not have these caps important to know you should be pleading both and the final difference and this is very important a section 1981 claim really only applies to race while title vii claims apply to a number of different forms of discrimination i hope this has been helpful happy to dive into any of the other distinctions here or dig deeper on any one of these i will track the comments on this video i hope this was helpful and i wish you all the best of luck
